Our K1 Visa recently became ready for interview at the UK Embassy - we're so excited!! We're hopeful we'll be able to start our lives together by the summer :)

Anyone else at this stage in their visa journey and feeling the excitement butterflies? Anyone nervous? Just wanted to give a place for people to share that unique feeling amongst friends :3

AOS Filing while pending SSC Issuance

My husband applied for his SSN last week. I can see in the SAVE system where the check was ran by USCIS and returned back to the SSA. I changed my legal name on the same day and also have not received my updated card, and I know things are a bit slower right now,

We hope to file our AOS ASAP and were wondering how to go about doing that when the I-485 asks if the individual has ever been issued an SSN. He hasn't technically been issued one, so would the answer be no? I don't want to cause any issues moving forward but we would like to get everything filed. We do have plenty of time remaining on his I-94 status if needed, as we married a few days after he got here.

Wasn't sure if anyone had any recent experience or insight on this :)

I recently had my Immigrant interview where all went well until the end where I was given a green piece of paper with many options for the CO to mark against. Mine was marked Joint Sponsor

All was well with the i-864 income levels exceeding the poverty level, based on passive income that will continue in the U.S., (No RFE from the NVC). My spouse s job is in the U.K, so will naturally end once we move.

I guess our issue is that although we have cash assets , that on their own without any other income would easily exceed the poverty levels, the option to use these has been made unavailable to us. Our only option (that is ticked off) is for a joint sponsor. Getting a joint sponsor is negligible to none at best, so effectively, as we can t use assets, I can t get a visa.

Is there any recourse with CO s, such as they really should look at assets, or can they simply say get a joint sponsor regardless of cash assets'?

You d think that sponsorship would first look to the resources from within the household and then look to a 3rd party if those resources were insufficient.

Any thoughts would be welcomed thank you.

Hi so my husband and myself are finally at the interview stage after 3 long years of waiting and also having to file the i824 as our lawyer made a mistake on our paperwork! Anyway brings me to my question, I requested a FOIA with uscis for my entire A file as I wanted to see what they had. I was reading through the original i130 sent to USCIS back in 2022 and they had ticked NO to has the beneficiary ever been in the United States . This is completely incorrect and my husband gave them all the information! Now I m extremely worried that this is going to cause an issue at my interview. At NvC I obviously filled out the ds260 myself and entered all the times I had traveled to the states. Is this mistake on the i130 going to cause issues or shall I just bring it up when I first sit down for my interview ? I m so worried now

K-1 immigrant (married within 90 days) filing AOS after I-94 expired. Need clarification on how to answer certain questions on I-485.

Background: I'm a US citizen. My wife immigrated to the US via K-1 visa in August 2024 and we got married within the required 90 days. My wife had a medical emergency that resulted in surgery and a lengthy recovery time, so we did not file adjustment of status before her I-94 expired in October 2024. I understand that as my spouse, she is considered an Immediate Relative so overstaying her I-94 will not be held against her when filing AOS. Still, I want to make sure we accurately fill out Form I-485. These are the questions I need clarification on:


Part 1, Question 14: What is your current immigration status (if it has changed since your last arrival)?

We answered: "K-1 Visa Holder/Expired I-94".
Is this acceptable? I've searched this forum and have also seen suggestions of "No Status" or "Out of Status" or "Expired K-1". We feel like "K-1 Visa Holder/Expired I-94" does a better job of telling the whole story, for what that's worth. I saw a comment (I think on Reddit) where someone claimed they left this part blank and still got their green card, but that seems ill-advised to me.


Part 9, Question 13: Have you EVER violated the terms or conditions of your nonimmigrant status?

We answered: "Yes".
Is this correct? I assume she violated the terms of her I-94 by remaining in the US after the expiration date. Other threads on this forum and Reddit mostly agreed, though I saw some people claim they answered "No" and still got their green card.


Part 9, Question 76: Since April 1, 1997, have you been unlawfully present in the United States? You were unlawfully present in the United States if you were present in the United States after the expiration of the period of stay authorized by the Department of Homeland Security (DHS) Secretary or were present in the United States without being admitted or paroled.

We answered: "Yes".
Is this correct? This is the one we're the most stuck on, because it appears to be a newly-worded question in the latest edition of Form I-485. I assume this is basically the same as Question 13 above; she has overstayed her I-94 and is therefore now unlawfully present in the US. It's scary to answer "Yes" to a question that's essentially asking if my wife is breaking the law, but we will provide an explanation in Part 14. I've seen comments that claim an explanation isn't necessary since the penalty is waived for Immediate Relatives, but we still want to give one.

I apologize for being the thousandth person to post a thread along these lines. I've scoured this forum and Reddit and other sites but haven't found definitive enough answers to feel comfortable filling out I-485. Thank you for taking the time to read this.
