  1. My husband and I are making a checklist of documents he may need at the interview and I'm wondering if he should bring some of the things I previously submitted with the I-130. When I initially filed our I-130, I submitted a five page document with several photos of us with family and friends, copies of our apartment rental contracts that list both our names (I've live in his home country for almost two years, 1 1/2 years with him), and a one page document detailing how we met and our life together since we met.

    Should my husband print copies of these forms to take to his interview or will they already be at the embassy with our other paperwork? Also, we have a business together and a joint bank account in his home country. Should he take copies of those documents if they were not included included with the I-130 package? Any other suggestions on what to take?

    Supposedly the consulate has your i-130 package, if I'm not mistaken, but I'd bring copies of everything. :).

  2. That makes sense. Because they said on July 2nd they received it but they couldn't tell me that until July 5th. And some operators told me July 5th.

    Deb, that's not good news at all...how is my husband going to get all that time off from work to wait for the visa? Snail mail is extremely unreliable in Mexico... :(. But thanks for your help hon!

    Oh so I just got this e-mail: the subject was RE: (my affidavit of support package e-mail)

    Dear Sir/Madam:

    The National Visa Center (NVC) received your correspondence.

    We received electronic documentation for this case. Please allow up to 20 business days from the day the email was sent for the scanned attachments to be uploaded to the electronic case file and reviewed.  

    IMPORTANT:

    Do not let more than one year pass without contacting the NVC concerning this visa petition. If a period of one year passes from the last date of contact (by telephone, mail, or e-mail) with the NVC, all submitted fees and documents expire. If this occurs, the fees must be paid again and documents must be resubmitted in order to continue the immigration process.

    As this case is processing electronically, all forms and documents must be sent via email as scanned attachments to NVCElectronic@state.gov .  Sending physical documents to the NVC will delay the processing of your case.

  3. Hi VJ’s...We had our interview 7/18. I think we were over thinking the whole process, the agent asked a few questions. The whole interview lasted all of 5 minutes, then she said we were approved!! Thank you all for your help

    How does that work? Do you have to wait for your visa at the consulate or do they give it to you right there, or at POE? Can someone (Saylin..any thoughts?) help me figure this out? I've heard a lot of different things.

    paid IV bill last friday night and now the status is "PAID". seems quick!

    I'm confused...isn't china electronic processing? I guess not because I have done everything through the portal since I got my case number.

  5. I have read on here that people waiting on the NVC should call everyday. But, I wonder what it does. A few days ago, Saylin responded to someone who posted about their luck after calling:

    Yes it's true, you don't have to call the NVC. But it's the quickest way to get our case number. Once we get our case number, we give them our e-mail addresses and that gets the ball rolling on our case. We all wanna get our spouses their greencards quick and the thought of wasting one minute waiting for "Don't call us, we'll call (actually snail mail) you," is unthinkable. Haha call us crazy, because I did kind of go crazy calling 3 times a day like dwheels. But if you don't want to do that, call every couple of days. But calling definitely helps get the ball rolling faster.

    Dwheels, you should add that bit about the USCIS to your timeline. :)

  6. I remember when i called USCIS they told me the same thing. But within 10 calender days it reached NVC. Keep praying n dont worry it will be in NVC in few days.

    "You cannot make online payments for your case at this time. Please contact the NVC if you have questions or need further information."

    I guess they are processing my AOS invoice. hopefully it will be available to pay in couple of days.

    Yep! That's what happens! Hopefully you should get your AOS on Monday!

    Well this just in. Called NVC and was tellin the lady was saga. And she said "well to be honest we have a boatload (I know she wanted to cuss) of applications and I am sure its here we just haven't got to it." Than she said, "Well I know we have people working the weekend to try and get caught up".

    So a bit of light on at least my situation I hope, I am smiling a little. She said give it until mid week.

    I've done my homework and researched my problem first by searching for "Gross Income" in the search field, but I didn't find an answer for my unique situation. Your assistance/suggestion is greatly appreciated.

    Here is my situation:

    I started out using I-864EZ and got to the Total Income field for the 3 most recent tax years but I couldn't decide what to show and let me explain why. On each of my 1040's from 2009 to 2011, I show a negative total income on line 22 of 1040, or the Total Income line on the 2nd page of my tax transcript, I have both the transcripts and 1040 for 3 years. The reason for the negative income is from my Other Income (line 21 on 1040) which is from my Prior Year Net Operating Loss (NOL) that I've been carrying for a few years now. The amount of my Prior Year NOL will be exausted in 2012 and I do expect to show a significant income for 2012 tax year. More than twice the poverty level for my household. The reason for my Prior Year NOL is due to a business partnership loss and my CPA has been basically writing off that loss for me against my income. I'm not self-employed, I get my W-2's from working full-time for a large company.

    Now, I know the I-864 guideline states that "For purpose of this affidavit, the line for gross (total) income on IRS forms 1040 will be considered when determining income", but is Prior Year NOL considered as part of my income even though it is really just a carryover loss from years back. Obviously, I would like to avoid putting negative Total Income on my I-864EZ by summing without the Other Income line, or does that even matter because my current annual income will be above the poverty level? Either way I end up choosing, I will explain the situation on my own cover letter and hoping that they actually read it.

    Here are my questions:

    1) Should I enter negative Total Incomes for 3 prior tax years or sum up my total income without Other Income since it is really just a carryover loss from a previous year?

    2) Should I switch to I-864 and also attach my assets to help with my case? I can supply 6 months of statements from both my bank account and my portfolio to show over 3 times the poverty level.

    3) I was planning on just sending the tax transcripts because 1040 copy is more complicated and would probably take longer to review, but only the 1040 copy shows what my Other Income is and it has all the carryover worksheets and schedules. So, if I was to send 1040 copy, can I just send it for 2011 and use tax transcripts for 2010 and 2009 since I can probably build my case for Prior Year NOL with just 2011.

    Again, your assistance/suggestion is greatly appreciated.

    You should enter your AGI according to your tax transcripts. Don't confuse the NVC. Mine were $0 for the past two years, but I provided lots of evidence of my current employment. But, if you can provide assets and fill out an i-864, I would do it! You can never have too much support, you know? That way you can feel comfortable just sending the tax transcripts, because that is what they want. You only need one from 2011, but you can send the others if you feel like they would help in some way.

    I just sent my AOS package, and I'll let you know how it goes or if I get an RFE. I also have a joint sponsor's packet ready to go if I get an RFE, and to bring to the interview...just in case.

    However, I think both of us will be fine!

  8. Paid IV, got Paid status, mailed packet today...7 lbs. Nope, did not front load at USCIS but did at NVC stage, just correspondence and highlighted phone records for one year mainly. Before you ask why...MENA country. Overnight USPS was going to be around $70 USD. So I forwarded Priority Mail which will get there on Monday...$24.00.

    My job is done unless I get RFE. Praying everything they needed and asked for is included. I went over this packet and meticulously recorded every piece of paper.

    I guess we will know in about a week. Where is a fingers cross emoticon when you need one? I also need one that pats itself on the back. I'm proud of myself! :D
