    Joe, with all due respect, I hope you've not sent any money to her. This has SCAM written all over it! Anything and everything can be duplicated in the Philippines. It sounds like you've not submitted the petition yet. If this is the case, good for you! Anytime a relationship begins with the petitioner or USC being asked for money is a huge indication that it is a SCAMMER! Don't get me wrong, there are plenty of Filipinas out there who are genuine and have good intentions, but, please cut off all communications from this one!
    If you've met this gal in one of those online dating websites, you have the capability of reporting her as a scammer.

    Why don't you pull your 1-864 - your affidavit of support? That IS what you can do. If she just got approved earlier this year for a spousal visa to come to the US, then she only has CONDITIONAL residency. Send a letter in writing to USCIS, to your local and regional immigration office and to ICE with a copy of your immigration notices and a copy of your initial affidavit of support that you filed, indicating that you are getting divorced and no longer wish to support the person. She can file her paperwork, but without your support affidavit, they won't approve her. Unless, of course, she cries foul and tries to claim abuse or something.
    If she already had her 10-year residency, then there would be nothing you could do but divorce, but she is still a conditional resident. You can still request your support be pulled.

    If she left the USA without first applying for her green card, and she did not apply for an AP, then she cannot re-enter the United States.
    If she received her two-year conditional residency permit, and she left the country for more than the time allowed, then her residency rights are removed.
    The way I see it, you are the injured spouse, and if I were you, I would not hesitate in starting divorce proceedings, making sure that the reason for divorce are clearly outlined in your divorce papers. Since she is no longer in the US, then you can say she abandoned the marriage.

    To clarify - it is not the getting married in the US that is the problem. It is the 'staying' in the US after marriage and applying to adjust status. A person is allowed to adjust status while in the US on another visa type IF (a BIG IF) they had no intentions of getting married and staying in the US when they arrived. Normally this includes employees working on a work visa, students attending school on a student visa, or a tourist who has a whirlwind romance (or overstays their visa) and gets married while here. Entering the US with a visa meant for one purpose - a tourist - but with the deliberate intent of using it as a means by bypass the more appropriate formal immigration process for an immigrant visa - is committing Visa Fraud. Depending on what the intending immigrant told the border when he/she entered, visa fraud could be compounded by 'misrepresentation' - lying to the border about your intent upon entry. This can result is a permanent, life-time ban from ever being allowed to enter, let alone live in the US.
    So, yes - if she is ever able to get a visitor's visa, you can get married or you can file for the K-1 visa, but she would have to return to her home country to complete the processing of tthe appropriate spousal or fiancee visa.
    It may be a moot point, however. It is extremely difficult for young, single women from the Philippines to get a tourist visa to the US. In order to get a tourist visa the tourist needs to be able to prove they have strong financial and employment ties that necessitate their return to their home country after a specified period of time.
    You may wish to 'meet' in a third country you both can get to if you are not able to get to the Philippines, and then file for the fiancee visa afterwards.

    I think the best answer to this would be on your specific consulate's website, b/c some consulates do put it down on their websites that sending money counts as continuation of relationship & the beneficiary should bring the receipt(s) if any...

    There is nothing to worry about. Since the Naturalization Certificate is what is being used as proof of citizenship, it is okay to send a photocopy. It does not make sense to send an original of such an important piece of paper.

    And, I posted what I posted because that consensus is simply WRONG. Photos together are not required to get an I-129F petition approved. They are not even mentioned in the I-129F instructions, ANYWHERE and I've seen petitions approved without photos together. At least a passport photo of the petitioner IS required, however. Sure, it's better to include a passport photo of the beneficiary as well as photos together but only if requested in an RFE are photos together "required" for petition approval. From the Philippines, we see such RFE's, well, NEVER, in my experience.

    I married her for her broken English. It's just adorable. And how she irons my shirts, and how she always has a hot cooked meal for me, even when I come home drunk at 2am. And that she's like a little sports car, revving and ready for me to take her for a ride, even if she's been slaving over the hot stove all day. All the hype about these Filipinas is TRUE! She even thinks my rolls of fat and baldness make me look guapo. It was money well spent!
