    That is correct. She will need to complete CFO and pass the consular's seminar. She will get the seminar certificate, and CFO sticker. This always here to leave Philippines. Once that is completed book the flight!!

  2. What I can advise to those waiting for the NOA2 approval letter. Start preparing your fiance or fiancee I-129f package so when it comes time for that part of the process. You will be ready.

    This part is for Philippines K-1 Visa:

    It is a flat rate. Stuff as much as you can in to those Balikbayan Box. Just make sure to protect or wrap up anything of importance. As these boxes are placed on ships and let's say they are not handle with kid gloves..

    You have great enthusiasm and hopes :D . In this Visa Journey, best not to put dates and months in concrete. There are some many things that could delay your petition or receive RFE etc...

    Also after you receive your NOA2.

    You need to wait for USCIS to send your I-129f package to NVC (avg 7-14 business days and anywhere up to 90 days). :whistle::clock:

    Then you need to wait for NVC to assign a case number (MNL#) (avg 5 - 10 business days if not errors are found or made on the petitioner part, USCIS or NVC). :whistle::clock:

    Then NVC will need to forward your I-129f package to Manila USEM. (5 - 10 business days). :whistle::clock:

    Once you have the case number you will need to schedule the Medical at St. Luke's Medical Center Extension Clinic. This can be done while waiting for USEM to enter you case into the system. Medical is a 2 day process as long as there are no issues... if there are it could be up to 2 or more weeks depending on the issue..

    Then you will need to pay the beneficiaries I-129f petition. Gathering paperwork needed and mailing etc... You can now schedule your interview date at Manila USEM.

    You will now wait for what ever date you choose. :whistle::clock:

    Interview is a 1 day process as long as all your documents are correct and passes the interview questions.

    If you pass. You will need to wait for your passport and visa to be either delivered to your address in philippines or you can pick it up at your local 2GO pick-up location. :whistle:

    Then you need to schedule your Commission on Filipinos Overseas, CFO. You can do your CFO seminar before your interview and get the seminar certificate but you will need to return once you receive your passport and visa in order to get the CFO stickers. You will not be allow to travel without completing the CFO Seminar and receiving the CFO sticker.

    Once this is completed. You can now book you flight to the USA!!! :dance: :dance: :dance:

    The key to this Visa Process is patients patients patients. Due Diligence and triple check everything. One mistake can delay you for weeks or months :oops: !! :o

    There are no fees to be collected at the interview. Only out of pocket will be transportation and food etc.. for your fiance if needed. Most likely will be hunger after the interview.

  6. This is not correct. The NVC most certainly CAN deny the petition or return it to USCIS if they find an error. If they could not there would be no reason for them to do the background checks or AP that they do.

    It is not common for this to happen but it CAN. The consulate can also deny a visa application OR can reject the petition after it is approved by USCIS and the NVC.

    There have even been a number of cases where visas were revoked after being issued and the beneficiary asked to return their passport to the consulate. This is extremely rare, but has happened

    An approved petition is NOT a visa and the process can be held up, denied, rejected or revoked at any point

    You are correct NVC can deny an approved USCIS petition. As you have a broader knowledge of the Visa process. I trust your information. I was just stating the best case scenario. Thank you for clarifying.

  7. I'm going to hijack this post and ask: is it a mandatory step to call NVC to get the new case file, or is it just to gain to time? I'm wondering because we received our hard copy of the NOA2 last Friday and i thought they would contact us again with the new case information.

    125% of Poverty Line Must Equal: $18,387

    The petitioner makes enough at $40,000. No co-sponsor is needed. Just have her provided the 2009, 2010, 2011 W-2 and 1040 forms filed. 2011 1040 she will not have as of yet but still put the 2011 W-2 with the 2009, 2010 W-2's and 1040's filed.

    my embassy is Islamabad Pakistan. or is there any specific requirement for getting them done. I got them done of dec 31 , a month before the interview. Is it okay ?

    Medical examinations performed by non-authorized physicians will not be accepted. The medical examination includes a review of the applicant's medical history, physical examination, chest X-ray, and blood tests. The physical examination will at least include examination of the eyes, ears, nose and throat, extremities, heart, lungs, abdomen, lymph nodes, skin, and external genitalia. The authorized physician will either give the applicant the medical examination results to hand-carry to the visa interview or will send the results directly to the U.S. Embassy or Consulate.

  10. My wife will have her CR1 visa interview on February 1 in Manila. I am looking at the information from the Embassy. It says:

    Do we really need to register the delivery address before the interview? I thought we were to give to the delivery address to the courier service while at the Embassy for the interview.

    You must select a delivery address for your passport's return prior to scheduling your immigrant visa interview appointment. When you select your document delivery address, be sure to have the Immigrant Case Number shown in the U.S. Embassy/Consulate notification letter. If your visa application is approved, 2Go will return your passport and visa to you at the address or pick-up location you selected when you scheduled your interview.     The letter I received also says what documents to bring to the interview. Many of these documents were already submitted to the NVC so the Embassy should have the documents at the interview. Do we need to bring another copy of the documents that we already submitted?

    Yes. You will need to bring all documents listed on the letter.

    For the interview, bring:

    1. Original marriage documents, translations and certifications.

    2. Formal, long form birth certificate.

    3. Copies of any divorce records or death decrees of former SO(s).

  11. Here is break down of Philippines Visa Extensions

    If you arrive in the Philippines with no visa you get 21 days free. Your first extensions is for 38 days, taking you to 2 months. Cost: PHP 3030/US $69

    2 - 4 months Extensions

    Cost: PHP 4830/ US $110.50

    2 month extension

    Temporary ACR Card

    Cost: PHP 2800/ US $64

    Total Cost: PHP 7600/ US $173

    4 -6 Months Extensions

    2 month extension

    Cost: PHP 2830/ US $64.75

    As of mid February 2010, the Bureau of Immigration has implemented a new schedule of charges, as they now require tourists who stay longer than 59 days to obtain an ACR card. This is a credit card sized, plastic card which contains all your passport/visa information. The cost is US$50 and is based on that day’s exchange rate which varies, but is currently around 2300 pesos: you will also pay an additional 500 peso Express Lane charge.

    This new policy has undergone several operational changes of direction since its inception. Originally we were led to believe that the ACR card would have to be surrendered when the tourist left the country; this proved to be false. Then those tourists who had left the country for more than 59 days were required to buy a new ACR card, (even though their old one was still current), while those who had left for less than 59 days didn’t need a new card.

    It now seems that as long as your ACR card is current, you don’t need to buy a new one when you return and get to your first extension after 59 days in the country. The longest example I have tested this on, is a client who had been out of the country for nearly 6 months; we will see how it develops! If it continues, it will mean a saving of about 3500p for the returning tourist although when the old card expires they will be required to buy a new one.

  12. If one person brings over $10k, then yes - you declare it at customs at the airport. You can file form FinCEN 105 before hand or at customs. Failure to declare it can mean forfeiture. You can actually bring in as much money as you want as long as you declare it - you will not be assessed a fee or taxed on the monies brought in.

    (1) Each person who physically transports, mails, or ships, or causes to be

    physically transported, mailed, or shipped currency or other monetary instruments

    in an aggregate amount exceeding $10,000 at one time from the United States to

    any place outside the United States or into the United States from any place outside

    the United States, and

    C. Travelers—Travelers carrying currency or other monetary instruments with

    them shall file FinCEN Form 105 at the time of entry into the United States or at the

    time of departure from the United States with the Customs officer in charge at any

    Customs port of entry or departure.

    You do not need to declare $4,000 to US Custom as it does not exceed $10,000 or more. If it makes you feel safer, each person carry $2,000 a piece.

  13. My I-129 petition was approved on Dec 16, 2011. I assume that the Manila embassy has my petition by now. My finance never received anything, she was supposed to get a packet with instructions according to the letter they sent. I found out through this site that they don't do this anymore. I sent her the required documents and Form I-134. Is there a phone number or a website to check the petition was received in Manila? I really appreciate all help.

    At this point you should start preparing your fiancé’s Packet 3.

    You will now pay for you the fiancé I-129f petition there in Philippines. Fee is U.S. $350 / P15,218. Send a little extra as it is bases on current exchange rate.     When filling out the online applicant or speaking to the USEM agent. You will need the receipt number on the receipt from BPI.

    USEM will give her some dates to choose from. Once she selects a date. Appointment is set!! You can reschedule but they will push you further in the month or next month.

    On the interview date she will have a time most likely 6;00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.

    Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.

    You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:

    battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players

    large shoulder bags/purses - only bags that can be carried by hand will be permitted

    bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers

    food items (refreshments are available for purchase in the waiting area)

    sealed envelopes or packages

    cigarettes, cigars, match boxes, lighters

    sharp objects such as scissors, pen knives or nail files

    weapons or explosive materials of any kind

    If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.

    They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

    Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).

    That's it for the USEM interview. You can now breathe a little easier.

    Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.

    It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

    Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas).

    The following forms may come in handy:

    Sworn statement that advice of parents or guardian has been asked. (for those who are 21-24 years old)

    Consent to marriage of a person under age. (for those who are 18-20 years old)

    Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

    The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.

    It's all on the Consular's discretion whether they require consent from a parent or guardian.

  15. Wally, I have two questions but I don't know if its "silly" to ask or not since I am new to all of this still. First off, you mentioned my I-129F being forwarded to the USEM in Vietnam. The part here that confuses me, does USCIS forward the package I sent them or do I need to send the folder I have made up (extra copy) to my fiancee??

    No NVC forwards the package. USCIS forwards the approved package to NVC. NVC now reviews and issues the case number. NVC will send via mail the case number to you the petitioner. At that point you can give that case number to your fiance. Yes you will need to send the extra copies to your fiance for her I-129F petition (beneficiary). She or you will need to pay the fee for the petition. Read over the package information for Vietnam.

    I am planning on bringing the one I currently have to my fiancee's interview whenever that may be.

    You can do that depending on if you plan on waiting to set the appointment while you are there. Only thing is depending on when you submit the (Beneficiaries Package) you will need to wait for instructions from the consulate. I am not sure on how long that will take in Vietnam. My advise is get everything set-up now so she will have all complete when you arrive in Vietnam. You do not want to be there in Vietnam and there is a missing document.

    My other question is: I know each embassy do things differently and was wondering if Vietnam will allow the beneficiary to take their medical before I get my NVC case number? Sorry if I don't truly understand everything know but it's a learning process :blink:

    Sorry to hear that you got grouchy doctor!! :( Like we all said they will talk down on you and make it seem as if they don't believe your story. I was praying and hoping you got somebody understanding. This is the doctors job to scrutinize and evaluate.

    I think personally if any person that has annulments (plural), scars etc... They will either order a pysh exam. Also in the the Philippines culture (Catholic) they are super strict on annulment of marriage. They don't believe in divorce etc... So being you have two that gave them all ammunition to orders the full psyh exams. As for the grumpy grouchy doctor raising his voice at you. Sorry you had to go through that. I wish sometimes people could pull the skeleton out these guys closets :angry::devil: and see what they are hiding in their lives :devil::angry:. Anyway straying from the subject....

    Best thing now is to accept and do the next exam (PEPS) next week. They will have you do a series of test. You will be ok from this. Like Tahoma said " she has not seen any story were anybody has fail the medical and been denied. Unless your a certified Wacko and I know your not that at all.

    For now just relax and focus on what you need to do and continue to pray to God. You will pass this process for the medical. :D :D
