Hello Friends.

After submitting my I-864, the CEAC website says civil documents were "ACCEPTED", and I received an email saying our application has been sent to the consulate. Unfortunately, I also received a cryptic message titled "Case FE Review Note". The gist of the note is:

  • The income reported ... is insufficient to overcome the public charge grounds of inadmissibility for visa issuance.
  • You must provide updated or additional evidence for the applicant to present at the time of their interview such as:
    • Other income
    • Assets
    • Proof of current employment
  • You can continue to upload documents to CEAC up until the date of your visa interview.

I am retired. My yearly income is generated from interest on my investments. I provided three years of tax transcripts that indicate my yearly income from interest and dividends well exceeds the requirements (https://www.uscis.gov/i-864p).

I assume my income from investments as shown on the income tax transcripts is not sufficient. What should I provide? Should I update my I-864 with all my asset information and upload it again along with documentation to prove my assets? Or do I just leave the I-864 as it is and send the asset documents with my spouse (applicant) to the interview?

Hi Guys,

I've tried searching for this specific request on the the RFE but could not find anything on it. I've submitted the initial package myself with guidance from other threads here on VJ. The RFE is requesting I submit "Form I-129F, Petition for Alien Fiance(e)" and would like to know if anyone else has seen this request before? I know we only get one shot and before I seek an opinion from an attorney, I'd like to see if our community has any insight on this. If it's simple enough, I'd like to avoid hiring an attorney since it seems like I only need to submit one piece of evidence. My assumption is that I might've filled out the initial form incorrectly hence why they are asking for it again. I should probably add that prior to receiving the RFE on Feb 6th, I received a case status update on Jan 2nd, stating that "Name was updated". I am glad to elaborate more on the situation or share my initial I-129F form if it helps determine what to submit. Thank you all in advance for your insight!

Juvenile charge - effect on ROC?

My stepdaughter (15) had a huge error in judgement and was caught with a vape at school last week. She was not arrested, but she was charged by a local PD officer at the school with possession of paraphernalia (class c misdemeanor), and even though the vape was not empty, they did not charge her with what they could have (felony possession of a controlled substance), so in that, she got extremely lucky. We will eventually get the court summons (they said March or April), and we will be seeking either immediate or deferred dismissal, after which we'll fight for expunction.

We will be submitting our paperwork for removal of conditions for my husband's, hers, and two other stepdaughters' green cards in June. Because they are his dependent children who all entered the U.S. within 90 days of their dad, my understanding is that we will only need to submit one application and list the three children on there with their A numbers. Question 20 in Part 1 of I-751 seems to only reference the applicant.

So, my questions:

  1. Because she is a minor, do we need to include this information on the application? If so, where? (possibly under "Additional Information?")
  2. If there is not an appropriate place to include it on the application, should we still include the documents in the package?
  3. What are the chances of this affecting her permanent resident status? Could they deny the I-751 only for her based on this? (particularly thinking about the current administration)

This is a huge life lesson in actions/consequences for her, and I am not trying to skirt around anything for her. I just want to be sure that it would be required to disclose a minor's criminal history, and if so, where it makes sense to include.

Restricted tourist visa - ONE entry to ONE state

My Mexican girlfriend applied for a B2 visa in 2024 and finally had her interview last week. She said the CO was extremely hostile and had just denied the person in front of her. At the end of of a long, brutal interview, he told her she was only approved for a 1 year visa.

Well she just picked up her visa yesterday and it's restricted to ONE entry to travel to ONE state only. The state is just one she mentioned she'd like to visit, but there were at least 3 other states she listed to the CO.

So we are a bit devastated right now, as she had planned to visit me and also travel to a bunch of other US states this summer (Hawaii, California, etc). Is there a procedure for redress? Can she petition for an extension or some kind of early renewal? I think she just had bad luck with an angry CO.

Hi, I wanted to see if this was ok before applying.

When I first entered the country, it wasn't the state where my spouse lived. They were on a work trip, but we wanted to do entry to get the ball rolling.

I spent about 10 days with them in a residence hotel, then went back home for 2 months to wrap up some personal matters. I did bring belongings that would stay with my spouse as I did consider this starting to move to the US.

When I entered the second time it was to the state I would be residing in. I did take another trip home, but under 6 months, my main concern is, is it an issue that I wasn't in the state where our home is for the first few months.
