    If your fiance is from Australia then he can come under the VWP to the US to marry you. Filing for the K-1 is a waste of time and money if your fiance is not going to be migrating to the US right away. You can file for an IR-1 when the time comes.

    It' absolutely not against the law to use the VWP to get married. The problem lies with using the VWP to enter the US with the intention of getting married and then staying and applying to adjust status. Since he won't be doing that, then you are fine.
    He will need to bring evidence that he is returning to Australia (return ticket, proof of studies, lease, whatever else he has) in case he gets questioned when he enters the US. But as long a he answers any questions honestly he should be fine. I had a NZ friend who did the same. No problem whatsoever, and no law broken. He should not volunteer information at the POE unless he is asked directly.
    I agree that an employer-sponsored visa in Australia may be easier/cheaper than a partner visa. However I would check on whether this give you eligibility to Medicare, or government-sponsored university places (if you want to study), etc. I don't know much about visas to Australia, but the government website is very helpful.

    Of course you can look for work while waiting for your EAD. You just can't start until you have your EAD. Of course you should tell your prospective employer the situation (waiting for EAD, can't start till EAD is in hand). Also people waiting for an EAD after entering on a K-1 then getting married and adjusting status are not in an "illegal status".

    If using the passport to show citizenship in place of a birth certificate or naturalization certificate, you have to send a copy of ALL pages of the USC's passport, not just the bio page. It says that very clearly in the I-129f instructions. Your lawyer is wrong.

    I'd petition for my wife instead, to move to OZ. Plenty of work, no crime, beautiful country, the GFC never really hit, very inclusive, etc....Closest to paradise. I would try 'down under'.
    Consider it a blessing in disguise if it happened.

    Tell him to grow up. Moving to a new country means making some changes. Ask him how he would feel if you went to Morocco and complained about the food and demanded nothing but American food. My approach would be if he refuses to eat the food that you make, just let him go hungry, he's not going to starve.

    I don't think it matters whether you used a platinum envelope or not for your packet 3. I used a platinum envelope to send my packet 3 and it was signed for by "Smith" at the consulate, no problems. When I went to the interview I took a non-platinum express envelope with me for the return of my passport etc, I saved myself a few bucks that way. The instructions say to bring a "express/platinum envelope", and I interpreted that to be express OR platinum express. Since I would be the one receiving it I didn't care whether it was signature on delivery or not, as long as it has a tracking number that I could use to see when it was sent by the consulate. I received my passport back 2 days after the interview so it was not a problem.
    As for waiting time, I think it took about a week between sending packet 3 and receiving packet 4 (the interview letter) via email. So hang in there, it shouldn't be much longer.
    As Barbara said, "no" is the right box to tick, since even though K-1 is technically a non-immigrant visa, it is a pathway to immigration, and so it is treated as an immigrant visa (that is why you have to go through the Sydney consulate).

    I had dozens of trips to list for my K-1 application. I wrote "See attachment X" and I attached a sheet listing the trips (as best as I could figure out using the stamps in my passport). I signed and dated the attachment. It was not an issue for me.

    She doesn't need a K-1 if she is not intending to migrate to the US. As long as she has plenty of proof that she will be returning to Switzerland after the wedding, she should be OK, but she should be up-front about the plans at the POE. I would definitely cancel the 1-129f BEFORE obtaining the tourist visa. Otherwise it might look suspicious. Hopefully there are others out there who have done the same thing and can offer advice.

    Hey there Kady, try calling the Victoria Police service centre in Melbourne again. The first time I called I spoke to someone who seemed unsure about what they were talking about, she told me the next appointment was at least a month away. So I did what you did and tried calling around different police stations (even Geelong), they all told me that I had to go through the service centre. I called the service centre and was told by someone else that they had three appointments available the very next day. I went in the next day and got it done in 5 minutes. They even take credit card so you don't have to get the money order. Take the form from the website with you, you need copies of photo ID, and you need to get them certified. I got them certified at a pharmacy. If you don't have time, just take the originals with you and they can certify them at the customer service centre. I had the certificate back in 6 business days!
