  1. Hello Believe, by miracle my case was transfer today... You right looks like after i sent my I765 to renew they finally take same consideration...

    The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now being processed at a USCIS office. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

    Do you know how long takes now?

    That's great. Like Hypnos said it could take a few months (4 - 6 months) depending on how busy your local office is.

  2. Believe, would you mind if i ask how long did you wait since you got approval notice in mail to the AOS interview notice? I just got an email saying my VAWA is approved in email couple days ago and still waiting for the official approval in mail, how long did it take you to receive the actually approval in mail since you first notified by email/text?

    Apple2013 my I360 was approved in October last year, so it's been about 7 months. My lawyer got the notice in the mail about a week after that.

  3. Hello all, my I360 approved in 07/2012. Still waiting for interview... Anyone in the same situacion? Please let me know.

    Gizq I was in a similar situation, but I didn't wait as long as you. My case was transferred in November or so, and my lawyer only just got the notice for interview. I didn't get an email or text message like when my I-360 was approved. I also didn't get a notice for biometrics so I was a bit confused. However I read on the USCIS website that there's a new policy where people with interviews get their fingerprints taken at the interview location also. So I guess I'll wait and see.

    Since it's been so long it shold be about time to renew your EAD. Have you sent the form & attachments to VSC for renewal? That might be one way to get them back on your case.

  4. Thank you for posting N400-2011. It's very encouraging to hear from those who that undertaken this journey before us. I'm glad you posted the link to your post on changing your ssn. My ex has all that information so i will have to do that ASAP! One question though: How did changing your ssn affect your drivers license, taxes, bank accounts, etc? Was it a hassle to change all that?

  5. Panama-Guy so sorry for all you've experienced. it's sad that you are being held like a pawn under someone's thumb like this. You're really undergoing a lot of stress and I hope you can keep it together and keep going to counselling to maintain your sanity, and for your daughter's sake too. She may be young, but children are very observant and absorptive. You don't want her to grow up thinking that the way your wife treats you is the way to show someone love.

    SingleDad2USC financial abuse can happen in different ways. It's all about control. Even though she's not making the money she's controlling how and how much is used by using their baby and his immigration status to demand money.

  6. My Case was Approved today April 10th!!!!!!!!!!!!!!!!!!!!!!!!!! I am still in shock, I just wanted to let you know guys and thank you for ever to SANDRAJ!!! for your advices and support! you are an awesome person and deserve the heaven for helping tons of ppl in this forum!!!!!!!!! im SO HAPPY. Praise the lord!

    p.s I applied on Nov 4th 2011 and I did not have any RFE

  7. Hi believe so you never got prima facie only your EAD?

    Yep! I didn't get prima facie, but I was issued an EAD in the timeline that prima facie's are normally isssued. I did a FOIA request for my USCIS file (I wouldn't advise this as it takes a very long time), and the notation was that I had prima facie determination, and was to be issued EAD.

    I'm still waiting for my interview date, since November nothing much has happened. I'll be getting ready for EAD renewal soon.

    Hypnos, glad to see you're done. It's sad that they dragged you through all that rigmarole.

    Macbook please keep the faith, and contact your other state reps like Hypnos said.

    To the question about EAD and prima facie: I got my EAD a fe weeks after applying, and I never got a letter for prima facie. I think the EAD was issued in lieu of prima facie, since I needed to work. I also didn't get a biometrics appointment. I'm waiting for that now for my AOS.

  9. I hae some additions to the advice you've been given.

    OP, what are you doing for YOU? Emotionally and otherwise. Are you in therapy, attending counselling, meditating, spending time in church or doing other religious activities? What books are you reading to help you process all that you've been through? I'm asking all this because even though the divorce is done the work of healing is a road you should be paving rught now. In order for you to take care of your daughter you need to be healthy all around. Your child will easily see any bitterness that comes through you no matter how well you try to hide it, and that may poison your relationship with her if you let it.

    Let me suggest the following books:

    - In Sheeps Clothing - Dr. George K. Simon (I learned about this book from reading some of rlogan's old posts and it's been incredibly helpful. There might be a link to a pdf of an older version around VJ somewhere. I also own the audio version and it is superb.)

    - Pulling your own strings - Dr. Wayne Dwyer

    - Boundaries - John Townsend (This is a Christian book, fyi)

    - Loyalty to your soul - Drs. Ronald & Mary Hulnick

  10. a lot of aspets in the domestic violence circle apply to me,i went to therapy, womens in disstres i was baker active etc, next month i have a hearing in court, he wants to dissolve the restrainer order, idk if he is doing that bc he wants to change n fix things or if is only to clean his record, its been more than a year that idk about him, i cant help but love him, we have the same religion n for us marriage is a serious thing, im tierd of all this.

    if my only intentions were to get legal thru marriage a usc i would have stay married for whatever time it takes to apply n then divorce him, that simple.

    Natalia please be careful. Stats say that it takes a woman 4 - 7 times to finally leave her abuser. But the violence always escalates. You may love him, but the fact is that love on it's own is not enough to sustain a marriage. Please take some time to think through what you want and need to do. When you're tired is not the best time to make a decision that will affect the rest of your life. If you guys have not been in contact for a year then the work of him going to therapy and repairing trust just has not been done. You don't want to find yourself in a repetitive cycle and get more helpless. And be careful that you're not listening to anyone who is telling you to go back and "endure." They won't be there if something horrible happens to you and you lose your life!

    You were strong enough to get out once. Maintain your boundaries and exercise the strength you've gained from this experience. I wish you well.

  11. Hi my dear friends here.

    I really need help. I came to States January 2011 with K-1 visa. We got married in April and I filed I-485 Package in June. Actually my husband has abused me since I come to States and I just put up with him because we have a very cute infant boy. Eventually I couldn't handle anymore and I went to Shelter with baby. But my shelter manager said my case is not strong to file VAWA case because I never phoned 911. I lost everything in my husband's house too. He destroyed my laptop. He filed child custody to against me but I got sole physical custody at the first time. And then he tried very hard to convince me to go home to be with him. At that time I still loved him and anyway we have a baby. I went home 4 days before 2nd custody court hearing. But he phoned 911 to kick me out the night before the court. He planned this. I was so upset and almost want to kill myself that night. I am homeless before the court hearing and he prepared lots of fake evidence. So I lost baby's custody because I am homeless and no status in States. I was so upset and plus I was very sick. I drove back to Canada to see my doctor and other reasons.

    Right now I checked that my green card was denied this month. And I am ready to go back to States to fight my baby's custody. I am thinking, May I file Vawa too? Please tell me any possibility. My friends. thanks..

    If I recall you can also file VAWA from outside of the country, as far as the reasons you left are related to the abuse. Have you been seeing a therapist or psychologist? Your husband will probably try to prove you are mentally unstable and if you've been seeing a therapist it will help your custody case. You'll also need to establish a domicile to prove that you can take care of the baby, so returning to the US might be your best bet.

    Be strong. You have quite the road ahead of you.

    This message going to be very short today. I hope you all had a good christmas. My was not so good.

    I had a major problem with my husband and I don't know what to do at this point.

    As I posted before I ask my attorney to apply for my work permit renew, but he want to charge me for that and I dont have money to pay him. So he told me to do it my self. I did and sent out the forms to renew it, and I thought that they would send the receipt and the new work permit to the attorney on file not to my house, so the worse happen , and they send me the receipt to my home address , and unfortunatelly my husband is the one who checks the mail box because he wont give me the key for it. So on this past saturday the receipt come in and he was the one who got it, he opened it and found out that i had applied for work permit, so he put me against the wall to tell him how come i apply to renew something that I dont have and what I m hinding from him. I m so scared that I dont know what to do. I fear for my life now and my 2 years old baby. I dont know what to do now. I Am afraid of run away but at the same time I m afraid to stay here and he do something now that he knows that I have a pending case with USCIS. I m thinking about calling VAWA unit and ask them what should I do now. But they wont speak with me i think because i have an attorney on file. What should I do. Please reply to me ASAP if someone have a advice to give me. Specially SandraNJ that have experience. Thanks

    You're in a very unsafe situation dear, and you need to leave as soon as you can. Like Domi-nique said, go to the police station & make a report of his behavior. Now that he's seen the notice he'll be on the alert that you want to leave and it can get very dangerous for you. Please take all the things you need & care about in case you're unable to go back. He may destroy your belongings to try to get back at you.

  14. He just turned three. He started using Word at two. This is the program called paint.

    At one month old we started the walking exercises we learned about in the peer reviewed science literature, and it was the key to his early mental development.

    He can read, which is why we started him on the Word program. But it's all at his own pace. He really likes Paint.

    So we will start him on Excel when we're into the math.

    I doubt there will be any more news for us all since the holiday is going on. They are on break...

    I was so hoping to be done soon but I guess another holiday and new year in the state.

    You're welcome. I feel you, but the Vermont Service Center folks need to rest too. :) Who knows, the New Year may come in with your approval. Then you'll be happy when you look back over 2013. So keep up your hope, and enjoy your holidays.

    I think it just depends on the adjudicator. Maybe some are slower than others. And if they receive Congressional requests then those move up to the front of the line and others have to wait longer.

  17. I did that's why I puzzle for what else they would ask for since I already sent my police record.

    Are you a volunteer at any organization? In addition to police record, community involvement and consistency of task shows good moral character. If you've recently graduated, or are still in school, that would help also.

    In your affidavits also, the people who wrote affidavits for you should have written something in there about the length of time they've known you, and attest to your character.

    So, to summarize, in addition to resending your police reports, the following should aid in establishing good moral character:

    • A letter from your church/religious organization/subgroup of your church stating how long you've been a member and how you've contributed positively,
    • A letter from your job stating how long you've worked there (note that you have to have been legally authorized to work for this to be relevant to your case), and how your boss knows you to be a person of good moral character
    • A letter from any organization you volunteer for stating how long you've volunteered there, and what you do that positively impacts the community,
    • A letter from your school stating that you've been a good student for however long you've been there,
    • Affidavits from responsible members of society who know you and can attest to your good moral character.

    That's all I can think of right now. If anyone has something to add, feel free.

  18. My heart goes out to all the kids and adults and their families in connection to the mass shooting in CT.

    May the Almighty give them all strengh to cope with this horrendous evil act.

    This is so sad to say the least....I am speechless.

    God, please, have Mercy on all of us.

    It's terrible. Little kids who had nothing at all to do with him. Just how on earth could he have... In fact there are no words. It's just horrible. I pray the families are able to deal with this. Lord please comfort & shield them.

  19. So, lately not a lot of good news has been coming my way, so I thought Id share the little that has.

    I had a job offer yesterday, for a position that starts January 15th, which is fantastic.

    I also had a second interview for another job that I really want, so hopefully that will go well too, and I have my fingers crossed that they get back to me too.

    And finally, I had a lawyer reach out to me, to offer his services for my case, and allow me to start paying him back in arrears once I start work next month. (I met with him yesterday, and although I don't think he specialises in VAWA cases, and some of the info he gave me kinda contradicted a lot of what Ive been told. I know having him on boarrd should provide some amount of help!).

    So now, just trying to get my package ready as soon as possible to send off, hopefully before my interview next week!

    Congratulations on the job offer. I hope the second one works out for you as well.

    If the info the lawyer is giving you contradicts with what you've been told here and your research, do NOT give him your business. There's another forum member who had to do almost everything herself because her lawyer knows little about VAWA, and is keeping her stuff hostage because of money. You don't want to be in that position. Have you tried Catholic Charities?

    Truth is, you can represent yourself. There are some older members who did that, and had their cases approved. Sandranj has been extremely helpful in answering questions, and the rest of us can provide our experiences, links, news, etc that you can use to file yourself.

    You should go for the interview with your I-360 filled out, and the attachments you have. You can write a letter stating that you are a victim of domestic violence and attach your police report. In the letter request a stay of adjudication on your I-485 and allow USCIS, not the Immigration Court to adjudicate your cases. This will give you time to file the I-360 and a new I-485. Then when you receive your notice of action on the I-360 (or prima facie, or both), you can take it back to your local USCIS office and give the IO a copy.

    Sandranj what do you think? Should he request that they hold on to his old I-485 until the I-360 is adjudicated, or should he file a new one?

    That's weird. You should have received an answer to your request for prima facie extension. I think you should write a letter to Vermont asking about the status of your case, and re-requesting extension of prima facie. Another forum member, inpeace, did that when he got out of processing time and he got his approval.

    I'm waiting for my AOS interview. My I-360 was approved in October.
