    "Administrative processing" in US visa applications

    Dinsmore & Shohl LLP USA January 29 2010 When your employee applies for a nonimmigrant visa at a U.S. embassy or consulate abroad, keep in mind possible (and sometimes unforeseen) delays due to what the U.S. government calls "administrative processing."
    The U.S. Department of State (DOS) website offers a helpful "Visa Wait Times" list here. The posted Visa Wait Times indicate the usual number of days it is now taking a particular U.S. embassy or consulate to schedule a visa interview/appointment for your employee, issue the requested nonimmigrant visa, and return the applicant's passport to him or her.
    However, you and your employee should realize that not all visa applications go through the process without delay. While, with fastidious preparation, an applicant can often avoid delays stemming from forgetting a document, presenting an inadequate set of documents, or presenting incorrect or incomplete information that triggers either a denial or a field investigation, there is one factor that is largely beyond your employee's control. U.S. consular officers can issue a "provisional" (temporary) denial based upon "administrative processing."
    Administrative processing can mean many things, but in most simplest terms, it means that the U.S. government has determined that some sort of additional security check or other clearance is necessary before the visa can be issued. Various factors can lead to such additional check, including but not limited to:

    the company requiring, or individual possessing, education or experience in a discipline such as nuclear technology, supercomputers, global positioning systems, etc. that appears on the U.S. government's technology alert list and that triggers the consular officer's decision to seek extra security clearances; the applicant's past arrest or conviction for an offense; or a "hit" that results from some government data mining (such as your employee's name being similar to someone who is on a watch list, a prior address being the same building as someone of interest to the government, etc.) If administrative processing occurs -- which is more common now due to the Northwest/Delta incident and the earlier issuance of a U.S. visa to the alleged terrorist who was on one of the government's lower grade lists -- you and your employee can expect a delay in visa issuance for anywhere from two weeks to several months.
    While your employee cannot generally do anything to avoid administrative processing and while the U.S. government will, absent extraordinary circumstances, not short-circuit the usual time frames for this extra processing to be completed, you and your employee can take a few steps to minimize the inconvenience if the U.S. government triggers administrative processing:

    Alert your employee's manager that he or she is applying for a U.S. visa and the possibility of delay if a security check complication ensues so the manager is not surprised; Have a Plan B available that enables your employee to live and work abroad if his or her return is delayed due to administrative processing; and Recommend that your employee purchase airline ticket insurance so that if he or she has to change the U.S.-bound return flight, he or she does not face a substantial penalty when booking a new flight.

    You can search the archive here for many, many posts discussing a lot of the specifics of the name check/background check process. There are multiple agencies involved, and some of them have access to different databases. The results of a name check are not permanent; a new name check will be required if a period of time has elapsed since the previous one.
    So name checks are all too real, and many of our MENA members have had to endure lengthy delays because of them - in some cases, the process took more than a year to complete. Yes, the process can be very frustrating for people who are waiting, but it is actually a very important function of Homeland Security.

    I know people have to explain British humor to me (and still I'm not sure I get it). And my husband says he doesn't get Saudi humor at all. Somethings just don't translate across cultures.
    Mostly though I'm sure its just the lenses they are viewing this satire through.

    I have a day off today and I think I will surprise my wife with a new project that she love so much in my home in morocco. Last night after a long discussion about kitchen appliances, I have decided to do projects that I actually can do. We decided on the baby's room last night and she said I would love our baby girls to have a Moroccan room with beautiful colors. I cry so much, what is wrong with me? I miss home and family, and when she said this to me, I broke down something horrible, I thought this was suppose to happen to her not me.
    My project from now until babys are due is to make a beautiful girls room with hand carved lanterns hanging from a Moroccan hand carve ceiling. As a child I learned this carving technique and me and father did our entire home. My wife fell in love with the ceilings every where she went in morocco. She wanted a lantern but it was too big to bring on plane but I found picture she took and it will be created for her at my father law place while on lunch everyday I will work on it. I will also have a Moroccan couch wrapped around half the room, the easiest of the room make over. I hope she will love it and my soon to be little girls.
    I think my wife is right, I need do focus on things I can do, working on farm is great, but I need weekends off now to make her dream room.
    Thank u all for nice comments. I stayed in baby's room last night until,4 am looking and measuring. I'm tired but no time for sleep now.

    Well... we are approved though the happiness is a bit hollow. Waiting is the name of the game! No additional evidences or document requested.

    please i request everyone not to use CEAS website...it is INCORRECT. i checked for my fiancee's visa last week and it said that it was issued but when i contacted the visa hotline..he is still in AP CHECK...they told me that it is a fairly new website and there is a glich in it. so please dont wrorry about it just acall the visa hotline number and provide them ur case number and they will be able to tell you ur case status.

    Well-- we just did the final run through together... we organized paperwork, went over some information and said Salam! I won't talk to him again until after the interview isA.

    Don't be so uncertain. I case completed Feb 24 and have an interview April 2nd... That is really fast! The other February case complete also got hers at the beginning of April. Now is a great time to get an Egypt interview apparently
