  1. You posted that you could not naturalize for a specific reason in your home country. Therefore they are correct in their statement that you did not want to naturalize.
  2. Yes She will need to file I-130 for both if your mom is a US Citizen. But your sister and her daughter will have to return home until it’s processed. They cannot stay here while it is being processed.
  3. Most likely your EAD will be denied and you will not be able to get one until VAWA approved. Or you file another I-485.
  4. But you actually did not want to naturalize. You said you did not want to due to financial issues in your country. You should have just waited until all those things were done to file.

  11. This plan is a huge red flag for immigration. You have to list all your addresses from the past 5 years. How are you going to explain we don’t live together. You can’t lie about because they can look up the information.

You will need to contact where he got his medical exam to do the drug tests otherwise they will direct you where to get them done. 18. The basis for the denial was because on October 19, 2020 you did not have any other approved visa to adjust from the denied it.
  19. Your denial letter says it was denied in 2020.

  21. There is nothing to reconsider. He had not filed for VAWA at his appointment. He admitted no longer with spouse. His VAWA was approved in 2022. Two years after it was denied. The only way he can ask for reconsideration was if he filed for VAWA prior to October 2020 date and his receipt reflects that date. Furthermore. USCIS does not have to hold your I-485. There is no requirement to do so. The IO adjudicated it appropriately. You are going to spend money and resources for your reconsideration to be denied in another year.
  22. The only proof they accept is your receipt of filing. Showing them a stack of papers means nothing. Actually refiling will be quicker. Your file will clear quicker because all of your information is current.
