Hello again VJ members, i've been here since SEPT 2012 and i stamped my passport in DEC 2012 in Spain in order to get an extra 90 days, now i over stayed my visit because i thought that my husband was gonna get approved in APRIL 2nd 2013 so we would leave to the US together but he was put under AP. the question is should i go ahead and get an other 90 days or it's ok to stay and just wait for the visa to get approved..because it's just a matter of time i called the us consulate today and i requested to speak to an officer and he told me everything is fine, we have all the documents needed and your case is only under review it won't be sent back to the USCIS or the NVC.
cheap tickets to Paris or Milan round trips, your Moroccan husband needs a visa to enter these countries.

Everyone wishes you well, but what we are are saying is your wife needs to put some effort into trying to get you here also. Its not about support and finances, its also about how it appears to the consular to see all signs of proof coming from the beneficiary. I would do anything it took to get my husband here with me, I work full time and I spent every evening preparing our file for the I-130, and I would do it again and again if that's what I needed to do. Don't waste this opportunity to prove your relationship is legit, your walking on thin ice right now.
I totally agree with what you said, let me explain something, my wife just got this better job 2 weeks ago, she has to let them know 1 month ahead if she needs to take off, knowing that 90% of the paycheck goes to bills and rent, she can take off now but the landlord won't wanna hear about the NOIR nor AT & T would, her nature of job obligates her to be away from her apartment where she has the necessary evidences, working 4 days on a row, and as part of this i can't just watch it falling apart just to NOT LOOK SUSPICIOUS, she has no savings because in America there you pay for doctors and medications which sucked half of her savings on top off the tens of thousands of $ we spent here in Morocco previously trying to establish a life we thought in our dreams that is possible, if there's job a guarentee for her once we're done with the NOIR letter, she would be doing this as well, knowing that a good amount of evidences are here with me, i had them to show at the two interviews. Thanks

Most people here are desperate to be with their loved ones. She hasn't seen you for two years and is ' too busy' with a new job? Seems crazy to me. I would do anything so that we could be together. You can't tell me she's working 24 hours a day? You seriously need to get her involved otherwise you won't get the case turned around.
the job is for bills and sponsorship, no, not 24 hours / day, wish us good luck

Your wife having a new job does not seem like a legitimatereason to not help with your case. You should not be doing it all. If there isa will, on her part, there is a way. She CAN help. I, in fact, did most of thework for my husband's case or we did it together. I wouldn't have trusted himto do it all by himself!
When workingwith the consulate they want to see exacts, but not memorization. Morocco is arough consulate. I also had chat logs but I only submitted a few pages fromeach month that we chatted along with a few pictures. Like another poster said, you have a lot of red flags but anything is possible. First and foremost youmust get your wife active in your case. Good luck and contnue to ask questions, there are many indivduals with VJ with outstanding information and experience.
Thank you. my wife wishes she could help, i wonder if anyone could give me a thread link of similar case, cause i'm having no time off, this has to be done and shipped asap, shukran everybody

http://www.marcellislaw.com good luck, maybe he can help you organize. If you don't mind , what are the reasons for the consular thinking you are scammers? Did they actually give a detailed explanation as to why they think that?
Thank you for the lawyer's website, yes they gave details on the letter explaining why they think we are scammers:
" The petitioner and beneficiary were married in Casablanca, Morocco on October 11, 2010. During a visa application interview at the American Embassy in Casablanca, Morocco, the interviewing officer determined that the relationship between the petitioner and beneficiary was a sham entered into primarily for circumventing immigration laws. The interviewing officer concluded that there was a good and sufficient cause to believe that the beneficiary never intended to establish a life with the petitioner. The consular officer based this determination on the following facts.
· The case contained a significant number of high fraud indicators seen repeatedly in Moroccan marriage fraud cases. Namely, the couple met online, the petitioner has been married twice before, and both the petitioner and the beneficiary are or were recently (during the relationship) either unemployed or underemployed. Additionally, the petitioner's latest divorce was final only six months before her marriage to the beneficiary, well after their relationship was established . All these factors make it socially and culturally unacceptable for the two to marry.· The petitioner has not returned to Morocco since the marriage, nearly two years ago.
· The beneficiary was very unfamiliarwith many details surrounding his wife's current employment regular activities. (NOT TRUE AT ALL)
· The couple provided stacks of supporting documents several feet tall to prove the legitimacy of their relationship, an excessive over-documentation never before seen by the interviewing officer.
Additionally, according to the beneficiary, the petitioner was unemployed between 2008 and 2011. The employment history of both the beneficiary and the petitioner raised concern as they fit a fraud pattern in Morocco of the underemployed or unemployed women, usually significantly older than the Moroccan beneficiary, marrying underemployed or unemployed Moroccan men)seeking to manipulate these women for immigration benefit. Along with the significant age difference, the petitioner's prior marriage, the petitioner's divorce very soon before her marriage to the beneficiary , and the fact that the petitioner has not returned to Morocco since the wedding, the case has an overwhelming number of fraud indicators.
When asked specific questions about the petitioner, the beneficiary was able to answer with such a degree of exactness and specificity to suggest that he had memorized many facts, such as the dates of her previous marriages.
The beneficiary said his wife is very faithful in attending church every Sunday; however,he did not know any details about the church, such as its denomination or its size. ( I SIMPLY SAID MY WIFE IS CHRISTIAN).
After a review of the excessive amount of supporting documentation provided with the case, the beneficiary returned for a second interview. The interviewing officer gave the beneficiary the opportunity (THREE MINUTES MAXIMUM OFFERED BY THE CO) to give more details to support the legitimacy of the marriage.
Based on the foregoing, it appears that the marriage between the petitioner and the beneficiary is not valid for immigration purposes and that the beneficiary is not qualified for the classification sought. Further, "good and sufficient cause" exists in the present case which supports the commencement of revocation proceedings.
the letter continues.......

I just want to point out that you aren't giving yourself enough credit, your english is quite good. Do you actually get a chance to look at what your lawyer is submitting on your behalf once he goes through the evidence you sent? Unless you know a lot of people that know your lawyer and have had good experiences , I wouldn't trust them with my future or paperwork. That's just me! Now on the other hand , you state you want a new lawyer....I have heard that a lot of people on this website are very impressed with Mark Ellis , I think his contact here is Ellis island, someone help with this if you know more about this lawyer. I have seen a few things he's submitted on here and he seems genuinely interested in helping couples unite according to immigration law and is very knowledgeable!
Thank you Destiny64, I get no chance to look at what our lawyer is submitting, my wife will, I'm going to make emphasis of the the items that should be submitted, looking at the facts against us that were concluded by the CO i can also find facts to rebut the CO's ones but using evidences, here i mean explanations, each explanation needs piece(s) of evidence to support it, therefore, i don't know how to find Ellis island, i tried the member finder filter but no result, meanwhile, surrounded by papers, i'm fasting.

If your wife can't take the time to provide proof and write explanations to convince them your marriage is bona fide then how are you going to prove to the consulate that they are wrong? You can hire 20 lawyers but if none of the evidence is coming from your wife and you are doing all the work , that could be what is causing all the suspicion. Make the time!!
My wife just got a better job, she can't take couple of days off, I'm doing all the explanations with my poor English hoping that the lawyer put it in a professional language style, in the other hand, im gathering maximum evidences, so bad, we had submitted original copies of several items as evidences through the NOA1&2 and NVC stages prior to the first interview, we got no copies of them!! I'm under huge pressure because i need to get everything ready to ship on Monday because the delivery time will take 5 days minimum from Casablanca > California, the NOIR letter was originally mailed on March 14, 2013, i don't know when our lawyer received it but he faxed it to my wife on the 18th, each minute counts now, im gonna try to sleep now. thanks guys

So get busy, engage with an attorney today !
Do we need to submit any form to let them know that we have a new lawyer or something like that?
-
you can do whatever you want, really, for the rebuttal -
--use prior lawyer
--use new lawyer
--do it yourself
Thanks Darnell, why we want a new lawyer is because the USCIS is needing certain explanations + evidences, the explanations have to give insight into the nature of our "claimed" relationship and convince that we have a bona fide marital relationship, my wife just got a new employment and has no time free to write the explanations, additionally, my English remains poor for writing such explanations, our current lawyer is not not dependable, you can see why we are in need for a new lawyer.
-
Hello,
We are astounded hard, we received the NOIR 4 days ago, the main thing they're saying, is the CO determined our marriage was entered into primarily for circumventing immigration laws, it means we are considered scammers both me and my wife!! We are given only until April 14, 2013 to submit evidences, we have a lawyer since the initial filing, we haven't been assisted by him enough and now we are considering hiring a new lawyer, how does it work to hire a different new lawyer?
Thank you

So... after a few years here, I've seen the drama, I've seen the... strong women sharing their sometimes unpopular or "harsh" opinions with newbies and/or people who they characterize as the "rainbows, sunshine, and unicorns" folks... the skepticism that many MENA people get when they post here without telling their USC partners about this place... and it got me wondering...
Do we need a FAQ or "Welcome to the MENA boards" sticky? Something to explain a bit about the tone of the boards to the newbies who come here and might get scared off by the content here? Because I know that the "reality checks" are needed, but it seems like there are an awful lot of questions that come up a lot. It feels like we're constantly describing red flags, etc.
Is a FAQ/introductory post something that we might want to work on as a board and make a sticky? It could include things like:
- What is "MENA" and other acronyms?
- What are "red flags?" How do we overcome them?
- Why is there so much talk about fraud on the MENA boards?
- Why do people keep asking me hard questions that might seem irrelevant or like they don't trust our relationship? (answer- because that's what you are up against at the consulate)
- Past interview questions
- Why do people here seem "harsh?"
- Country-specific details that come up often
Again-- just a thought!
I know that it would have been helpful to me to see this all in one place when I first started... before jumping into the discussion head-first, so to speak!
Love and respect to all!
k
As a newbie but not being USC in here, i've been noticing so much demoralization and hope-destroying people, many of them justify their behaviors as being factual or to-the-point because immigration is no fun, the newbies eventually realize it's no fun, and that they should do their absolute best to overcome their weaknesses and to not anticipate or expect any good from the immigration corps, "oldbies" are supposed to open newbies' eyes not demoralize them which harsh.

My fiance didn't take advantage of going to college in Morocco...and at least once a month I ask him why not...to his annoyance.
I really want him to take classes at a local community college when he gets here. (In my opinion, I think it will help him to get a decent job in the long run here) During my research, I find that most school want high school/college transcripts. When I ask Abdou about his transcripts from high school I can't seem to make him understand what I am talking about. I know he didn't go to an international school so I'm really not sure if they have the typical "transcript" that I am used to in the States.
My main question is this: if you SO started going to college in the US what documents did they get from Morocco if any.
Thanks in advance!!!
Tasha
Someone who -successfully- got the Bac (in French) = high school diploma (in English), doesn't need to pass the GED, they can go to college in the United States, if your husband didn't get the Bac, he will need to pass the GED tests in the United States, the GED is the equivalency of the high school diploma, he better start preparing from now on, the GED test covers : social studies, science, language arts, reading, mathematics. Good luck

no idea, but then i don't understand the big poufy dress thing at weddings, or stupid cakes and all that nonsense. weddings and people's preferences for certain things at weddings are nutty, imo.
you hit on a really important thing there, re. some women on this forum throwing out their religious preferences for that of their spouse's at weddings. some people are irreligious, but nominally christian, and don't care one way or another. but that many?
there's a trend on vj mena anyways, from my observation. as a muslim it's not like i'm advocating for muslims to get married to their christian spouses in churches, but i wonder why it's so often my way or the highway for how lots of mena guys want to get married.
mena guys want to get married thinking they can have better grip than fiancè route. fact!

My wife just got back from the embassy's doctor and he didnt gave her the medical report, but he said he will send it to the consulate by himslef? is that true?? coz what i heard it once u are done with all tests and vaccination, benificery will be given a sealed envelope with the medial result and report...
I'm a beneficiary from Casablanca Morocco, I was given the sealed envelope of my medical examination result by the Dr associated with the consulate right prior to my first CR-1 interview back in Aug 2012, what's the name of the Dr your wife had the examination at?
-
Sounds good.
Do you and your wife share another language besides English? For example, emoticonese.
omg im laughing hard, sorry , gd luck to everyone

my interview is coming and I heard from someone in other forum that having a wedding party will help a lot in avoiding AP after the interview, so I was wondering if any one had any experience with that? cuz I know two couples here who didn't go through AP and they did have wedding party, I know this is kinda irrelevant but I got worried cuz me and my husband didn't have a wedding party, any one who didn't get AP or got it please share you experience in Cairo
We didn't have a wedding party due to circumstances, we got denied twice AP + AP the CO said my wife is not meeting the financial criteria, that's why we got denied, but surely not having a wedding part can affect your case a bit, just do anything to support your case, these days we people from the MENA need every little detail that can support our cases, so make pics with family and all, and wedding party if possible, good luck to you

Haha GREAT, im glad it worked for you
ya welcome
Lol the ads are like every 10 min ;( but yeah it was worth it
Thanks! yeah i kinda felt really brainwashed by ads today, comparing those on Hulu with ads on our Moroccan channels
-
The title is '' Crossing borders '' each episode is different the uploader of the video landed on the Moroccan one and she/ he posted it which really good.
The thing is IM IN Morocco too and i got to watch it and so should you but ONLY if you do as i said download the software activate it and your IP will be American.
It's only a trick nothing fancy .. Good Luck bro on your journey and hope you'll get to see the video. Peace up
It worked, thanks a lot, i watched the entire thing, great documentary, worth the ads interruption
-
My favorite part was when they all went to Sidi Moumen. Honestly for me it was the most redeeming chapter of the movie. All the Moroccan kids seemed fairly upper class except the one who dropped out of school so it was great to see them and the Americans get perspective on just how stark and contrasting the realities are between the economic classes. I had a very similar experience in South Africa when I was a teenager and it changed my entire world view forever.
Excuse me , just wanna know if the documentary spoke about Sidi moumen in Casablanca, i'm asking you because Hulu allows only viewers within the United States, I'm in Morocco now. thanks
-
kristen_maroc Thank you so much for sharing the Link
Sarayoubliss i had the same problem but if you use (hotspot shield)--(www.download.com), it's a software that change your IP to a US IP you'll be just fine and that goes for all the ppl that wanna watch this documentary but can't get access too.
Thanks, I changed my IP address but it didn't work, then i remembered the Hulu message that says the video library can only be watched from within the United States, so i chose to use a US IP but this time a different message said the server detected the change of my IP for purpose to access Hulu's library,
I'd like to know the documentary title, i will Google it hopefully a video provider has it uploaded.

Currencies of MENA countries have very lower value compared to Dollar or Euro, Dirham (Moroccan currency) cannot be wired nor bank-transferred. In my opinion, the case when the female USC sends money to her MENA beneficiary, the beneficiary is the one who is looked at suspicious not both.
Culturally, it became normal for the Moroccan husband to be helped financially by his wife, not to have fun with it, my mother sold her lands to rescue dad's business back in the 90's, if the USC female supports her jobless MENA beneficiary i think it's normal, not a huge fraud indicators compared to if he sends her money, then it's obvious, socioeconomically it's impossible.
