Can I do aos from student visa

Hi all,

I have some questions and would really like some input.

My situation is that I am currently in the us under a student visa (scheduled to grad may 2023) I have a pending f4 Petition pd 30th march 2007 row. I would like to know

1) can I file for aos and what forms do I file?

2) if I do file and the interview is not scheduled before I graduate what happens??

Ps. It will be at Minneapolis/stpaul

I am at a loss as to why I got an RFE pertaining to our I-864 submission. My sponsor Total income per year is 140,000 and number of persons in the household is 5. Therefore the income for sure meets the 125% of federal poverty guideline. However, I received the following:

On August 8, 2022, you submitted your Form I-485. We are writing to inform you that we need more information from you to make a decision on your case. Please read this letter carefully and follow all of the instructions below.

What You Need To Do

Youmustprovidethefollowinginformationinorderforustomakeafinaldecisiononyourcase. Pleaseincludea copy of ALL pages of this letter with your response.

Based on the documents submitted, we could not determine that the petitioning sponsor on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor s household size. See Form I-864P for information on the Federal Poverty Guidelines.

If the petitioning sponsor's income does not meet 125 percent of the federal poverty guideline for their household size, you must obtain a qualifying joint sponsor who demonstrates the ability to support you or submit evidence of assets. See Form I-864 Instructions for more information. If you decide to obtain a different joint sponsor, you will need to:

Submit a completed and signed Form I-864, Affidavit of Support, from the joint sponsor. All pages must be present and of the latest edition date.
Provide the joint sponsor's Social Security Number on Form I-864.
Provide a complete and correctly calculated household size on Form I-864.

Submit a complete copy of the joint sponsor's Federal income tax return and all supporting tax

documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year.
Submit evidence of the joint sponsor's status as a United States citizen, United States National, or Lawful Permanent Resident.

The "Total Income" line on IRS Form 1040 is used to determine qualifying income for a sponsor, not the "Gross Receipts" line from IRS Schedule C or C-EZ.

If the petitioning sponsor or the joint sponsor is unable to meet the income requirements, they may qualify based on the cash value of their significant assets. Assets must equal the stated difference between the sponsor s income and 125 percent of the federal poverty guideline for the sponsor s household size.

Assets must equal the difference for applicants filing as orphans.
Assets must equal three times the difference for a spouse or child of a United States citizen. Assets must equal five times the difference for all others.

Acceptable evidence of assets:

Bank statements covering the last 12 months (statements will be averaged over a 12 month period) or a statement from an officer of the bank or other financial institution in which the sponsor has deposits, the account balance averaged over a 12 month period, and current balance;
Evidence of ownership, value, and dates acquired of stocks, bonds, and certificates of deposit;

Evidence of ownership, value/equity, and dates acquired of other personal property;
Evidence of ownership, a recent licensed appraisal or county tax assessment, any mortgage/lien or lien release of any real estate, and dates acquired.

PLEASE HELP BECAUSE WE ARE LOST. We filed all the W2, 1040, IRS Tax Statements, Job Letter, Bank account statements, etc. So what did we do wrong?

Hi all, a quick question. Is it legal to volunteer at an institution while awaiting the working permit? Is any document needed from USCIS in order to give to the institution for them to see that it is permissible if it actually is? Thanks all.

My beneficiary would be entering the US on June 27, 2022. We intend to apply for the Marriage License within a week and then get married. The reason for this post is for advice on how we could move to Green Card, EAD, and SSN as fast as possible. How should we go about it? Step by step.

F3 Interview Experience at Port of Spain Trinidad

Hi, just wanted to share our process and interview experience at the Port of Spain, Trinidad post. We applied under the F3 immigrant visa category.

PD: May 14th, 2007

NVC Case Creation: May 6th, 2019

DS-260 Submission: September 15th, 2019

DQ: July 1st, 2020

Interview Letter: November 23rd, 2021

Medical: November 29th, 2021

Interview: December 6th, 2021

AP: April 11th, 2022

Issued: April 22nd, 2022

Passports received: May 3rd, 2022

We only got 2 weeks notice for the interview, but we managed to get our medical and new police certificates in time. The phone line at the doctor s office (Renand Limited) was very busy so we had to call a lot before we got through. They ll email you some instructions and forms that you have to fill out and email back. Everything (including the chest X-ray) was done on site.

For the police certificates, usually the processing time is 2-4 weeks but we were able to get it expedited and ready by the next day. Just carry a copy of your interview letter and tell them it s urgent.


On the day of the interview, they seated us in the waiting room and gave us a folder to arrange our documents in. Then we waited an hour or so before they called us to the first window. At this window, the lady took our documents and asked us a few questions like who is the petitioner, how long have we been married, have either of us ever been divorced, etc. She asked us for more recent (2020) tax documents from our sponsors and for new, unexpired police certificates. We weren t instructed to bring more recent documents in the interview letter or anything, but based on other VJ users experiences, we carried more recent documents just in case. So thankfully, we weren t missing any documents. Then we had to go back to the waiting room and wait another hour before they called us to the second window.

The second window was where the real interview began with the CO. We swore an oath to be truthful and then had our fingerprints taken. We also had to take off our masks so she could verify our identities. She asked us questions about our employment, where we planned to stay in the US, etc. She also asked what our children are studying in school. Although we had all the required documents with us, apparently we were also supposed to upload the more recent tax documents and police certificates to the CEAC. Since they weren t on the CEAC, we were issued a 221(g). She gave us a blue sheet of paper with instructions on how to mail these documents (along with our passports and Return TTPost TrackPaks) to the Embassy via TTPost.

In January, we received Post Feedback on the CEAC with concerns about our sponsors ability to meet the minimum income requirement. Thankfully, their 2021 income was much higher so we uploaded their 2021 tax documents.

In February, I noticed that our case hadn t been updated in weeks and they had stopped replying to my emails. Eventually, they reached out and explained they were experiencing staffing shortages and a backlog in processing pending IV cases.

So we had no case updates for most of February and the entirety of March.

Then on April 11th, our case status changed from Ready to Administrative Processing. On April 22nd, status changed to Issued. Waited for our passports to be delivered and tried to track it with TTPost but TTPost didn t have any info. Emailed the Embassy on April 28th asking for an update, and they confirmed the visas were printed. Our DHL tracking numbers were generated the same day and emailed to us. Received another email the next day stating that the passports were ready for pickup.

At DHL, the guards will give you a numbered slip to write your name and tracking number. Then expect to wait outside for at least an hour. When it s your turn and they let you into the building, you ll be asked to present your ID, open the package, and confirm the passport belongs to you.
