Hi lovely people! I had my AOS interview today. I completed biometrics but never received the EAD/AP, so seemed to skip that step in the process (I'm grateful for it!) and I suppose they will never show as approved or rejected? I was just wondering how to reflect this in my timeline so that I don't skew the numbers. I want to reflect it in the best way, as I know so many people (including myself!) check timelines and approval estimates.

Good day Vjs. I received RFE for form I944. last month.
My initial application was sent in September 2020 to adjust status from K1.
I submitted my parkage at the time the i944 was being litigated, so we sent i864 in leu of I 944 as instructed at the time.

My question, should I wait if president Biden new executive order will do away with i944, or I should go ahead and sent the RFE (i944)?

Any response will be appreciated. Thanks in anticipation.

My wife had been verbally and physically abusing me for the last few months and I finally couldn't take it anymore and therefore have decided to divorce her. While I haven't filed divorce yet, I would like to know how this new turn affects my case.

I had filed for AOS from H1B back in Sept 2019. We have been married for less than 2 years and have a 6 month old child.

We went through counseling for a few months last year and things got better a little bit but afterwards they took for a worse turn when she started first verbally and then physically assaulting me. This continued for a while before I finally pulled out my phone one day and captured what she does to me in front of the baby. The verbal abuse still didn't stop - sometimes in front of the baby too.

I spoke to a family lawyer and I was told to file for divorce because honestly this is too much for my mental health.

But the problem now is twofold: On one hand is my AOS, and on the other my child. I don't want to abandon the first because that would mean I could face deportation.

What is the way to convince the USCIS officers during the interview that I had been a victim of abuse (I have an adult witness) for long and that denying my case would mean me being away from the infant child?

I am a UK citizen currently in the US visiting on a B2 Visa. I entered August 18th 2020 and my I94 expires Feb 17th 2021. I married my wife, who is a US citizen, in November and we mailed a I-485 with concurrent I-130 application for family based Adjustment of Status to Chicago lockbox and tracking confirmed receipt January 14th.

If my I94 expires before we receive an NOA1, is that a legal issue and considered as overstay? If so, is there any way to resolve this such as filing for extension of stay on B2 until an NOA1 is received?
