    Hey guys!
    Today is one of the best days of my life! I'm SOOO happy and excited!! I had my K-1 visa interview today (11/25/2014) at the US Embassy in Budapest, Hungary. I arrived 10 minutes early and spent no more than an hour inside altogether. First, a Hungarian lady took my fingerprints and my documents, and I was told to wait a little. After waiting like 10 minutes I was invited to talk with the CO who was a professional looking, nice lady. She asked me some questions about me, my fiancé and our relationship. She didn't ask for any proof of ongoing relationship (not even photos). Then: "Congratulations Miss *my name*, your visa is approved, welcome to the United States." Then the Hungarian lady told me that I'll receive my visa and my passport in 2-4 business days. I was walking on air all the way back home!
    The questions I was asked are the following:
    1. When and how did you meet your fiancé?
    2. When and how did you meet your fiancé in person?
    3. How many times did you meet him in person?
    4. Did you meet any of his family members in person?
    5. What are you planning to do in the U.S.?
    6. What are your marriage plans?
    I honestly can't believe that this was the interview that I was so nervous about!! It was so easy and short. After reading a lot of horror stories here on Visajourney; I started to stress about it non-stop. At least it made me to pay attention to every little detail when it came to documents. Reading Visajourney interview stories can be deceiving though. Obviously having a visa interview at the US Embassy of a European VWP country (like Hungary) is a whole different story than having an interview in a third world/high fraud country. I think that if your case doesn't have red flags and you're from a low fraud country (Canada, Australia, New Zealand, and European VWP countries) then you will likely have it this easy. My advice is to be prepared for everything, have a lot of proof and evidence, keep having faith and hope for the best! It's better to be safe than sorry!
    Let's get back to my interview experience.
    Here is what I bought to the interview. I organized the documents & stuff in 4 different colored folders, I'm big time fan of bright colors!
    Pink folder (personal documents)
    1. passport
    2. DS-160 confirmation page
    3. interview appointment letter
    4. visa photos
    5. birth certificate
    6. police certificate

    Green folder (form I-134 & proofs) - my fiancé is my sponsor

    11. IRS Wage & Income Transcript (2013)
    12. last 12 paychecks

    Yellow folder (proof of ongoing relationship)
    14. Facebook wall screenshots

    16. Skype call history (I used SkypeLogView)
    17. a postcard I sent to my fiancé
    18. updated letter of intents
    Blue folder (proof of having met - we already submitted these in I-129F)

    So that was it. Now it's time for me to celebrate and to start my new life in the United States with the man of my dreams!
    Without this site I wouldn't be where I am now. I'm very grateful for all the great, detailed infos and all the helpful Visajourney members.

    I don't know your culture and I can't relate? Just because my wife is Filipino and I am American doesn't mean I don't know your culture. I have lived, worked, and resided around Pakistanis,Indians(both North and South Indians), and Nepalis for many years now. I know about the culture and the taboos that are associated with it.
    We have tried to help and figure out your father's case for you, but you don't want to take our advice. You just want to belittle us for asking questions and trying to give you some tough love. You want to act like you are the only person that has ever suffered from PTSD and Depression at the same time. I know it is tough trust me I know. I work a full time 40 hour a week job all the while going to school full time to get a Bachelor of Science degree, being a father to my 3 kids and a husband to my wonderful wife.

    I think that people keep mentioning that you could get a job, not because they're telling you what the solution to your problem is, but because you are going to have to prove "extreme hardship" to get the waiver. What you're describing isn't "extreme hardship" because you DO have options---and one of them is for you to get a job. You may not like the job, it may keep you from your family etc, but that's not "extreme hardship" that's being dissatisfied with your current employment and lifestyle which is something that many, many people are. People here are telling you how it's going to look to the decision makers, and I'm inclined to agree. It doesn't mean you can't try, or shouldn't try. But that this approach does not seem to be a winning one.
    As for " How can you say someone has been here illegally, when they have always been truthful about their immigration status and have seeked legal help." Because, I'm sorry to say, he IS here illegally and that is why he's having problems. He had a visitor's visa, and he stayed longer than that visa allowed. That is the literal definition of being in a country illegally, and is how the majority of illegal immigrants are here. Yes he tried to get help to avoid that happening, but that help failed. Yes, he's always been honest about it and has been trying to legalize his status, but that still doesn't mean that he is here legally. In fact, if someone is working to become legal, logic shows that they are actually not legal.
    So yes,you can try to prove extreme hardship, and you should try. But it sounds like the reasons you're giving aren't going to work. He doesn't have a life to go to in Fiji-- yep, that's a "normal hardship"--most deportees don't have lives to go back to either. You depend on him for money-- yep, "normal" as well. Just about every adult has people depending on them for either money or support (such as childcare/elder care etc). It's especially thin because your household has a third adult--you-- who *could* get a job to support the family. That's something that a lot of deportee's families don't have. I'm not trying to be harsh, and I don't think anyone else is either. Just letting you know how it's going to present to the decision makers.

    Exactly. I just don't get this. He doesn't have to tell anyone about it. And anyway, PTSD is common. It is hard but it's perfectly possible to live a normal life with it.

    Yep. A DV felon who has been an illegal immigrant for 15 years. Doesn't sound very appealing.

    I know that my comment will not be helpful to OP but I just want to try to save other posters' time and effort. Looking through the story provided by OP and multiple discrepancies in his story, this looks to me more and more as trolling. I would recommend closing this thread.

    No one said all cops are saints. But it would be strange to have someone sentenced to 1+ years to do something that didn't have any solid basis in court. If she changed her story and showed no signs of abuse, they couldn't just throw him in for false DV charges. That's why everyone thinks there must be more to the story.

    Starts to make more sense
    Overstay his visa
    Felony DV served a year
    Been held by ICE for 3 years
    Went through I 130 from wife and waiver, tried Asylum as well.
    Worked its way up to the 9th Circuit, no joy after many years.
    Now slated for deportation.
    Not going to get COR with a DV Felony.

    Sorry, but this beggars belief. Either your father is the unluckiest person in the world, and everybody is against him in the entire criminal justice system, or there is a lot more to it than this. No one goes to jail for 4 years for accidentally pulling someone's hair when they're drunk. I don't buy it.

    Your story keeps changing. Now you say you have a job? People told you to get one because all you talked about is what your mother earns a year and you kept repeating that you have PTSD like it was something that makes people unable to work.
    Why are you being "honest" about your PTSD if you clearly see that it completely holds you back from getting a better paying job? Have common sense. Of course no one wants to hire someone who keeps talking about his severe depression and PTSD. A lot of people are going through extremely stressful periods in life, you are not the only one, trust me.
    Face the facts. Your dad has been illegaly in the United States for 15 years and went to jail for 4 years for a serious crime (domestic violence). I'm sure that you don't like all the answers you get on this forum. But you also have to understand that the vast majority of us came here AND stay here legally (investing thousands of dollars, time, effort, tears). Don't expect sympathy from everyone.
    1. You KNOW you can't get a good paying job if you mention your mental disorder in your applications, yet you STILL do it. Your answer: "You don't want it to effect you in the future". How would it effect you seriously?
    2. You KNOW you have PTSD yet you don't want to get it treated with medications. Your answer: Because you don't believe in medications.
    DECIDE what you want. Be a victim and feel sorry for yourself OR get yourself together and face challenges in life like an adult. The choice is yours.
    Get your PTSD treated. Get loans. Go to college. Follow your passion (I'm sure you have some talents). Take your life into your hands. Make something out of yourself. All you can do now is to support your mom financially, mentally, physically and emotionally. You can get through this - but you have to want it.

    Yes, your father came here Legally on a visa, he was here Illegally as soon as his visa expired. He then committed a felony and that is the big reason for him to be deported right now. Yes he committed it because he was found guilty of the crime. So he has shown to have morality problem and which the US does not want immigrants with morality issues.
    You say you have PTSD and Depression.WELL THAT DOES NOT STOP YOU FROM WORKING AT ALL IN ORDER TO SUPPORT YOUR FAMILY. As I have stated before I suffer from PTSD as well but due to being in Combat in Iraq, I suffered from depression as well for a couple years until I found it in myself to get above that. There are many Combat Veterans like myself who suffer from PTSD and still work in order to provide for our families.
    I know people from my time in the Marine Corps that take care of their parents while they are in the Military, and thus the parent is considered the dependent for all intensive purposes. Just because you might have to deploy and be away from your mother for a period of time doesn't mean you shouldn't join.
    The point I am trying to make is that you need to go out and WORK. Make more than $350 a week which is well below the poverty level. Get some skills and start supporting yourself, stop pouting about the whoa is me stuff.

    Just a quick thing to clear up (and could explain why he's in this sort of trouble to begin with): just because you enter a country legally, with a visa, doesn't mean that you will always remain legal. Unfortunately, he overstayed that visa (and if he was working while on it, he misused it). He was not here legally as soon as that visa expired. That is how the majority of "illegal immigrants" arrive--legally (and usually with visitor's visas) and then become illegal. This is possibly a big reason why your mom couldn't file for him.

    I know you are coming on this site to try and get help for your father in hopes to starve off deportation, but you have to realize the vast majority of people on this site are trying to navigate this process legally. So don't be surprised that some people are a little pissed that your father gamed the system and is now trying to stay here indefinitely.
    Also I think there is more than what has already been put out if your father was sentenced to a year in prison for DV. I know you say that there was a misunderstanding and he was wrongfully arrested, but if he was wrongfully arrested he could have fought it an won. I know that for a fact because that happened to me with my x-wife, there was a verbal fight and she started swinging on me, I pushed her away and she fell and hurt her back. I take her to the ER and then I am arrested for DV and sent to jail for an automatic 48 hours for a "cooling off period". I fought it in court with no lawyer and it was dropped. So yes it can be done.
    Also you say you have PTSD and that's why you can not work. Don't try and play that on here please. There are numerous people that have varying degrees of PTSD that go on with daily life. I am suffering from Combat related PTSD that is verified by the VA and I am living my life and working in order to support my 3 kids and my wife, all the while fighting the demons that are waiting for me when I close my eyes at night.
    You are 18/19 years old, pull up your big boy pants and help support your mother. Join the military and add your mother as a dependent so she can get medical she needs. When I was 19 years old in 2003 I was in the Marine Corps and preparing to join the invasion of Iraq. So your idea that you are only 19 doesn't hold weight with me at all.
    Sorry I am tough but it is tough love.

    Knowing the things I know now, it's been 16 years next week and I would enjoy another tour through high school. I don't really understand your situation compared to high school though.

    Well you refuse to answer certain questions and you don't like to face the truth. As other users pointed it out there has to be a lot more to this Domestic Violence felony thing. No one goes to jail for 4 years for nothing. I get it that you are stressed and confused but also understand that you are not helpless. You CAN get PROPER treatment for your PTSD and when you have yourself together you can support your sick mom financially and emotionally. The chances are very slim that your dad can stay with you two. Good luck to you anyway.

    I'm sorry but you keep repeating the same excuses. I understand that your mom has health problems. But how exactly would your dad living with you help your situation? How could he get a job supporting your sick mom, you and himself? He is not young either and he is a felon.

    As for your PTSD. You said before that you were diagnosed with depression and PTSD but you don't take any medications for it. Why don't you seek professional help (therapy) if you feel like it is crippling your life so much that you can't get a job? A lot of people who have mental disorders still work.

    There has to be a lot more to your story. If your father's arrest was a "misunderstanding" and it wasn't domestic violence then why didn't your mother defend him?
    From what I understand, your dad has been in the US illegally for 15 years and he was 4 years in jail for domestic violence. He abused the immigration system and he was in jail. Letting a person like him stay would be a slap in the face to all the legal immigrants who came here following the immigration law to the letter. You are an adult. You can get a job and support your mom.

    sounds like it was not a bona fide marriage and more like an arranged one. You are avoiding to answer our questions, who has supported all this years? sorry but you aren't getting a green card in the situation you are in.
