Best is to keep in contact with him and reassure him everyday that you will be with him. There is no faster way to speed up the process at this point. Unless he was active duty and being deployed or severe medical issues. That is the only way to expedite a visa.

We understand you frustration and anxiety but all you can do is wait. You congressman can get involved but you most likely will still have to wait. As you have not exceed the normal wait time for you NOA2 approval. You VJ timeline gives you a estimated time for approval between February and April.

I sympathize with you and your husband. As I have a brother that has PTSD from the Iraq War. As for hear anything, there is nothing that you can do at this point but wait until you get the letter or update from USCIS.

On the NBI clearance form she does not need to fill out the field husband surname for married women. As she is annulled from her previous marriage.
What is she using as her current last name on any ID's passport, postal ID etc..?

From your timeline you received your NOA2. Your approved package should already been sent to NVC. We went through the same long wait for our petition in the summer. We were approved July 7 2011 and did not receive our MNL number until August 25th 2011. Finally I had to call USCIS and NVC raising a stink finally it worked it way through the mistakes on USCIS part. Also the time of year plays a factor in the speed it is processed. July - August is vacation time and December and January is vacation time.
Average wait time for package to be sent to USCIS to NVC is 5 -14 business days
. It could take up to 30 - 60 days
. If it takes this long, you need to speak with tier 2 supervisor with NVC and USCIS.

From what I have read on some of the AOS applications that filed late. There is no penalty. Your wife and kids just can not leave the USA or cross any US borders. If you go past the 90 days. You begin overstay time until you file AOS papers.

I-134 Affidavit of Support form. Ensure it is signed, with all required supporting evidence.
He will need to provide the last three years tax returns with the filling documents (W-2 and 1040 forms filled)
He can request a tax transcript if he does not have the 1040 forms.

He will need to mail you the original sign letter of intent to you.
Also Letter from Employer sign date. If he has a HR Dept they can provide this letter on a company letter head. (Years employed, salary, in good standing with company etc). he will also mail this to you. Must be signed and dated from HR or Manager (Boss) and he should also sign and date.
Proof of relationship. This proof is from receipt of NOA1 until Current. You can provide, Phone records, cards (If not date don't worry), travel documents, passport stamps, flight itineraries, flight ticket stubs, hotel receipts, photos, engagement ring receipt (not a big deal if you do not have engagement ring yet).
Make sure photos are print at a Kodak, or Photo printing store. **Do not print on home print**
what is the bar code? i also asked wally if do i need to fill out first then print or print out and fill out with a pen? i read other members in vj they are also confuse.
The BARCODE will appear when you print the form. Nothing you need to fill out on BARCODE.
Fill out online then print. It makes it easier for them to process in plain text versus someones hand writing. Not saying you have bad penmanship but makes
it easier on the Embassy when processing.

K-3 Spouse Visa
The K-3 and K-4 Visas allow the Spouse and Spouse’s children (unmarried children under 21) enter the United States to await the approval of the I-130 petition by USCIS or the availability of an immigrant visa.

The reason people may not be keen on being a co-sponsor is the Legally bind contract:
This form is a contract between a sponsor and the U.S. Government. Completing and signing this form makes you the sponsor. You must show on this form that you have enough income and/or assets to maintain the intending immigrant(s) and the rest of your household at 125 percent of the Federal Poverty Guidelines. If the immigrant sponsored in this affidavit does receive one of the designated Federal, State or local means-tested public benefits, the agency providing the benefit may request that you repay the cost of those benefits. That agency can sue you if the cost of the benefits provided is not repaid.
Example of Means tested public benefits
Means tested public benefits" are welfare payments paid to people because they have no money of their own.
So if the person uses the fire department that's a public benefit - but it's not a means tested one, so you wouldn't have to pay them. If the person ever gets food stamps, however, or gets free medical care from a county hospital, you will have to.
How Long Does My Obligation as a Sponsor Continue?
Your obligation to support the immigrant(s) you are sponsoring in this affidavit of support will continue until the sponsored immigrant becomes a U.S. citizen, or can be credited with 40 qualifying quarters of work in the United States.
Although 40 qualifying quarters of work (credits) generally equate to ten years of work, in certain cases the work of a spouse or parent adds qualifying quarters. The Social Security Administration can provide information on how to count qualifying quarters (credits) of work.
The obligation also ends if you or the sponsored immigrant dies or if the sponsored immigrant ceases to be a lawful
permanent resident and departs the United States. Divorce does not end the sponsorship obligation.

St. Luke's will reschedule your appointment with USEM. I am not sure how they re-schedule USEM appointments...??? I believe USEM is aware of the expire date. Hopefully they will fit you in before it expire. They can extend your NOA2 expire date but I am not 100% sure on that. Maybe Tahoma or another high level VJ'er can shed more knowledge on the expire date of NOA2...??

i have a question with my form 156? i have 2 annuled marriage and how can i write them on the form which theres only one box availabale? do i need to fill up then print? or can i print the form out then fill it up?
Either or, you can fill out online then print or print and fill out will a pen. Fill it out online save paper and if you make a mistake. You can correct before printing.
On section 4. Martial Status. You would place your last spouse annulment and answer the remaining questions. Me being the make sure absolutely positive guy. I would call USEM and ask if you need to put both annulments on section 4. Again if any other VJ'ers can shine some light on this question. That would be awesome.
by the way,my fiance bought a house here in the philippines its under my name but i use his last name.do i need to show the title to the embassy just to prove that he's paying the monthly payment monthy? i dont know what else proof i need to show them.thanks wally:)
USEM is not concerned with properties in there. They will be concerned with the Affidavit of Support. They want to make sure he earns enough in USA to support you and himself. The property is your under Philippines Law. No foreigner can own land in the Philippines. He can own the house but not the land. No sure if that can be added as an asset on the form. If he earn above the USA poverty line. Then no need to include the property in the philippines.
Proof of relationship consist of:
Proof of your ongoing relationship. This needs to be taken to the interview! Include photos, travel documents, emails, etc from between the time you filed and present (NOA1 date-now).
Examples: Copies of phone bills, cell phone bills, emails (you can edit personal info with a marker), letters (edit personal info also), stamps on the letters (to document the date they were sent), and other written documentary proof. Provide a reasonable amount; two to four of each type. Pick a range of dates up to and including the present. You can also include a copy of engagement ring receipt (this is something that is a big optional - do not worry if you do not have a ring yet!)

My fiancee and I are in discussions about time required for all of her items needed in Philippines as she would like to keep working. How this came about her former boss is courting her to join her in Cebu back in my fiancees' field of Education. I am advising against this due to her being in a contract etc if she goes. Her current employer she can leave when she is ready. My questions are for those that have been going through this:
1) SHe lives in Bohol. Will she have to go to Cebu for her passport?

I know once she gets to having to go to Medical she will need to quit her job due to it being close to her interview (God Willing) as well. Our thoughts in reading all of the timelines and delays that we both want her to work as long as she can so her mind is occupied and not staring at computer and waiting... Yes I know how employers are in the Philippines with giving days off for these types of circumstances. She will need to travel to manila for her medical and it could be a 2 - 3 day process for the medical. If there is no issues!!!

I just read your reply,thank you so much
I had my psych.evaluation exam last week(PEPS),the phychiatrist lady is very nice,i started the evaluation 10am and finished at almost 7pm,i got headache answering those hundreds of questions,drawing,puzzles,etc. but what made me very emotional was the part of questioning me about my annulment cases,i did explained to her that i never had a psychological test during my annulment,and my atty,did all the work to get my case done.she understood but still i was very emotional when she asked questions about my fiance,i cried after i told her that my fiance is doing everything just to be with him,that we have beed together since 2003 and still proving to them our gunuine relationship.and i can prove to them that i am not psychological incapacitated.after the interview,the lady said o call her on wednesday to know when she forward the result in st.lukes.right now,im still nervous and worried thinking about the result,and worried of my interview.i dont know whats going to happen.i pray everyday to give me hope.thank you guys for helping me....i had my urine,xray and blood test last jan9.and no idea if i pass the test,they never told me.im worried:(

I believe you will pass your medical. St. Luke's did there job by raising the red flag when the saw two annulments and the manner in which the annulments were filed. You have passed through the gauntlet of exams and proven your of sound mind and happy in your relationship. As proof of relationship, 9 years is a long enough time for proof of relationship

It's ok you were emotional in your feelings to the examiner. As long as you explained everything.
The examiner will not give you your results after the examination. They need to process and review. Then forward to St. luke's if all is passed.
Once you go to St. Luke's, I believe last thing you will need is vaccinations shots if needed.
God is good. We are praying with you. So you join the rest of the VJ'ers on the Journey to there loved ones.
In the meantime start double and triple checking your I-129f package and make sure all documents, forms and ID's are together in order.

On the interview date she will have a time most likely 6;00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.
Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.
You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:
battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted

If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.
They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.
Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).
That's it for the USEM interview. You can now breathe a little easier.
Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.
It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas).

She will need to register for her seminar.
CFO is to inform fipinos about the country they are traveling to. The Good, Bad and Ugly. They will ask her some questions and issue her CFO sticker and seminar certificate.

Original and photocopy of visa;
Original and photocopy of Immigrant Data Summary for US bound/ Confirmation of Permanent Residence for Canada bound/ Certification of Eligibility (for Japan-bound);
Original CFO guidance and counseling certificate;
Duly completed emigrant registration form; and
Payment of the authorized registration fee.

If you fiancee is under 25 yrs. She will need a written consent letter from her parents or a parent will need to be there with her to give consent of there child's marriage.

Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.
It's all on the Consular's discretion whether they require consent from a parent or guardian.
