US Immigration from India

Hi all,

I have another complex question for you...

If my (Indian) fianc and I decided to go the route of K1 visa, keep in mind he has a stable employment in India, would he be able to leave US after we marry under the K1 visa (so that he can return to work) and then we file for a CR1 after? I know that in order for him to file the adjustment of status he has to remain in the US but we are trying to figure out how to navigate this without him having to quit his job for the duration of time it takes for these processes to complete. The intent is that when he returns to the US, he will be transferring his job from the Chennai office to the US office (we work for a global company, and met/committed while he was still here in the US on F1).

Have any of you heard of anyone trying this before? Is this something that would raise red flags?

We know that it may take more time but at the this point, the only reason we are looking adopt this option is because of the time and difficulties it takes to get married under the Special Marriage Act in India and complications/inconsistencies therein. It would be difficult for me to reside in India for more than a month due to my own obligations here in the US. Granted, if I have to then we'll just have to work something out...but it is not ideal.

I got a mail on 19th Nov 2021 that NVC has the document they need and my case is qualified, Now NVC is scheduling my Interview.

can anyone who is recently got his or her interview date, i really want to know how much time nvc take time schedule interview.

I can't seem to find this information anywhere, so I decided to ask here.

Here's the situation:

I am a USC, engaged to an Indian citizen living currently in Chennai (we began dating when he was in the US on the last leg of his student visa, unsuccessfully being able to secure an H1B twice). We are looking to get married in India this year in the fall so that we can finally begin the process of starting the CR1 visa process ( thanks to covid, we couldn't do so any earlier). K1 is not an option because we would prefer that he continue to stay employed with our current employer so that he can just transfer to the States without losing seniority.

What we need to know is, if I am to get the tourist e Visa, would I be able to travel and legally marry him without issue? Will there need to be some special designation during my application process for the Tourist visa? Or is there something else that I need to consider in order to enter India with the intent to marry?

The sooner we can get this information the better will be able to start the actual marriage and ceremony planning.

I spoke to Rep today and they told me my case was transferred from NBC to my local office on 12/26 and they requested the office to schedule interview on 12/26. Does anyone know how long it takes for an interview to get scheduled based on this information they gave me?

I was hoping if anyone had an estimated time line on when i should expect an interview notice from Queens FO. I was told that my case was transferred to the local office from NBC and interview was requested on 12/26/21. Any one aware of the timeline from when the case gets sent to local Field Office and interview gets scheduled?
