Parole in Place - PCS to Korea?

Hello, recently my husband and I applied for Military Parole in Place. It was accepted and I now have the I-94 in hand. Normally the next step in the process is to file I-130 and I-485. However, my husband just got orders to pcs to S. Korea. He is currently weighing out the options but it would be a very nice experience for the both of us, predominantly him. One of the biggest things on our mind is how we would continue the process if I were to or if I even can pcs with him. I know I need to have a SOFA stamp. I do have my Mexican Passport, currently waiting on my EAD and SSN. Though I have researched and it seems I would not be able to get the SOFA stamp. However I have also seen some articles say I can by visiting the Military Passport Agent and showing them my passport, I-94, and his orders with me on it.

For simplicity:

Q1: With my currently approved Parole in Place I-94 (expires March 2025), am I able to accompany him to S. Korea? Mexican national here btw. I ve also seen that it would be a good idea to do another I-131 Application but this time instead of doing it for Military Parole in Place, doing it for a regular Advanced Parole.

Q2: If it is possible for us to move together, would it be wise to begin the I-130 process in the states or once we are in S. Korea?

Q3: Really all we want to know is if I can move to Korea with him without tarnishing the immigration process prospects granted through Military Parole in Place.

Extra Considerable Info:

-I-94 accepted on March 14th 2024

Expires March 14th 2025 (for Mil PiP, you can reapply frequently to extend your stay)

-Yes, I will be on his official pcs documents and he is set as accompanied move.
-I am in the DEERS system already and hold my Military ID.
-EAD and SSN application filed online through MyUSCIS on March 23rd 2024

-Received and Biometrics reused on the same day.

-Husband only has 1 more year until he gets out, he has the opportunity to end his active duty in Korea

Anyone submitted a FOIA request for their spouse's consulate interview?

My husband's visa was denied this week bc of a possession of marijuana charge. We will request a waiver. After reading a number of AAO decisions for the same basis, it looks like USCIS obtains the notes from the consular officer when making a decision.

I want to see my husband's notes so that we know exactly what that officer wrote before we submit the request. I do not want to fight this blind.

Some AAO decisions have hinged on what the officer wrote during an interview versus what an applicant is submitting.

Has anyone successfully obtained the consulate officer notes from their/ their spouse's interview?

601 Waiver for Possession of Marijuana

Husband was denied visa. Given blue paper citing violation of law (possession of Marijuana) and 601 waiver.

I've been reading AAO decisions so that I can be familiar with the elements USCIS are looking for. I'm certain my husband falls within the criteria of being approved for a waiver:

-Marijuana only

- less than 30 grams

- single incident

- extreme hardship experienced by spouse (health issue)

The conviction happened in 2011. He did not serve any jail time. Instead they put him on probation for 2 years and 8 months and he had to fulfill court ordered requirements: monthly probation officer check-ins and therapy.

Those that had to submit a 601 waiver, anything I'm missing? anything I should be aware of?

What was the processing time period?

I-130 for parents general questions (before I get started)

Hello

I have read through the guides and posts, but still have many questions.

I am figuring this out to prepare to send the I-130 for my parents as soon as I get my naturalization

1. Am I understanding correctly that parents have to be filed separate and have individual process and timelines, correct?

2. My parents (both in heir higher 70's, still together) have both mexican and french citizenship. They live in Mexico. Does that change anything in the timelines? (Mexicans vs french)

3. I see timelines going from 7 months to 70 months. I this so unpredictable? I dont know how their health will be in 5 years!

4. During the times it takes to process, especially if it takes years) can they travel here and stay for longer periods? (like 6 months, on the maximum of a visa stay)

Wondering if the vaccine documents need to be translated.

Also when does the sponsor need to have the vaccines done by? Is it at the time of interview or entry?
