Hello VJ,
I have contacted our diligent Admin & Moderators regarding an anomaly with the PM functionality.
People who try to send me a PM get a message saying that i can't receive new messages, i emptied most of my inbox but that didn't resolve the problem, also i lost the "Add me as a friend" icon under my profile picture. Is there anyone experiencing the same issues?

As I am sure you now know, you should have copies of everything.
On the other hand, when a petition is sent back to the USCIS they are going to want more proof that the relationship is valid. I would say that whatever you had that you consider very important proof wasn't good enough.
It is time to really think hard about the reason your visa was denied so that you will know how best to fight it. When you get the NOIR you can state that original information was included in your packet, what it was, and that you didn't have copies. You will eventually get it back, after the final decision is made.
On my second interview, the CO explained to me that my wife does not meet the financial requirement to support me which our lawyer was sure of, then, the congressman's assistant informed my wife last week that she's ineligible to sponsor me, thankfully, her friend with great revenues is willing to be a joint sponsor, that will be taken care of when it should be, i just feel so bad if we don't get those postcards, letters,..etc back to use them again in case of NOIR, on top of other new evidences we're currently gathering, on top of the other evidences inside the mentioned envelop.
Please, do you have any updated guidelines concerning the Do's and Don'ts when 221(g) + return of petition to the USCIS?
Is Local service center another name for the USCIS.

Hello VJers, back to my first interview on Aug 2012, when the CO wanted me to hand her the envelop that contained items supporting the legitimacy of our relationship, what i did is, i included some items that we don't have copies of, such as post-cards, receipts & letters, i thought that the CO will return them in case of denial, which what it was "221(g)" local AP. A month later, i had my second interview with another 221(g) given, and this time petition had to return to the US, sooner or later, the local service center if NOIR will give us 30-60 days to submit the RFE, but the mentioned items are VERY IMPORTANT because they tell so much about our relationship, are they put together with the petition and shipped to the US or remain at the consulate for future usage? please help.

Thank you! I forgot to mention I have the senators office keeping an eye on our case this time around.
So if we are denied, they will need to supply a reason to them directly after. The senator's office
doesn't assure us a visa, just that they would be there for support and to let them know they are watching.

I'm glad your senator is on the dot with you, we got the congressman involved, but it looks he's too busy to for us, until too late, i heard that senators can make changes regarding the visa issuance, comparing to congressmen, would you mind giving little details of how you succeed to have your senator in your side? Just a reminder that after October 11, 2012 our marriage turned its 2nd year, being told by people our petition is now IR-1 instead of CR-1.
After the 2 denials on Aug & Sept 2012, our petition should be in the US or on its way to there for further review/AP.
According to the consular officer who interviewed me, the main reason of denial is financial more than red flags which we have many! and being told by people that we have to find someone to be my co-sponsor before time gets tight. Last week my wife (petitioner) spoke to her friend about this matter, the friend is ready to help but needs to read all the obligations and responsibilities that apply.
Meanwhile, waiting for the local service center to notify us, to know what's next, we are preparing ourselves for worst than before, not just preparing a co-sponsor.
What are the obligations & responsibilities on the co-sponsor? How the process of co-sponsoring will be?

Thanks for the picture, where is this office located? I actually contacted the US Consulate and they told me the same thing. We submitted the correct documents. I resubmitted the document and now it's up to NVC to review the file and move our case along. All we can do now is wait.

Ok, thank you. Yes, my husband was able to obtain the Fiche Anthropometrique with no problem. He received the Casier Judicaire from Meknes without any problems. One of the issues is I am not sure NVC lost the document or if they are saying it's not the correct one. After 2 days of calling I was able to speak to an operator that was nice enough to tell me that NVC doesn't make determinations and all I need to do is write a letter explaining the situation and resubmitting copies of what I have and once the case goes to the US Consulate they will direct my husband on if he's missing anything. So hopefully this will move my case along. When my husband went to the Fes police they directed him to Meknes, but we had already gotten what we needed from Meknes. If possible, can you find out the name of this subsidiary of the Ministry of Justice? Maybe they have one in Fes and that's where my husband will need to go as well.

You're welcome. Did you ask the operator if your case is still being processed despite the invalidity of your police record? I hope your case is not pending, the NVC/USCIS are unpredictable, we've submitted all they items they needed but they rejected our marriage license claiming it is not issued by a Quranic court regardless its originality, saying that my case is pending until requested document is submitted to the NVC, but while i was trying to find a way to proof the marriage license is Quranic, the NVC scheduled my interview, obviously my case hasn't been pending.
I found out that your husband doesn't need to obtain Fiche Anthropometrique & Casier Judiciaire from both cities (Fes & Meknes), it's enough if he obtains them from Meknes, because these records cover his entire national records in Morocco, i exclude the NVC needing both records from both cities, maybe they lost the recs or maybe they found errors in names,dates,etc.., or maybe it's a red tape.

I may be taking a trip to Morocco in October or November for about 10 days. I would like for me and my husband to do a day trip or 2 day trip of riding horses on a beach or camels in the safari. If you have a travel site or a recommended vacation package please respond to this post (Hotel package, etc).

Have you had to obtain criminal records? If yes, are you currently residing in the same city that you were born? If no, please answer this question. How did you obtain criminal court record (Casiar Judiciare) from place of residence? My husband is being told that because he was born in Meknes, he has to go there to obtain Casiar Judiciare (He currently residdes in Fes). Is there another way of getting this document from the place of residence. If yes, where would he go?
The police in Fes told him he had to go to Meknes and the translator stated we have the correct criminal documents but NVC is requesting the Casier Judiciare, even though we submitted it.

I was born in Casablanca and residing in it, never lived somewhere else more than 1 month, I obtained my court record (Casier Judiciaire)from an office you can say it's a subsidiary of the Ministry of Justice, and i obtained my police record (Fiche Anthropométrique) from the little police prefecture which is also the police station my district belongs to, not from the main prefecture of the city of Casablanca, that's how it goes the simple way, but in your case, your fiance/spouse was born and lived in Meknes then moved to Fes, I've read somewhere that an applicant doesn't need to provide court record + police record from cities/countries he/she lived in when he/she was under the age of 15, but i see that the NVC seems to want police records+court records from both Meknes and Fes, your fiance/spouse has to ask a representative at both the police station & ministry of justice of Fes about the possibility of obtaining those records from both cities, if that's possible, that will cover everything, but my question is about the NVC allowing you to submit those records again, if you're allowed please make sure no errors in names,dates,etc.. in both the original records and their English translations, meanwhile, i will probably sip coffee with someone from the authorities tomorrow to get answers for you. I am being told we are missing or didn't submit the correct police report. We sent in: The Imprisonment Sentence Report and the Anthropometric Certificate. Both documents were translated and stamped. Can someone one tell me what we are missing from Morocco?

Maybe, either the police record or court record have expired before submission or errors of names, dates of birth,etc... either in translations or original copies
what's the alien's country? if Morocco let me know.

I booked today because the rates were jumping up...like there is a CASA convention in the first week of November????
JM suites were too much for a one nighter...but will keep it in mind if we ever stay longer and need apartment like accommodations.
Before the helpful post...I looked back in search on VJ and read about others staying in a hotel and found this sufficient.
I am so grateful not to have to take the train by five am to make the interview. Thank GOD.

The nearest hotel to the US consulate in Casa is JM Suites Hotel, located 130 or 140 meters from the embassy (leave the consulate behind you, turn right, take Boulvard Hassan I till crossroad with Boulvard Rachidi, the hotel is found in the corner) nice suites and spa, luxurious but with reasonable prices, great deals if you reserve early, while there are furnished very nice apartments with good prices not very distant from the consulate, have balconies with view on the Hassan 2 mosque and ocean, secure area, I & my wife spent most of our times there, i have pics and can arrange if you're interested.

You can also enter " returned petitions " in the VJ search and find valuable info on how to give a rebuttal for USCIS if given the chance.

If you have been married for 2 or more years when you have a second interview after you may get reaffirmed and the result of the interview is an approval, you will be issued an IR-1 visa. Entering the US on an IR-1 visa will result in the issuing of a green card that will be valid for 10 years. No need to remove conditions after two years, that is the big difference between IR-1 and CR-1 visas.
I advice you to have her visit you again while you are waiting and stay for a few weeks, then go back and get a second job to increase income
or look for another job and also line up a co sponsor.
Why throw a chance of a reaffirmation out the window ? Be patient and wait it out and take time to think things through.Your petition will not expire like K1's do so just have her visit, spend time together and relax and read the links I gave you previously. I don't think the USCIS decision will take a year. I have seen some reaffirmed after just a couple of months. If possible have her visit the embassy and speak to the CO if she comes to see you

In next week it will be our 2nd marriage anniversary,
we won't throw a chance of a reaffirmation out the window, I myself was surprised they scheduled a second interview for me in just 36 days from the first interview, 1st was on Aug 23, 2012 - 2nd Sept 27 2012, i got 221(g) x 2 in less than 2 months, the first 221(g)didn't say anything about a return to the USCIS for AP, but it said my case needs AP, i thought it would take 6 months to have a chance for a 2nd interview but it took only 36 days, i don't see the reason why the CO wasn't frank at the first interview and simply inform me that my wife is ineligible to sponsor me knowing that the only Bona Fide documents they asked for was the evidences of communications (emails, IM logs, cards,etc...), I've heard that the NVC rejected affidavit of support of petitioners who are ineligible to sponsor their spouses, why the NVC didn't reject our affidavit of support??

Boiler is correct, after the few years are up your wife will have to go back and get a job, or she can have someone be a cosponsor for her. It may not be the easiest route, but it is a route. She could possibly teach English over there, there are programs out there for that. It is something to check into anyway. As for her learning the language over there - I am sure she would pick it up pretty quickly. I was amazed how much French and Arabic I had already learned from my husband. I didn't think so until I was over there.
Hang in there, you never know yet - it might all work out just fine from this end. Either way as mentioned before she might start looking for a cosponsor now for the next review. Good Luck!

do u think we can save time if we get her to live with me here ASAP? without waiting for the USCIS to reaffirm or not - NOID/NOIR, (6months from now). we will feel bad if the chance for a next interview in 6 months is possible, but to not feel bad she has to remain in the US in her job, she's ineligible to sponsor me anyway as she made $14,000.00 in 2011, it seems to me that since she needs a co-sponsor why waste time trying to be eligible (by the end of 2012 she will have made enough for only 1 year of the 3 years the CO look at, that means she will have to work steadily the whole 2013 and 2014 to have the 3 years fully covered) noway!!!! what pushes me to say this is because i don't see any co-sponsor out there, and i don't know if we can use my share of property that i have here.
we discussed that even last year, hopefully a co-sponsor appears very soon to rescue us, otherwise we have two choices, one of them is not an option, and the other is to get her to live with me.

I kind of thought the same thing here. I would go in a heartbeat if necessary.
You had said your wife had a bad experience there, but you also said where she lives now she has fears of being followed and attacked, she lives with drug dealers in the neighborhood, she is afraid of being robbed... of being alone. I can't imagine that actually being with you in your country would be worse then that... even with the bad experience in the past.
I would trust my husband 1000% he would not let anything bad happen to me. What it boils down to is depending on your outcome she may not have a choice. If she truly loves you and needs to she will come. After a few years and you have enough proof, the two of you can return here together.
Now with that said... let's hope it doesn't come to that~!!
Ok, but then, in the future after couple of years living here, how can she sponsor me not living in the U.S? The rate of incomes here is low comparing to U.S in case she finds a job here knowing that she speaks only english and little spanish, but she will have to learn arabic or french in order to do well in job? is it a possibility, in the future to mingle our incomes to submit an international tax, do u have any idea?
in 1 week our marriage will have 2nd anniversary, because we got married on October 11, 2010, will our petition automatically switch to IR-1?

Sorry for your pain...I see almost 3 decades of an age difference.
You described your wife as.... " my wife living by herself no family no friends" (which BTW dont think helped in proving a bona fide marriage) why cant your wife live in Morocco?
What exactly told the CO is the family and friends of my wife aren't living in the same town she she lives & works, i'm sorry for the confusion and why do you think the fact she doesn't have friends & family in her town didn't help in proving a bona fide marriage? I thought that bona fide is all about maintaining a genuine relationship,marriage,love by providing emails,pics,etc....
When we will know that it is impossible to get me to her, we will get her to me , and i'm not sure that will happen easily. we will see.

Did you detail this information about her business and the loss. In this economy that should have been stated. Do they even know she is a business woman and had her own company? What you have laid out really looks not inviting to a stranger. A lonely woman in a small town that needs a man by herside to I don;t know take care of her protect her.
I understand the family dynamics I and my daughter also were astranged but now are back and talking and bening a family. So happt for your wife about that.
Maybe getting some affidavits from the family leading their support may help alot. REally sorry I feel your love for her and its sad you have to be kepted apart.
Yes the CO knew that she had her little business (it's not a business with great revenue),
MY wife lives in town of northern California located couples of miles from a village where lots of south-American drug traffickers are active they're all over the place where she is, and number of homeless people is growing, she has been hassled and harassed so many times by homeless people, she keeps telling me that things became like that only in the last 2 years, as she was living in another town nearby she used to go shopping from the town where she's living & working now.
Please don't hesitate to ask me more questions so you can have a clearer image of our life, story and circumstances.

You have no idea the sadness and heart aching we're experiencing, if only she coul, in fact we tried landing us here in my country which was the plan from the beginning, just recently i asked her to just come and we will figure out what to do depending on how things will be, she simply thought that i'm irresponsible and that i don't consider her feelings when i asked her that question, because she had a really bad experience here, that point is complicated, really complicated.

Correct, my first administrative review was done locally, at the end of my interview, the CO stated " ..until i'm convinced of the legitimacy of your relationship, i need to look over your proofs of correspondence, then the consulate will call you", no 221(g) was given by her, but later on same day, going over the documents given by the consulate staff, i found the 221(g) among the documents I & my wife submitted throughout the process from the start, then after many inquiries, consulate informed us the case is under administrative review, couple of days after that, the consulate called to inform me the I-130 is missing, 2 weeks later, consulate called me for my new interview schedule, interview took place Sept 27, 2012> 221(g):petitioner ineligible to sponsor the applicant > petition needs to return to the USCIS for Administrative Prcessing, that's the real AP Mounir, I see you at the exterior window of the consulate grabbing your passport within the CR-1 visa very soon.
