Hi everybody. I have a joint sponsor (my brother) who is willing to help me out. He actually lives with me, my daughter, and my parents. On my tax returns, I do not count my brother or my parents as dependents. Me and my daughter are a household and my daughter is my only dependent. I file taxes as head of household. My brother's income alone will be enough to help me sponsor my husband. I'd rather put him as my joint sponsor. I believe putting my brother as a household member will complicate things with proof of relationship (birth certificates and all..etc. etc). BUT he has the same address as me. Will NVC see this as confusing and reject the I-864. Your advice is appreciated !!

I hope you are holding up well, In November 19, 2020, a D.C. federal judge ruled the suspension of the k1 visa processing unlawful (https://www.law360.com/articles/1330908): - While quoting "Romeo and Juliet," U.S. District Judge James E. Boasberg said the State Department was wrong to stop processing visa applications for the "star-crossed lovers" based on proclamations from President Donald Trump suspending entry into the country for immigrants and nonimmigrants from 31 countries under certain conditions during the coronavirus pandemic.
   - "A person who receives a visa can enter the United States without violating a proclamation namely, by first quarantining for 14 days in a non-proclamation country and thus can attempt entry without violating [the order]," the judge said. "Plaintiffs here may very well act in this fashion if and when they finally obtain their visas."
While it states clearly, that the department of state should not base itself on proclamations of Donald Trump and keep processing the k1 visas, the U.S. Embassy in Germany states on its website something opposite (https://de.usembassy.gov/visas/immigrant-visas/fiancee-visa/): - Please note that we are still prohibited from issuing K visas to persons physically present in Germany under Presidential Proclamation 9993, which has suspended routine travel from the Schengen Area to the United States due to COVID-19. Under recent guidance, however, the following K-1 visa applicants may qualify for a national interest exception (NIE)
Would you happen to know why the ruling is not enough to restart the processing of the K1 visa in the Germany? Thank you all, B & V Court Opinion K1.pdf

When will NVC start considering 2020 income for I-864 Affidavit of Support? Due to unfortunate circumstances, the joint sponsor who agreed to support my application fell through because he did not file 2018 taxes. His 2019 income will cover the I-864. It is out of my hands to make him file 2018 income taxes. I can get a co sponsor who has agreed, but he did not make enough in 2019 but will have made more than enough in 2020. When will I be able to put 2020 income in I-864. Again, thanks for helping me.

Hi guys! I hope everyone is staying safe and healthy during this hard time. My Fianc and I are together in the USA right now and as some of you guys might know the Schengen area is banned from traveling to the US so I had to stay in Turkey for 2 weeks before I came here to visit with my ESTA. Being together actually made us realize something: Can we not just get married now and get my AOS done so that I can finally stay here? If it wasn't for COVID I'd already be living here and I already had started school. Covid delayed SO SO MUCH.. it's crazy. I guess we're just a little desperate and trying to find a better/faster way..? Anyone have s clue if that could work? Thank you for your time.
