601A-Waiver Approved & 1-year ban

My husband is the beneficiary and I m the US citizen petitioner. We got approved for 601A-waiver which he needed to leave the US to do the visa Interview at the Embassy, This was March 2022. During the Interview the officer never asked or mentioned about the 601A-waiver. He still gave it to her but she gave it back to him, but I realized our lawyer did not or forgot to upload the waiver on the application. Now they refused him because of unlawfully presence in US for more than a year and a letter stating he failed the drug test and received a 1 -year ban with random drug testing but is eligible for visa after the 1 year ban.

It s confusing because 1 letter says his eligible after the 1-year ban if he passes the random drug testing. And the other letter saying cause he was unlawfully presence in the US, which I thought that was what the 601a waiver was for?


My lawyer is not really helpful at all but she is telling us that we need to apply for another waiver but the 601 instead. And idk how my husband failed the test when he stopped smoking a while before unless it still showed up in his system but he s about to start the random program. I m upset and confused and seeking other advices from a different attorney.
Please Has anybody had a same or know of situation similar to ours?

Received an RFE to upload joint sponsor s 2021 tax transcript but I already uploaded it, W2s, Tax returns and pay stubs and they were all accepted. So I m confused.
has this happened to anyone

I551 Stamp Travel in Removal Proceedings

I have a pending I751 since Nov 2019. Upon my return in the US on March 2021 after a trip abroad, I was questioned by CBP who searched through my electronic devices and concluded my marriage is not bona fide. I was issued a NTA with hearing date May 2024, they then sent me to ICE custody where I was bonded out after 15days.

I was able to get the I-551 stamps (CR6 Category) since my release from custody and my current stamp is valid until July 2023 in my passport to be renewed next year.

When I went to USCIS to get the latest stamp, I asked If I will be able to travel with it for a short trip abroad and they said yes because I am a LPR until Judge says otherwise, but also mentioned that just to be sure it will be best to go ask CBP in the next window next door in the same building. I went and asked a CBP officer and he said yes as long as I meet all the other residency requirements and no criminal record, which I don't, I should be fine upon my return. He then placed/stapled an additional I-94 Paroled Stamp card next to the original I551 Stamp for the same expiration date (July 2023) with "NTA" as the paroled purpose.

He said when I go through secondary at the boarder showing the stamps, I should be fine.

My Questions:

1) if I end up travelling and I am paroled during reentry, does it mean I lose my temporary LPR status if I am paroled in vs Admitted?

2) Would I still be able to get the I551 stamp next year while the removal case is still pending if USCIS sees I was paroled in?

Anybody with a similar experience (under Removal proceedings and was able to travel using their stamp for reentry) please share any insight you may have. Much appreciated.

60 Day Progress Letter

Hi everyone!

I know of a few people receiving 60-day progress letters from NVC and also read it here, but my husband (the beneficiary) has not received such an email. We used an attorney, but they have not received an email either.

Should I be concerned?

For reference, our DQ date is 11/2/21 and his visa class is now IR1.

This is really a long wait

Does anyone have any good news about getting interview dates?
