  1. READ : my point is get all the docs ready to send to NVC the moment that you can

he's turning USC in June/July/August, even if he gets the police report TODAY, it's still valid.

I only mentioned police report, birth certificate and tax transcript and follow the instructions.

i didn't mention affidavit of support and all the other stuff you listed.

Why would it take more than a year for him if he's turning USC in June to Sept time frame?

Even if it does, I would rather like to send the docs required by NVC the moment that I can instead of risking any delay because you I don't have the docs ready to go because I worried it'll get staled.

and so what if it does get stale because of any unexpected processing delay, get it again.

  2. What is meant about the "Meanwhile" And gathering the above documents, this has to do with after NVC assigns a visa number and proceeds with the case, these things (police Cert, Affidavit of support) will be stale if you try getting now.

Isn't police certificate from China valid for 1 year?

Can the tax transcript be stale?

my point is get all the docs ready to send to NVC the moment that you can.

  3. Hi Chen,

    happy CNY.

for your case, i'd get to know all the steps you need to do to become a USC.

As soon as you get the naturalization certificate call NVC to upgrade your LPR i-130 petition from F2A to

IR (immediate relative). the continue with the NVC steps and the interview steps to get the visa.

meanwhile you should get all the paper work for the NVC steps, such as

    1. police certificate + english translation

    2. birth certificate + english translation

    3. tax transcript

    ... more..

you can find out more here http://www.visajourney.com/wiki/index.php/EZGuideSpouse

I have seen USC gone through the NVC steps and consulate (Guangzhou) steps in 2 months.

so figure 3-4 months after you get your naturalization certificate, your wife should be here.

    GOOD LUCK!

  4. thanks everyone for their reply.

Side questions regarding the police certificate and electronic processing OPTIN code

my spouse has been living in China only.

Would I need to get a police certificate from every city she stayed more

than six months OR just one police certificate from the city where she's living would do?

Is the 3 digit code for Guangzhou processing embassy/consulate GZO or GUZ?

    NVC electronic processing

  5. For China the preferred translations that the consulate in Guangzhou prefers is the Notary Translations you get at the notary office that issues Non-marriage cert, police cert, birth-cert etc... The translation will be bound to the document.

If the doc is in Chinese, do I still need to translate it for Guangzhou US consulate?

What do you mean by "Notary Translations"?

Do you mean the notary office(公證處) in China can provide an English translated of Police Certificate and Birth Certificate?

I don't understand why we have to submit a translated doc for Guangzhou US consulate,

they must have people that read CHINESE. and for the kind of money they're charging,

they should accept Chinese doc without English translation.

  6. You can assume that but it isn't a realistic assumption. The time line you provided would be reasonable for a USC that doesn't have to wait for an available visa number. Your actually time line will be extended by whatever the wait for a visa number time is from the day you are approved to the day a number is availble. The rest of the process is the same as for a USC.

    yes i know it's unrealistic.

but who would have known PD jumped so fast in 2010.

let's hope that it moves FORWARD again in the coming months back to 01AUG2010 and beyond :)

  7. If I assume PD is current when my i-130 is approved in 07/2011 and remain current until

interview is scheduled (see assumption in original post)

can my original timeline be remotely possible?

Your time line is not realistic for a spouse of a green card holder

    1. 01/2011 i-130 submitted

    2. 06/2011 i-130 approved (est. 5 months)

    3. 07/2011 NVC received case and wait for a visa number to be available for F2A

    4. 07/2014 assign Case #

    5. 09/2014 Case completed

    6. 10/2014 Schedule interview

    7. 11/2014 Visa received

    8. 12/2014 Arrive in USA

The above if more realistic Note the wait between steps 3 and 4

  8. We are answering the question, NO timeline is NOT possible

which step am i being too optimistic ?

Petition will be approved and have a priority date at the time of approval

Isn't it true that i130 will be approved independent of PD being current?

If PD isn't current at the time of approval, the case will just sit at NVC?

NVC is handling petitions that were approved 2 and 5 years ago and have priority dates at that time, (2008 and 2005 for Mexico)

where may i find this information?

  9. Hi all,

I recently submitted the i130 in Jan,2011 and got the receipt in a week.

Would like to know what's the best case scenario for my spouse to come here.

    This is what I'm hoping:

    1. 01/2011 i-130 submitted

    2. 06/2011 i-130 approved (est. 5 months)

    3. 07/2011 NVC received case and assign Case #

    4. 09/2011 Case completed

    5. 10/2011 Schedule interview

    6. 11/2011 Visa received

    7. 12/2011 Arrive in USA

Assumption : PD is current during step 2 to step 5. (I know it's unlikely...but we can hope)

    Some more questions :

    1) If PD is still not current when my i130 is approved, will my case still get transferred to NVC

and wait for PD to be current? i.e. idling at step 3?

    2) Must the PD be current through step 3 to step 5?

i.e. If PD is somehow retrogress again after NVC complete the case,

I'd still have to wait for PD to be current?

    3) Why does i130 approval take 1-2 years for some people? Did it take that long before?

Let's hope March Visa Bulletin brings some good news!
