I was working in the US on an H-1B, with a company who had filed an I-140 for me. The company was acquired in 2017 and my role was restructured out. My H-1B expiry date was in August 2017 so I elected to return to New Zealand with my NZ fianc (now wife). Fast-forward to now, we want to return to the US to be near family. I ve filed an I-130 and tracked down the immigration attorney that filed the I-140 to check the status in case it came up, assuming it was abandoned when the company was acquired/I was made redundant. Surprisingly, their reply was that the I-140 was filed by the acquiring company, and was approved in Feb 2018 (6 months after redundancy and leaving the US) but that I never filed the I-485 (makes sense). I didn t get any notification about the approval, I assume it was sent to my old work email (that s on me). I have two questions: 1. Is that I-140 approval likely to have any impact on my current I-130 application. 2. Is there any chance that I-140 approval might still be able to be used if I file the I-485 for it? I m guessing the answer is an obvious no after 5 years in New Zealand, but can t hurt to ask. I m not employed by that company any more, but saw various things about if the I-140 hadn t been withdrawn by the company after 180 days there were some special cases. Thanks for any help!

I am an independent full time student, and I work 30-35 hours a week currently. I will have to cut down my work hours to accommodate clinicals soon, but I have to keep health insurance throughout my program. The cut off for benefits at my employer is 29 hours or less a week. I looked on my states marketplace/affordable health insurance website, and with my income I qualify for a subsidy to reduce my monthly payments. I am eligible under the 5 year rule to file for Naturalization next June, and I am anxious that if I get a health insurance plan that is subsidized (not Medicare/Medicaid), then I will no longer be eligible to naturalize. I haven't been able to find a definitive answer online, or on the USCIS website. Any assistance is appreciated. Thanks!

Hey all! My husband has been in the States since mid June & just feeling blindsided about a biometrics appointment request he received. He has been anxiously awaiting his green card in the mail (he received a notification 15 days ago that it was being produced) and he was surprised by how long it was taking he just logged back in to find that he had a notice of request for a biometric appointment that they scheduled him in for Sept 7th. I m just confused if this is normal , I thought I was well versed in this process and we had already ticked every box and finished everything they already approved his visa. They did a criminal background check back in New Zealand and took his fingerprints at the consulate when he was interviewed just wanting to know if this is a normal step for everyone as I was not expecting him to have to do another appointment or finger print scan in the U.S. ?

Hi there, I posted here a couple of days ago about still waiting for NVC to review a document I submitted on 18th May, which based on the current timeframes on the NVC website should be well and truly finished by now. The advice I was given was that this isn't normal and that I should get in contact with the NVC to find out what's happening. With the phone service currently offline (an unbelievable pain), I sent a message through the Ask NVC webform where I explained the situation, requested that my case the escalated to a supervisor to investigate, and prepared to wait a month to hear anything back. This morning, 2 days later, I shockingly got a response, however I have no idea what it means and I was hoping someone here would be able to help me decipher it: Quote The correspondence submitted is currently under review. An appropriate action will be taken once this review is completed. I'm trying to figure out if this means that my Ask NVC 'correspondence' has been received and action will be taken, the document that I sent on 18th May is now actively being reviewed and I just have to wait, or if this is just a generic response that my case is flagged for review without looking any deeper into why the review hasn't been done yet. I'm afraid that it's the latter and that my case is flagged as 'under review', but has been forgotten about or lost somewhere in the system. Should I send another message and hope that this time the agent on the other end understands that my case appears to have fallen through the cracks? Thanks very much for your help!

Hi there, I was asked to submit an additional document for my case as the NVC back in May. I submitted this document on May 18th. I ve been following the case processing times fairly closely and at long last the three-ish months have passed. The NVC page says that as of today, 8th August they re processing documents from the 28th May. Based on that timeline I would expect that my additional document would already have been reviewed, but I haven t heard anything and when I login to the portal I can see my document with the status submitted . Is this any cause for concern? After the last rejection my wife and I are starting to get a little antsy. Thanks for your help!
