  1. 1) What is OPTIN vs DS-3032?

    Both sounds similar, as in choice of agent (USC spouse to be the choice of agent).

    2) How are you going to send it tomorrow after you Wife signs it? Isn't she in China?

    or do you mean to email her and then she signs it, scans it into a PDF format and emails you and then you email NVC.?

    I received the AOS bill and DS3032 today, just as Ryan predicted. :-) I am able to login to the payment center online. Even though we previously prepared the DS3032 form (downloaded & signed by beneficiary before), I plan to be cautious to have my wife (beneficiary) signed again with the DS3032 included from NVC since it has the case number & barcode on top. And send OPTIN email for EP with it tomorrow.

    The AOS bill asks about whether the current address of the beneficiary is correct or not. My wife did move to a new address than the one when filed I-130. Because I am going with EP, I suppose I don't have to send NVC the new address as long as the new address is used in the IV DS-230 package later. Would that be an problem? Thanks!

    1) What if we submitted our returns to IRS but the transcript is not available to order since it was just recently submitted. What do do then?

    Include Tax transcript of 2009, 2010, and 2011 amended return + w2?

    I'm going send my Amended 2011 returns next week, so thats why i ask if i get to NVC before my 2011 amended tax transcript is available.

  6. Right, I'll be taking all my copies to the interview in case they're missing something. You do send copies of civil documents (marriage cert, birth certificate, etc) along with the Originals. If you didn't send copies of civil documents just bring them with you to the interview so you can collect your Original Docs.

    Original Civil docs: Marriage certificate and Beneficiary's Birth Certificate.

    What else? is there other Certificates i'm not remembering?

  7. I heared it is good idea to send originals and with it, copies of the originals.

    I would also put sticky notes saying "Originals" on original docs ( Marriage certificate, beneficiary birth cert.).

    Also put sticky notes saying "Copies of Originals" on copies docs.

    I would think Doing this may get your beneficary better chance at getting Original docs back on the interview day.

    In that case, i will mail NVC my 2008, 2009, 2010 tax Tranxcript and 2011 1040X with 2011 W2.

    If i get RFE, then i will mail them the 2011 Transcript after it is available from IRS by calling them (this is how i ordered the previous year transcripts)

    No no big no: a 1040 is NOT a transcript, it's just your tax return. Tax return transcripts are documents you need to order from the IRS. If you just send the 1040, then you'll need to add other forms like W2s, and they might still request the transcripts eventually.

    So you want to order you tax return transcripts online or on the phone with IRS, you'll receive them within a week usually. You can also go to your local IRS office and have them printed out immediately.

    I did the Amend for my peace of mind by not leaving anything on Chance.

    Plus i think it would look GOOOOOOOOOOD ! when presenting to NVC or CO our US tax transcript showing "Married filing Jointly". Know what i mean ! :thumbs:

    I just talk to a member of my portal ( Haiti) that recently got her husband visa approved. She said that she filed single and there was no problem

  10. Ok i have an idea then.

    She can just go to the same Tax service place and ask them to show her the Refund amount if she were to choose Filing Married Jointly.

    They just need to make some minor checks here and there in their program and she'll see the result right away!

    Then you guys decide if going this route is better or just stay same.

    She has one kid of 6 years old and her sister is her dependent. She is 15 years old.

    We are not ready to refund any money now as 90% of the money was already used for stuffs that she had to take care of

    I think NVC just asks for Tax Transcript and 1040X is the Tax Transcript. It will show you are NRA (non resident alien) but the I think the bottom line is that this is a 2011 Tax Transcript showing you guys filed "Married Filing Jointly".

    Your USC wife SS# is present on the 1040X so I don't see any reason why NVC will want to see your IRS Tax ITIN#.

    Somebody correct me if i'm mistaken.

  12. 1) 1040X (this is the Amend for your 1040 that she filed) (Signed & Dated by the Paid preparer, NRA You, & USC your wife)

    2) Form W-7 (this is requesting ITIN# for you. You are a NRA (Non Resident Alien) (Signed & Dated by NRA you)

    3) A Declaration letter stating that you both declare you the NRA to be treated as US Taxpayer for the year 2011. (Signed & Dated by both USC your wife and NRA you). Under SS/ITIN# for you NRA: write applied for

    4) A Notorised copy of your Passport (The biographic page).

    5) also maybe i'll send a color copy of our Marriage Certificate? i don't know

    Once your USC wife gets these from you by mail, she will mail to below address as instructed in the W-7 instruction guide.

    Once they assign ITIN# for you, i was told they will forward the packet to below address as instructed in the 1040X instruction guide.

    note: #1, #2, and #3 can be emailed to you in pdf format, so you can sign and mail to your wife.

    Before mailing all to your USC wife, make some copies for yourself!

    In anycase, Please take these steps with a grain of salt as this is first time for me and I'm not 100% sure but from what VJ members have said, this seems to be the correct steps.

    I'm emailing all these tonight to NRA spouse. :thumbs:

    LATER ON....your wife will get your ITIN#. Only then she will file Amended State tax.

    Until then, when your wife gets the previous returns from 1040 and state. I would not cash or deposit them because she will get updated returns so i'm not sure if IRS will ask the previous money back or not. I will just keep it in a folder.

    What form will she need to fill to amend the tax, what are the step to start? please inform me. Thank you so much for your help

    What do you mean by it will delay the process?

    I just amended it at the same Tax service place and got it in less than 15 min and so i will send the updated 1040X transcript to NVC when i get to NVC.

    I know i will get returns a little late but at least i'll have an Amended 1040X Transcript which will show Married Filing Jointly.

    I don't understand what delay you are talking about.

    Ok but i can not amend now it will delay the process.

  14. Today I went back to my Local tax service place and filled out the 1040X amended (Married Filing Jointly) + W-7.

    Today or tomorrow, i'll email all the documents to my NRA spouse so she can sign and snail mail back to me (1040X, W-7 + Notorised foreign passport + W-7 declaration letter). .

    Then i'll mail it to all to

    ps: i don't mind getting my returns late as i would like to present the 1040X showing married filing jointly status to NVC.

    Ok thank you to inform me, I am no longer worried as plenty of members here and some of my family filed single by the time their were in the process of getting their spouse in the US. I am cool and calm down now

    Oh wow... I talked to IRS for an hour... and she told me to file married/separated... and put NRA on SS# for my spouse who is not in US yet... BUT his visa has been approved... we are just waiting for it... maybe that's why..... I would go with what you were told IF you trust that source.

  15. You can do an amend anytime after filing, just remember that an amend to be processed by IRS takes a few months (4-5). I did one in 2008 and it took for ever to get my return.

    I'm okay with late returns due to my Amend.

    I just want to Submit the correct Tax transcript to NVC.

    Correct Tax transcript would be the Amended one 1040x (married filing jointly) which i will submit to NVC.
