    I think I will wait 3yrs to apply again. My green card wont be expired till 2018 so I dont have anything to lose. Once you learn from your mistake, you won't do it again and you try to make it right. That's what I'm doing with my life and trying live my life to the fullest. Thanks to those who shared their opinion with me.

    I was correcting your assertion that "... this has no impact on anything". Arrests CAN and HAVE been used against people, specifically by USCIS, even after said charges have been dismissed. I was stating that this MAY have an impact on immigration, and that USCIS MIGHT hold it against them, I was not talking about police resurrecting it.

    Actually you're wrong. Could be dismissed with or without prejudice. Being dismissed doesn't mean innocent, it means they didn't have sufficient evidence to get a conviction at the moment and could come back again (depending on the with or without prejudice part) and USCIS HAVE been known to use an arrest against someone (there was a thread somewhere which I tried to find but couldn't). I think there were other negative factors in the case but regardless it was held against him/her as a negative

    JUST BOB --where did u get your ''information '' about deportation from ? Stop sweating out the man . A person will not get deported for a misdemeanor . He is asking for advise not criticism . Besides I do not think you are legally qualified to give such advise .

    I just read this whole thread, and I would make sure to hire the VERY BEST lawyer you can find, one that will tell you whether you have a case or not. I worked with a firm in So. California (pm me if you want their name) for many years prior to my LPR, and they would not take a case for whatever reason unless they were absolutely sure they could win it. They will do a phone consultation (free) and will tell you whether they will take the case, based on whether they can win it. (They are considered to be the no. 1 immigration firm in the country). In your case, which is very scary and major, THAT is where I would be going, I wouldn't mess with USCIS for ANYTHING. Trust me on this, I have been through some very harrowing US immigration experiences, and been on the wrong side of them more than once for much less than you have going on.

    You can request your own report from FBI. If you goto FBI website you can find a list of companies that are authorized to get you, your own report. Take a look at and see what it says. When you apply for certain jobs they will pull your FBI Report. Clean it up so it can be helpful to you in the future.

    Please ignore the plethora of "rubbish" that many of these VJers posted. A simple question is asked after you clearly admitted fault and stated your case and all is needed is an answer to the question. Not insults (example, people labelling you a thief in PRESENT tense!). Wow! This is a forum that is supposed to be filled with advice in the ABSENCE of insults and "judgements."
    my thoughts to you is consult with a GOOD and highly recommended attorney who has experienced similar cases. It may be that you can appeal, it may be best for you to wait. But that's best answered by the attorney.
    In the meantime, enjoy your marriage. Like someone on here said, that's all that should matter.

    This topic has managed to continue and is now 6 pages long and two days old.Mainly because we have people who want to be judges of character.I have to say that this is the first time on visa journey that people have posted 6 pages with about half of those pages address irrelevant isues or just blasting the person who needed a simple answer.Many times when someone posts people simply ask the person to provide as much info as possible in order to be helped.Now that this person has given all the info, we have some of the "God's" of Visa journey descending on her like a ton of bricks.I wonder if she even got her initital question answered instead of the grandstanding that some people here have shown.
    Ibluemoonl.I hope you realize that not everyone on VJ has taken the judgemental, I am better than you stance.There are a lot of people who support you here.

    How on earth does calling fellow member a thief is not a personal attack. I like JustBob too and he is a good contributor in this forum; but today, with all due respect, he is out of line - way out of line. I was looking if those personal attacks from respected members would attract any attention from our moderators. I was pleased to see one of them giving warnings against personal attacks. Fairness and general forum policy should not waived from any member no matter how we like him/her or how much he/she contributes. The OP, in his original post, mentioned that he misunderstood the question. He repeated that by saying it was not in his/her intention to hide anything. Any reasonable person would take the OP's word for that. Even if you don't believe the OP's story, do not judge or call him/her names. Offer your help and politely mention the mistakes of the OP, if any. There are many ways to show the OP the terrible mistake he/she has done. Calling him/her names is not one of them.
    OP, as stated, this could have been far more worse as the IO could cite misrepresentation in their denial letter. I would just wait the 3 years and file again through a lawyer.

    I don't know much but I do agree, maybe you misread the question, but you should've definitely made the intent of stating what you did. When my dad filed for naturalization last March, he had had a dismissed stop sign violation, but he still marked that area because it falls under detained. Meaning, you were stopped. Just because you didn't have the handcuffs on you doesn't mean you were not detained or wrong in doing something. I do believe you can reopen the case, and ask a lawyer, a good one (not one of those who you call and an answering machine picks up with the hope they'll return your call) in order to make sure they can help you. If they gave you a form of appeal use it wisely, Im sure theres a way to explain

    Thanks, Moroccan. I will see my attorny tomorrow. He definitely knows a lot more about these issues and the procedures. I think I will give myself another chance to explain myself and the situation.

    I would suggest staying put for 3 years. If you insist on speaking to a lawyer, you might want to go to one of the free consultation ones and try to see what the lawyer says. Disclose every single thing that has happened. Its better to write it on a paper before you go to a lawyer. Ask him/her your options? Keep in mind the fact that lawyer wants money too. Evaluate his advice. An honest lawyer (seemingly impossible to find) will give you a true picture about chances, risks and costs involved. Based on that, make a decision. Some people here think like an IO.. some people think like an applicant so you will get a lot of different views and ultimately either be furious or frustrated. To emphasize again, make sure you write the whole thing on a piece of paper and take it with you when you meet the lawyer.

    Even if you apply after 3 years, I would advice to go with a lawyer at your interview. It really helps. I filed a lawsuit against USCIS alone but had a lawyer present when i went to them, that really helped.

    I agree, you were right! at least you admit that you made a stupid thing and you learn from your mistake.
    even though they have some point of view which is right, but instead of giving you a good advice they judged and insult you for your mistake. But you cant help it, some people may understand you some may not.

    No body is perfect, anyone can make a big mistake sometimes not intentionally..
    all of you have your own point i guess, but i understand her in her situation,that she share her problem in this site to get some advice not to be judged I guess

    I would go talk to a lawyer and figure out what the next best step is. No one on here is a lawyer, nor are they God. They have neither all the information or the right to judge. Good luck on whatever you decide to do!
