  1. What is your state? Seems that they asked more requirements than ours. Here in KS, if you're going to apply a Learner's Permit, you'll just need to present your SS card and valid ID. In my case, I presented my K1 visa with a stamp on it and our marriage certificate and explained that I don't have an EAD or GC. After that, you'll just need to pass the written test and vission test.

    I think that's possible.

  2. You guys should be okay. If you move to USA and then he'll be gone to work for 1-2 months, then you still have extra 30 days to get married. Same situation happened to me. When I moved here last July, my husband had to go to Europe for his tour, what we did when he came back was processed our marriage right away. But we did applied for a marriage license before he flew to Europe so by the time he returned, everything was set already.

  3. I'm terribly sorry about what happened to your marriage. Sounds like this man is cannot yet stand on his own and was not ready to handle married life. Just make him sit and talk to him heart to heart. Tell him how you feel and how uncomfortable it is for you when he prioritize his parents (mother in particular) than you. Tell him how hard it is to be a foreigner in other country without any relatives from your side and you had to adopt everything yet he is not there supporting you. You will find out the answer when he talk. When all else fail, you have no other option but to return to Philippine since you don't have a legal case here in America.

  4. I'm so sorry that your relationship is on a bumpy road right now. But what you should really do for your own good and your child's good is to stay in the Philippines. This petitioner seems so irresponsible to do that to you and HIS child. Imagine a future with him. Lets say he change his mind and would allow you and the child to come over in the USA and then a month or so you will have a misunderstanding with you and then he would do the same crazy BS. You will be left behind with nothing.


  5. Sorry, friends. Not visa or petition related but to those who have tried this before, can I bring package from US to Philippines on our vacation? We planned to travel back to Philippines next year and I have a balikbayan box full of goodies for my family in the Philippines but I don't want to ship them for now because I've heard so many failures in delivery particularly in our province in Negros. So I think maybe it's safer to just check in it at the airport on our flight date. But is it possible?

    Answers and ideas are pretty much appreciated. God bless us all. :)

    Smells like no one find you in SAVE database - but it's quite possible that:

    1. SSA clerk not know what they were doing or

    2. you have error in SAVE database on your name, captured at the POE.

    Hi, I just received a letter from the Social Security Administration. They said that my card will arrive in 2 weeks. The reason why they had to check it to the immigration is because of the mistake of my last name recorded. The immigration forgot to include my last name which made my middle name my last name on their record. When I applied in the SSN office, I put the complete name which seems like a mistake because the last name that I used is not the one on the immigration record. However, the double check was done and successful. My card will be delivered in 2 weeks.

  7. Deportable? I don't think so. As stated above, you are considered "out of status" between I-94 expiration and receiving your GC, but as long as you don't try to cross a US border, no issue.

    I agree with Darnell, I'd go file for a SSN right now, before your I-94 expires. You can always do a name change on it after you have a marriage certificate.

    I already applied SSN, they are checking my name to the immigration yet and they said they will send it within few weeks.

    My concern is about my status. I'm sure we can get married within the 90 days but we can't file the AOS right away because of the 3 weeks waiting to get the marriage certificate.

  8. This is asked often. There is no deadline to file for AOS. As long as you marry within 90 days of entry with the K-1, and never leave the US, then you are eligible to file for AOS. However, you will be out of status when your I-94 expires and cannot travel and re-enter the US, work, and most likely not be able to get a license or state ID until you file for AOS and get your EAD/AP or green card. You won't be deported, but there is a small chance of being detained while out of status. Once you file for AOS, you will be a new period of authorized stay. Just file as soon as you can.

    Thank you. So it wouldn't be a problem then? We planned to immediately apply for AOS after the marriage because we thought that we could get the marriage certificate after 3 days but the court said it will be issued after 3 weeks. So we have no choice but to wait for it even if we can file right away because it is the number 1 needed in the AOS packet. And yes, we will get married within the 90 days. Thanks for the answer. I feel relieved now. :)

  9. Hi friends, I'm here again. Please bear with me and I hope somebody could enlighten me from my confusion.

    Here's the situation. I arrived here in USA last month. So I only have 2 months left now because I'm under K1 visa. However, my fiance will be working in Germany for 1 month starting on 31st of August. We already got marriage license and planned to get married on the first week of October which will be my last month under K1 visa. The court said that we need to wait 3 weeks to get the marriage certificate so I thought we couldn't apply for an AOS immediately because we have to wait 3 weeks for the marriage certificate. And by that time, my K1 90 days is already expired.

    My question is. Would it be a problem if we apply for AOS after the 90 days under K1 visa? Will I be deported just because we can't file AOS right away even though we're already married?

    The AOS Guides here (see link atop any VJ page) are very helpful. In brief:

    Marry within the 90 days of entry into the U.S.

    Take every step to get more than one copy of your marriage license, rapidly.

    Have the funds already allocated to be able to file for AOS as soon as possible.

    File just as soon as possible after you've married.

    Most definitely file for AP & EAD at the very same time.

    General advice on important documents (not necessarily immigration-related, but to ease your path in your new country):

    Depending on how much time you can stay in your country after receiving the visa (meaning, are you traveling within days of receiving it, or can you stay longer?), get more than one copy of these and similar documents:

    Your birth certificate.

    Divorce or death certificates of previous spouse(s), if applicable.

    Birth certificates of children, if applicable.

    University transcripts or school records.

    All medical, dental, & vaccination records (see below) that you can lay your hands on.

    Your driver's license from your country, with as long a term of validity as possible.

    Any other official document that would be impossible or expensive to request from the U.S.

    In regard to vaccinations, get all of them in your country, as is possible. Have a doctor transcribe them onto an officially signed/stamped paper that you get at least two copies of. If you got vaccinations as a child, ask your doctor or clinic to provide or reconstruct your record for you. Vaccination information is required during the AOS process, and these papers could prove to be invaluable to you.

    The above is a "quick & dirty" overview. Study the VJ Guides, and pay attention to what knowledgeable VJ members have to offer in this thread and in the ones that you'll surely review in the main AOS forum.
