Hi All

I am in a stressful state and need to clarify some things regarding my case.

I am 2019 Vawa filer and I am in removal proceedings. My file has been transferred to status docket before an Immigration Judge in NY.

I could not file for i485 & the combo file I765 for EAD card since the case is with the court now and will have to wait till my i360 Vawa petition is approved.

My question is if my Vawa file gets approved anytime soon, will I be able to :-

1) Advance my next hear date which is in 2023 and will that have any negative impact on my file?

2) Will I be able to file i485 and i765 before next hearing date?

I will be so grateful if anyone can guide me regarding this matter as I am unable to work since I do not have EAD and really want to apply for it as soon as God Will the Vawa gets approved. But confused what if I cannot apply for it since im on removal proceeding and the hearing date is far away.

Hi Everyone,

I have a question regarding the re-entry permit for my sister.

She is in USA now and she is is planning to travel outside of USA as she has to finish her bachelors(which she enrolled before she became LPR).

She might need to stay outside of USA for a year and half. So we are planning to file Form - 131 for the re-entry permit.

I have a question on the Part 5 - Question 2.Please see the attached screenshot.

My sister has never filed for Federal income tax returns because she is a student(not considering herself as nonresident) and not earning any money.

So should i check Yes or No.

Hi all,

We would like to know what is the procedure to upgrade the form I-130 for Spouse after Naturalization and how much time does USCIS take to upgrade.

My wife submitted the I-130 application when she was a lawful permanent resident in March 2020 and she got the receipt stating that the process in review.
She became a US Citizen on Sept 2020 and then she called NCSC to upgrade the petition on the same week , but when she raised an enquiry on USCIS last week they informed that us that our petition still under lawful permanent resident category.

We would like to have some clarifications to the following questions.

1) What is the exact procedure to upgrade the status of petition ? should we send documents (Naturalization certificate copy ) to them by mail?
2) How much time does USCIS takes to upgrade the file?
3) Do We have to send i130 Upgrade request to NVC as well?
