SingkeDad2usc What you are doing in this thread is called gaslighting. Feel free to read up on it.
OP, Darnell has given you great advice, & you've shown strength by the steps you're taking. Keep going. You'll do great.

Hi sandra or anybody who can help.l applied my vawa in october 2011,my lawyer told me not to apply for my AOS,l,m really desperate now bcos l didnt get a decision yet even after sending my rfe back beginning of may.its almost two months now since rfe...my question iscan l still apply for my aos now without using my lawyer bcos he,s sill going to charge me again.l paid almost $6000 for my vawa now am broke as hell.l have a 3yr old n very desperate.l just need a work permit so l can get a better job and a drivers license..i,m so tired of taking buses especially with a child.
Missymd if your ex is a US citizen you can apply for your AOS right now. You don't need a lawyer, especially one who charged you so much for VAWA (which is free!). Fill out forms I-485 (form for AOS), I-765 (form for work permit), and 2, I-912's(form requesting fee waiver). One I-912 goes with AOS, and the other goes with the work permit application. You can also write a letter requesting a fee waiver for both applications, instead of filing the form I-912. (This is what my lawyer did in my case. - USCIS guidance here) Sandranj has previously advised that you write the letter and state your income, expenses, and other payment responsibilities, and ask for the fee waiver. Remember to include your A#, and a copy of your approved I-360 petition. This pdf has the poverty guidelines per household size.
Oh missyd I feel your pain my lawyer charged me 4500.00 for me an 2250.00 for my son who is my beneficiary so I understand how hard it is I still ended up paying 5300.00 an that was just for the work permit......I still have to pay 4875.00 when mt AOS comes around!!!
Faithkeeper please read my suggestion to Missymd above. You don't need a lawyer who's charging so much when there's help available.

The USCIS site says that VSC is currently taking 13.1 months to adjudicate I-360's for VAWA. Several of our members here have gotten their approvals within 11 - 12 months of filing. I'll estimate approval in about 60 days from when they receive your response. Sandranj has previously said 45 - 60 days. Did your lawyer submit forms I-765 and I-485 along with your VAWA application?

If it is delivered to her residence because he forgot to change his address or whatever, and he is no longer living there, she can return it to sender with the notation "no longer at this address". She can also put the envelope (without opening it) in another envelope along with a copy of her withdrawal and a letter if she likes stating she is withdrawing her I-864 due to fraud and that he no longer resides at this address.
There is nothing illegal about that. She cannot check his mail box. It is only if it is delivered to HER residence/mail facility then she has the right to return it, she does not need to give it to him (it is improperly address mail) but she cannot destroy it or throw it out. Redirecting it or returning it to sender is perfectly legal
Agreed
Forward it to his address in his home country?
Seems feasible. However she may be caught on a technicality.

Tampering with, or "intercepting" US mail is a criminal offense.

Unfortunately, your friend is slowly getting into the vicious circle of abuse - going from one to the other. In addition to the advice others have given i.e. to not re-marry until her AOS is approved, I'll suggest that she leave both her attorney and her relative. As a victim of domestic violence she can stay in a shelter until she gets situated. She also needs counseling in order to heal, learn how to restore her boundaries, and recognize the signs of covert aggression. If you want to help her you can help her by finding her another job, and another place to stay. Her being entangled with this snake of a lawyer and another relative who is using and abusing her is the fire to the frying pan she was in with her husband. This type needs a clean cut.

VSC can request all types of evidence. It depends on what the petitioner did not include. It can range from documents establishing identity e.g. birth certificate, to documents showing good moral character. Several members have had RFE's for good moral character, others for abuse, and others for good fa*ih marriage. It really all depends on what the petitioner included in their application.

Congratulations!!!! You guys are almost there!
Panama-Guy, you're next!

Correction: He is not seeking a visa, but filing to remove conditions, otherwise called ROC on this site.
OP like others have said, file for divorce now. You can gather proof to show that your marriage was entered into in good faith - e.g. joint medical and car insurance, joint bills, a joint lease or mortgage, joint loans, etc. You should also get a letter from your bank to show that you and your wife had a joint account, but it was closed due to check fraud on her part. Any other records of you bailing her out could also be used. You will sumbit those documents with the I-751.
So, file for divorce now, then file form to remove conditions based on the divorce immediately you get your divorce decree, or when your 90-day window opens (whichever one is sooner).

Panama-Guy do take heart. It is usually darkest before dawn. take a look at your little girls face and find the strength you have in you to fight. Dig deep man, and fight. Reach down into your roots and figh! You can! And you're almost there.

How did a topic on who's a Genuine American turn into a topic on Mexican food?
OK who's a Genuine Mexican? And are Texans and Californians really Mexicans because they once were part of that country?
It's the tacos... Once you mention tacos everything goes haywire.

Sandranj , Now will they transfer the case from vermont to my state , does that take a long time?
VSC will transfer the case to your local office. The amount of time it'll take for them to get you in for the interview will depend on how busy they are. You can usually gauge this from the size of your city and the predominant mix of people.

A copy of the I-94 may suffice. And a note in your cover letter that you submitted the original with your F-1 reinstatement application.
-
Yayyyyy. Divorce decree?? From this last marriage
Yes.

So I had my I-485 interview yesterday. I went with my binder full of information, but none of it was requested except my passport, birth certificate, Driver's License, EAD and divorce decree. The interview was generally pleasant - short and sweet. And the officer said I should receive my card in 2 - 4 weeks.
-
hi believe where is your local office and how long did you wit for interview date and how soon is your interview as my I-360 has been transferred from December 26/ 2012 and until now still no interview date
I sent you a PM.

finally262012 take copy of your tax return, but if you have your tax return transcript is even better.
Thanks Sandranj.
-
Believe you will be fine, just take with you the original documents such as passport, birth certificate and translation, divorce decree if you have one,if you have your 2012 tax return take with you as well, police certificate, restraining orders etc...
Time is a great healer. Do not allow the wounds of your soul and spirit remain, just dust off old dreams and explore new ones. You are in charge of your life now! Good luck
Thanks sandranj. I will take those. For my tax return, can it be the one I filed, or does it have to be the IRS transcript?

Hi guys. Hope everyone is doing all right. And if you aren't right now, take 5 minutes to cry, then wipe your tears and smile. I hope you can find a reason to at least smile.
It's close to the end of the road for me I guess; my AOS interview is next week (I'll be updating after the interview), and I'm a little apprehensive, pensive, and really in my thoughts. I've put my evidence together, along with everything the interview notice asked for, but I just can't help feeling a little gritty. Maybe it's the thoughts of the life I wanted to have with my ex, and how life just turned around and bashed me in the head... Ahhh... Anyway... I just thought I'd reach out. In spite of things turning out as far as possible from what I could have imagined marriage- and family-wise, there's still good right now, and much more in my future.
If anyone has any advice for the interview I would appreciate it. Meanwhile, let me find where I posted my timeline and re-post it in case someone finds it helpful.
Edit:
Do I need to go in with passport photographs? I'm not sure why but the thought has popped into my head more than once while getting my stuff together.

Ahem... Yes... Write, and write often.

Vawa part 4
in Effects of Major Family Changes on Immigration Benefits

There is no fee for the I-360 if you're applying for relief under VAWA. The fee is for the I-485 as anajnic said. You can request a fee waiver for both the I-485 & I-765 by filling out an I-912 with a cover letter detailing your income & expenses. Sandranj posted samples in the VAWA Part III thread.
Hope this helps.
