    Simple question!

    My wife has her Interview in a month at the consulate in Juarez. I am the Petitioner and husband. Do I go with her to the interview? I always assumed I would, and my non-profit lawyer said yes, but I read online that only certain people are allowed inside the interview and Petitioner wasn't one of them. Does my wife have to go to the interview alone?

    I was there on August 3rd with my fiance. The New Delhi embassy is particularly harsh...it is an excellent idea to attend, especially if you are an interracial couple. It seems like the K1 filers have a much tougher time than the married couples so that's a plus for you.

    When my fiance and I went up to the window, a 221g form and mandatory AP letter were already printed and ready for us. When the CO found out who I was, he threw the 221g form away. That alone was worth it in my book.

    New Delhi doesn't have an issue allowing you into the embassy, I was even allowed at the window and to interact during the interview. If you ask VFS if you are allowed to attend, they will tell you no but they don't always know what they're talking about.

    It's never a bad idea, it will never hurt, and it may even help.

    The petitioner being at the consulate is never a bad idea. Many consulates won't let the petitioner attend the interview but what you can do is take their US passport in with you and have it sitting on top of the stack of evidence so the VO knows they are there. In my opinion it is always a good thing if at all possible. Whether it helps or not is debatable, but it certainly never hurts.

    1) Pictures of vacation(s) together preferably with noticeable and obvious landmarks etc...

    2) Marriage photos with your spouse's family members and friends that you took in court

    3) Print Emails and Phone call records.

    4) Marriage Certificate

    5) Air tickets to see your spouse

    6) Tickets from your vacation together

    7) AOS: Affidavit of support from your family members acknowledging that you married etc...

    8) Receipt of the engagement ring purchase

    9) Receipt of the wedding ring purchase

    10) Screenshots of Skype video call records

    What kind of proof will be expected if a couple marries in the judges office and does not have a church wedding with allot of people present. What kind of pictures will be considered proof of the couple getting married?

  7. Submitted i-130

    Got NOA from i-130

    We sent i-129F and stated in the cover letter that it is for K3 visa :dead:

    Questions:

    Will i still be able to change to CR1 later?

    Will they ask me if i want to go the CR1 route?

    What do you guys think is the better option? obviously everyone wants to be reunited sooner than later. :innocent:

    I have found answer to my Question 1,2, & 3.

    I still have 1 question that i need help with guys or a suggestion to what i should do.

    4) In I-130 that we submitted, we forgot to enter dates on Question # 21. It asked to enter last address where we lived together and dates, We entered the address but forgot to enter the dates.

    Should We call USCIS about this? or wait for them to resubmit or ask for ROE request of evidence?....?

    I wouldn't bother with the K-3 visa

    You've submitted the I130 so you are on the path for the Cr-1 visa, which will allow the beneficiary to enter the US as a permenant resident with work privledges immediatly.

    My advice, simply do not bother with the I-129F

    However, if you are set on doing it, yes you should include the NOA for the I-130

  9. I-130 was sent.

    Few days later, received email notice "USCIS Acceptance Confirmation"

    Few days later, received the actual letter in mail "I-797C, Notice of Action" *it has letter 'C' at the end, so I-797C not I-797 as stated in the guide steps.

    Q's.

    1) Is it time to send the I-129F now?

    2) Also in the guide below it states to send a copy of I-797, does not says I-797C. Are they same, just letter 'C' got left out in the guide?

    3) When the guide states "Once you receive the NOA1 for the I-130:", is it talking about I-797C ? I-797?

    3) This letter does not state anything that we need to do. I thought "Notice of Action" meant USCIS would let us know what we needed to do next.

    Once you receive the NOA1 for the I-130:

    Assembling the I-129F Package: Checklist

    Forms and Documents (follow these assembly instructions. All supporting documents must be in English or be translated as noted here.)

    1. Payment as required by USCIS (I-129F petitions for K-3 status filed on/after July 30th 2007 have no fee since the I-130 cost was increased). Use a check so you can track the payment.

    2. Cover Letter. Should include a description of what your are petitioning for (K-3 Visa), a table of contents (list everything in the packet). If you need additional room to explain your case, attach a separate sheet (list the attachment on the cover sheet). Make sure to sign and date the cover sheet.

    3. Copy of I-130 Transfer Notice (indicating where your underlying I-130 petition was routed to after it was filed at the appropriate Chicago Lockbox).

    4. Form I-129F: Petition for Alien Fiance(e). This form may be used to obtain a K-3/K-4 visa for your alien spouse and her or his child. Fill out the form as directed, except assume that "fiance" or "fiance(e)" means "spouse." answer Questions B.17 and B.18 by stating "N/A." Note that filing this form is only necessary to facilitate the entry of your spouse and her or his child as a non-immigrant.

    5. G-325A filled out by the US Citizen signed and dated.

    6. One passport-type photo (see specification) of the US Citizen. Write the full name of the US citizen on the back. Place in a plastic bag and label the bag "Photo of <US Citizens Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    7. G-325A filled out by the foreign fiance(e) signed and dated.

    8. One passport-type photo (see specification) of the foreign Spouse. Write the full name of the foreign Spouse on the back. Place in a plastic bag and label the bag "Photo of <Foreign Spouses Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

    9. Copy of the Birth certificate for the US Citizen (front and back) or a copy of ALL pages of the US Citizen's passport or a copy of the US Citizen's naturalization certificate (front and back). This is used to establish citizenship.

    10. Copy of the NOA1 from the I-130

    11. A copy of your marriage certificate (If not in English then again get a translation)

    12. In regards to Section C Question 2, if applicable provide certified copies of all court and police records showing the charges and dispositions for any specified conviction(s) (in accordance with the IMBRA). See section 9 of the I-129f instructions for more information.

    Attach "E-Notification" Form (Optional)

    Clip a completed G-1145, E-Notification of Application/Petition Acceptance, to the first page of your application (on top of the cover page). By completing this form and attaching it, USCIS will send you an email and/or text message to alert you when your application was received.

    Mail the I-129F Package to the USCIS

    You should mail the completed form(s) to the USCIS Dallas Lockbox. Mail the package with return receipt requested / delivery confirmation. Send via USPS.
