  1. That is awesome! Thanks for sharing your experience. I am still waiting for the biometrics appointment but hoping they approve my mom's application. Also I was told by USCIS that if my mom were to leave the country before she receive a response from the immigration all she has to do is keep the paperwork showing she applied while she was in the country and did not overstay her visa. When she come visit again she should have that paperwork with her to show to the immigration officers but she should not have a problem to return.

    I don't see him asking for your opinion to start with, he was just stating what he have done before... so better keep your opinion out of this thread and yes telling someone to pack a bigger bag it is uncalled for.

    Rather curious he claims to have done it for 5 years while also claiming to be a US citizen, but whatever. Would suggest his MIL packs all her things to take with on this short trip as she may find she has an unexpected long holiday in Canada, Mexico or wherever while waiting for flights home to open up.

    We all know despite USCIS not recommending that everything is dependent on the immigration officer decision at the time of re-entry.

     

    The fact they were able to do it for 5 or 10 years does not mean it will always work but there's also no reason to be sour about others people decision. We should be here to support each other and if we don't have anything nice to say better just keep scrolling.

    I have not received anything as of today. USCIS offices are supposedly opening up again today so I am hoping to at least get a notice to complete biometrics soon but I highly doubt we will have a decision made before my mom's authorized period of stay expires at the end of June but I will update here as soon I hear anything. Good luck with your mom's process!!!!

    I do not have any updates on my mom's application yet other than a confirmation they have received our request but will update here whenever we have more information. Did you end up applying?

    I sent the application last week already but did not include an affidavit of support just my parents tax return from last year, bank statement and also added my husband's and mine most recent pay stub to show that we are able to provide her food and place to stay while she is visiting.

  7. Hello All,

     

    I will apply for my mother's B2 visa extension due to the corona virus spread since I don't want her to be exposed given that she is almost 70 and has pre-existing conditions. I have a few questions for those that applied before. Sorry for some real basic questions but the instructions were not very clear and I don't want to mess it up.

     

    I am applying online and they have several question

     

    • They ask if there is a preparer and interpreter helping fill out the application. I am helping her since she doesn't speak English. Should I answer yes to both questions or just to the preparer? Not sure if that makes a difference?
    • They ask Where do you live now? - Should that be my address where she is staying?
    • They have several questions Have you, or any other individual included on this application... would that include the preperar/interpreter or just herself? We are not applying to anyone else just her.
    • Have you, or any other individual included in this application, been employed in the United States since last admitted or granted an extension or change of status? - She never worked here but I work since I am the preparer should I answer Yes or the question only pertains to her so in that case should be No?
    • They ask her to describe how she is supporting herself while she is staying with us. She is retired and has a really low income that comes from that. While she is staying with us myself and my husband are the ones providing food or anything else she needs. Can we provide our bank statements and show proof of financial support for her or they only accept source of income coming from her?

  8. Hello PerfectStorm we are in a similar situation and I was wondering what you decided to do?

     

    In my case I am having a baby anytime now and have to move across country in July so I would really need my mother here for a little while but she doesn't plan on living in the US indefinitely. I am not really sure what to do as of right now. She could potentially fly home and attempt to return but she has diabetes and other conditions and I don't want to risk her health either. I am worried about applying for visa extension and having it denied too since it will take a while to hear back on that we can count on it. Currently she can stay til the end of June but I don't know if would be wiser to just wait and see how things are here and back home by then. Just trying to figure this out as well...

    I am assuming you are just starting and getting the I130 completed. It will take 5 - 8 months for the I130 yo be processed then sent to the NVC.  The I864 is required for the NVC stage. So the income required would be for the address that you have at the time of completing the I864. If you move to the lower 48... and leave one of my most loved parts of the US.. 😢. you would need to change your address with the USCIS ... see the instructions on the USCIS website AR11.. different instructions for pending and recently approved petitions

  10. Hello I plan on applying for my parents to come live with us. My husband is due to military transfer this Summer and we are currently in Alaska where the requirements for support is bigger than in the lower 48. My question is at what point throughout the application process we need to show proof of income? Do I have to send that out with the application or will be requested after my parents interview in the consulate? I am debating whether to apply now or after we move due to that requirement.

    Thank you for your response. I have not filed n400 yet because I'm not eligible because of the DUI. I asked a lawyer today who advised me that probation will not cause my case to be denied. I originally sent the police report but they wanted the court docs. 

    So I guess for now I have to keep waiting until they either approve my case or request I attend an interview. Ofcause I'm hoping they are able to approve me without an interview

    I apologize for mixing it up!!!! =) So regarding the I-751 I had no problems at all and I was still under probation too. 

     

    I just sent them the court disposition document certified by the court showing what I was charged and what the court imposed me which in my case was the 3 month DUI program, a BIG fine, 4 days of jail time which I didn't really understand how that worked but I only spent a few hours after my arrest and then was released and the 3 year probation. At the time I had completed the DUI program and paid all the fines so I just sent all the documents everything was completed and I had my driver's license reinstated. I did not send the arrest report. They never asked for RFE or interview. I just got my 10 year green card on the mail.   You should be just fine. I apologize again for mixing up the N-400 with the I-751 but at least now you know about both of them. Please send me a message if you have any other questions.

     

    I applied to remove conditions on October 27th, 2014 and received my green card on April 20th, 2015. At the time I was living in California but the whole process was just fine and I was charged with DUI in May of 2014 just a few months before I had to submit my paperwork so I was super worried too. I hope everything works out for you.

    Hi Val,

    I got my case approved and finalized at the end of April. They did not ask for anything after I submitted my package and just sent me an interview letter for April. During the interview the officer asked about my arrest and to explain what happened. I also explained to her that I completed the 3 month DUI program, paid all fines and was also out of the 3 year probation. I also said that was a horrible mistake and that I haven't had any problems with the law since. I had my case approved on the spot and she even offered me take the Oath the same day given how expensive it is to get from the island I live in Alaska to their office in Anchorage. It went pretty smooth but I was out of probation by the time I applied for my citizenship last year. I actually waited until a couple weeks after I was out of probation to mail my package. I believe being out of probation is one of the requirements to apply for citizenship but each officer can take a different approach and I hope you have your case approved. I wish I could help you more but let me know if you have other questions. Good Luck!!!

  13. I plan to bring my parents (66/69 years old) to live in the US and my biggest concern is the aspect of health insurance. This post was extremely helpful but my question is if my dad move to the US and receive his retirement from Brazil can he claim he has no income in the US on his tax return and be eligible for one of the more affordable health insurance plans or he will have to file tax in the US showing the retirement he receive from Brazil? Thanks!

  14. I am a US citizen and will be applying for my parents to become green card holders. My question is my parents as green card holders can apply for my adult (over 21) divorced brother to become a green card holder as well?

    How long would take for my brother to obtain his green card? I know I can also apply for my brother but it can take 14 -20 years for him to get a green card and I was wondering if my parents can apply for him giving him a higher priority than a sibling would.
