US Immigration from Vietnam

Hi everyone,

My wife just had her interview last tue 1/12 and did not past the test. Her appplication was BEFORE the dec deadline and she had the 2008 ver of the test. We were to told to wait for the next interview date within 90 days. We are wondering if the next interview will be base on the 2008 ver or the new one. Also, will the answers to the questions change...such as who is the current president, congressman

hello, we received our interview date this morning by email, my wife is sleeping and i want to reschedule the visa appointment. is it ok if i register an account at HCM consulate or does she need to register?

our date is only 2 weeks out and I want to be at the interview, with quarantine, i would need to leave a few days ago. would like to wait until after new year because of airfare also

I understand that you are supposed to filed 90 days prior to the green card expiring. I looked up processing time and it looks to be at least 12 months. During that period, the green card will be expired, do they send out a new one or can that one still be used.

Hi, my wife wants to petition for her mom to come over. She got her citizenship 6 months ago I assume that is ok? My understanding is that I need to file i-130 form. In the past when I petitioned for her to come over based on marriage I was using a lawyer. We are trying to cut cost and doing it ourself this time as our lawyered quoted us $1700 . I hope it is not too bad... I would appreciate any advice you guys can provide. I heard the estimated wait time is 1 year. I've been reading a bit. Something confusing me is the new rule on Public Charge. Her mom has a low income where she's coming from. Would that be a problem? This is for Vietnam if it helps. Thanks again.

We got our NOV2 a few days ago and starting to work on our papers and evidence right now but we ran into a few confusing advice from our agency:

Little bit about background:

- We started dating 4 years ago and were colleagues back then

- My fiancee moved from US to VN to work since 2017 so we've been living together since (same company, different location)

- We filed K1 visa as we weren't really thinking too far (we get engaged so filed for k1 - didn't really think about the benefits of CR1)

- Hiccups: I tried to apply for tourist visa 3 times but rejected before we filed for k1

Questions:

- Our agency advised us to find some evidence that my fiancee will go back to US once we get our k1 approved. I actually have no idea what it should be because the only reason we file for k1 so that when he go back to US, we will get married and be together there. Can you recommend some evidence that we can gather before the interview?

- Said we need to wait for the case number then file DS160 and schedule interviews, no need to wait for PK3. Is this true? (is pk3 similar within same Embassy or different for each individual?)

- Job in US: Fiancee is working for the VN location so contract is for VN office. Once we move to US, he can continue working in the company but will have to redo his contract. Does he need a US job (contract from US company) or is it ok for interview until we decide to move back (within 6 months of the final approval/visa date)?
