US Immigration from Serbia

Hey everyone,

I cannot see a more recent thread that discusses IR1 visa experiences and travel through Schengen. Our trip will originate in Serbia, Belgrade and while there was a possibility to take direct flight to NYC - we could not find free seats until October that did not cost arm and a leg.

So we (myself on IR1 visa and my husband USC) will be travelling straight to Virginia - IAD with a layover in Germany. All my research says that as US Citizen + spouse and with a copy of marriage cert, we should have no problem making our connection. Am I missing something?

So I have been in the Balkan region for about a year, traveling with my Serbian fianc e. We started the K-1 Visa process last February, and according to our estimates we should be able to move to the US around March, if all goes well. We have been doing extensive research on what might be expected from Packet 3, after we receive our NOA2, and we see that I must be able to prove my domicile in the United States is permanent, and I have always had the intention to return.

I'm currently unemployed, but we have been doing odd volunteer jobs throughout Serbia, Bulgaria, and Albania. Our current plan is to keep doing that until we get our Visa approved, and we can't really give confident statements on when exactly we'll be able to return, obviously, or even reliably search for jobs in the US when we're 9 hours ahead and can't say when I would be able to reenter the country.

Is this considered just one big trip? My fianc e has not filed for residency in any other countries, so we are hoping we don't need to bother with any extra police checks from the places we have spent approx. 6 months spread out over a year. I also don't have any formal visas in my passport for these countries, only stamps, which I plan to include. Other than that, we are planning to submit the following for proof of domicile:

- Mailing address (NOA1 was sent to my parent's address in Seattle, where I am registered permanently)

- Bank statement

- Copy of active driver's license

- Tax returns from last 3 years

Does anybody have any suggestions, or have they been in a similar situation to us? Will this be enough to satisfy the requirements? Separation is not an option due to COVID, we don't want to be apart again.

Hi, everyone! Does anyone know what to expect in the packet 3 that the embassy sends? It's impossible to find it anywhere for Serbia, and there are some confusing requirements for other countries. If anyone has received it recently, could you please share the content? Thanks!

Hi, I have a few questions if anyone can help me out. My mom overstayed her B2 entry last year due to covid and we applied for I539, we never heard from them up until the other day that they denied her extension due to her leaving country before any decision is made, although we gave the proof that we booked her flights many times and they were all canceled. We called USCIS and they really didn't make any sense, basically never gave us any real answer.

Now we are planning on contacting the US embassy where she lives.

My question is, is she going to have issues getting new B2 visa in the future? Thats our plan to do since anyways her passport is expiring soon, we have a letter of denial since that's the only document seen on USCIS account.

My fianc and I are currently early in the K-1 Visa process, but are starting to plan out where we are going to live, in context of the Adjustment of Status process. We have heard that the 5 USCIS processing centers (California, Vermont, Texas, Potomac, and Nebraska) are geographically dependent on where you are applying from, but can get transferred for no reason. This worries us, because some centers, like California and Vermont, are extremely backlogged and can take up to three years to deliver green cards, whereas Nebraska has a processing time of up to seven months. Has anybody else had these concerns, or managed to apply to the processing center of their choice by moving to the Mid-West?

We are interested in a number of different states, such as New Mexico, Arizona, Colorado, and Michigan, and we wondered if anyone on the site has moved to these states; if so, which USCIS Center processed your case?
