  1. My moms green card was approved a couple years ago, but we received a letter in the mail now stating that her NV case was terminated. This was part of a huge mess USCIS has made which required us to reach out to our congressmen to get her green card approved. I was told back then to disregard the whole NVC processing since she was going through adjustment of status in the country. Can this letter affect anything with her green card? Anyone had similar problem that can advise?

    We refer to your application for an immigrant visa. Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf cancelled, if you donot apply for your immigrant visa within one year of being advised to do so.

    Your were advised of this requirement on March 16, 2023, but we have not received a response from you since then. As a result, your are hereby notified that your application for a visa has been cancelled and any petition approved on your behalf has also been canceled.

    Your application may be reinstated and any petition revalidated, if within one year, you can establish that your failure to pursue your immigration visa application was due to circumstances beyond your control.

  2. We got an awesome surprise this morning. My mom's green card got approved without the interview. We run into several issues with USCIS prior to applying for her green card and again when we applied for her I-130 they approved and sent her case to the NVC instead of the local office despite us selecting she was in the country and going through adjustment of status. After calling USCIS and NVC multiple times and having the expedite request denied twice we reached out to the local congressman with all the evidence and documents and apparently that did the trick! I know that does not apply to everybody but if you are having any issues with USCIS I would definitely try to go that route and see what the congressman can do for you.

  3. Hello

     

    My mom's AOS still waiting interview to be scheduled. Her I-130 was approved but was sent to the NVC instead of the local office. I tried to expedite the visa interview twice on basis of immigration error but got denied. 

     

    She needs to travel back home for medical reasons and we are concerned she may have issues to return because she still waiting for the green card and we had issues with her tourist visa extension that we applied before her green card (very long story).

     

    Anyone had any experience leaving the country just with the combo card and was able to return without any problems? Could her tourist visa extension that was denied before affect anything? I would appreciate any insight from anyone that had similar situation.

  4. Does anyone knows if you move to a different state and you update the address if the case goes to the bottom of the wait list at the new location? We are moving twice in the next year and a half due to military orders and with the delays we are seeing at the office in Seattle area I am pretty sure we won't get my mom's case finalized here so looking for others input if anyone has had that experience.

    2021-09-09 - Contacted local Social Security Administration office to inquire about status of issuing an SSN. Appointment made for same day and we went in person to apply for a SSN. This shouldn't have been necessary as we checked the box to automatically issue a SSN on the I-765 application, but the agent confirmed the ball gets dropped between the two agencies regularly. The agent just needed the EAD card and the process was complete in 5 minutes. Social security card was dispatched via mail.

    2021-09-20 - SSN card received.

    2021-10-29 - Website showed I-485 status update: Interview Was Scheduled
    2021-11-01 - Called USCIS and agent informed us the interview date is 2021-12-07.

     

     

     

    Congrats on the interview scheduling. I am curious to know if you requested to Expedite your interview? I am also in WA and the processing cases for I-485  family based are dated back in july/2019 so I was just curious if they are moving faster now?! 

  6. Yes her application was sent to the NVC and the NVC sent to the embassy in Rio de Janeiro for interview scheduling but she is in the US waiting for interview.

    I just downloaded the copy of the I-130 filled out online and the section below was filled out so it should have been sent to the local office but did not. =(

     

    The beneficiary is in the United States and will apply for adjustment of status to that of a lawful permanent resident at the U.S. Citizenship and Immigration Services (USCIS) office in Chicago, IL

     

    So based on your response it is correct to assume they will transfer her I-130 back to the local office when they are ready to schedule the interview? Not sure if you went through this but did that delay your process? Our local office is already super backed up so I was worried this would take even longer than expected to approve.

  7. My mother applied for adjustment of status but we submitted her I-130 online and the I-485 and other forms via mail. Her I-130 was approved but sent to the embassy overseas instead of the local office. I called both USCIS and the NVC but apparently no one can do anything about it right away. I had to fill out a request online in the NVC website which takes at least a few months for them to reply and USCIS just sent me a standard reply that did not really answer my questions. I was wondering if anyone experienced anything similar and what was the outcome? My mother is currently waiting interview to be scheduled at the local office and I am not sure how this can impact her approval process. When they schedule her for interview will they just reach out to NVC and request her I-130 package to be moved back to the local office? Thanks!

  9. My mother applied for B2 visa extension and then several months later we sent a request to withdrawn her application because we decided to apply for her green card. I sent the withdrawn request via mail and never heard anything back. Early April I went to USCIS website and saw it was showing they sent on March 31 her biometrics appointment. We have moved three times since we applied for her visa extension and had mail forward but we never received that notice so I made sure to go under documents on their website and upload the letter I have previously mailed asking to withdrawn the application. On their website said that was under review for months and now end of August I got a letter saying they denied her case because she abandon her process and did not appear to the biometrics appointment. We never received any notice of the appointment and I contacted them about that back then and despite having all the evidence it cost $675 to appeal their decision. My big question is if we leave as is will that impact her AOS application? She already had I765 and I131 approved we are just waiting for I130 and interview. It is just so hard that we over communicated that we were withdrawing her application and have all the evidence but still they probably did not even look at the documents uploaded to their website and probably did not receive the one we sent by mail and now cost that much to appeal. Also I made sure to always update our address on their website every time we moved. What other options we may have at this point?

  10. Thank you for all the information. My mother is not on his orders as a dependent. In fact we haven't even received the possible locations to transfer to yet but I know for a fact that USCIS will not schedule the interview before we move because they are so backed up right now. My mother does live with us though so if we move she will go with us too and from what I've heard if we change address our application goes back to the bottom of the wait list at the new office so I was trying to see what options we could have to expedite it while we are here but I will have to wait until we have official orders. My husband is the co-sponsor for her application but not sure if that helps anything. @Ed&Midori1031 thanks again for the template!!!

    Thank you! I just got an update that both I-131 and I-765 got approved. Now just a long wait until the actual interview. With the AP can my mother travel overseas and return to the US without any problems? I heard that is treated just like another visa so I was unsure of how it works especially because at the moment tourists from my home country are still banned to enter US due to covid.

    Had some updates on my mom's case. Today I got a message AED card was sent for production but does not say anything about the AP and the status for I-131 has not changed since case was received. Does that mean I need to call USCIS to ensure they also process or should I just expect to receive a combo card? 

     

    Also interested to know if anyone went through an interview in Seattle, WA area? According to USCIS website they are still working on cases from early 2019 so I am a little worried we will move before the interview is actually scheduled.

    You sure can!  I did the same thing with the Seattle office.  As soon as I got my orders, I had to have my wife's and step son's AOS approved before departing for Japan, so I requested for an expedite, and got approved.  If you message me your personal email, I can forward you a template I created for expedite.  

     

    I will ad, it only works if you're going to be stationed overseas.

  14. We are waiting for an interview to be scheduled for AOS for my mother but looks like Seattle office is super backed up and they are still scheduling cases from early 2019. My mother lives with us and we will be transferring next Summer. Is it possible to request expedite based on us transferring? Do we need to have the actual orders or just a letter from my husband's command showing his tour here ends soon would suffice? Anyone had any luck with that?!

  15. Hi guys I am following both November and December threads because i submitted my mother's I-130 petition online on 11/13/2020 and all the other forms in December/2020. So far it is moving super slow. We finally got her biometrics appointment scheduled to 08/13 after requesting to expedite I-765. Funny thing is that we never got a message letting us know that was approved just received the biometrics appointment in the mail.

     

    I also tried to request to expedite I-130 they asked for evidence which we submitted and got rejected because they said they had too many requests for the same reason (medical) and they were increasing the requirements to approve those kind of requests and out evidence did not meet those requirements. 🙄

     

    Anyways I will update here when I hear anything else but things are moving super slow!

    We ended up sending the notice back to USCIS requesting for them to reschedule and took several months for them to reschedule.By then we ended up cancelling the request to extend her visa and applied for her green card instead.

    If I were to go through this again I would probably pay a visit to the local office instead and explain to them the situation. I heard some people were able to do a walk-in depending on the situation. Here in Seattle it appears they are turning everyone away but I would still give it a try because it is very time consuming to get it reschedule. Let me know if you have any questions.

  17. Here is my timeline applying for my mother. I can see our process is moving a lot slower compared to many of you. I am not sure if that is due to applying for I-130 online instead of submitting the whole package together.

  18. I applied for my mother's AOS last year and have a few questions:

     

    • Do they require an interview for AOS? My friend's mom did not have to go to one but I wasn't sure if she was just lucky or if they doesn't normally request an interview for AOS for parents?
    • My mother just got the biometrics appointment in the mail. Do they only review the case and check if there is any missing documents after biometrics is completed or was that done already? Meaning can we still get an RFE?
    • We have done the medical appointment just before I submitted her I-485 in December of last year. Just now I heard that there is a 6 month expiration on that form and since the process is taking longer than used to does that means we will have to redo her medical appointment again? Does this rule apply for AOS?
  19. Well yesterday we had a sweet surprise although nothing was updated on USCIS website we got a letter in the mail with my mother's biometrics appointment for the I-765/I-485 combo. We had requested to expedite about 20 days ago for medical reasons but have not heard back on a decision and differently than I-130 that got denied right away we actually got that request approved. I am not sure what happens after she completes biometrics and don't know the impact on the I-130 process but at least that is something!

    I already filed a case outside processing window did not hear anything back. Tried to expedite the process due to a medical condition and got it denied last week.

    Called a few times and they said there is nothing else that can be done. It is just very disappointing to hear people applied several months after and already had it approved and we are still waiting =(
