Submitting the I-130 Petition in Germany

Greetings,

I haven't started the immigration process yet, but trying to accumulate information from travel.state.org, US Consulate in Germany, and here at visajourney. My question is that the advice from the US Consulate in Germany is a bit different that on travel.state.org in terms of options to submit the I-130 petition. A brief background, is that I am currently married to a German citizen for over 2 years, so I will file the IR1 option.

The US Consulate states, that my only option is to submit the petition to the Dallas Lockbox via mail. https://de.usembassy.gov/visas/immigrant-visas/family-based-immigration/immigrant-visa-petitions/

The advice from travel.state.org states I can either submit the petition by mail or online. https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/filing-petitions-outside-the-us.html

The 3rd option described here at visajourney, is that I can file a DCF with the Consulate if I qualify. Now, I am not a U.S. Military service member or I don't believe I have an extreme case, so I don't want to begin the process incorrectly.

Is there anyone with recent experience that could share their insights? Maybe with experience as well with these options with the consulate in Frankfurt?

K1 medical examination questions germany.

Hello Everyone i am so relieved that i have found visajourney and wish i knew about it years ago already.

My fiance and I are Going through the K1 visa process since around march 2019

and we are currently at the 8th step according to (https://rapidvisa.com/k1-visa-process/)

"Step 8. Medical Exam The fiance must have a medical exam. The package sent to the fiance by the U.S. Embassy will explain how to schedule the medical exam. You must pay a fee for the medical exam. The fee is usually paid in the local currency and varies depending on the location. You (the U.S. citizen) do nothing at this step. This fee can t be paid from the United States."

But I had not scheduled an appointment because of personal reasons and The global pandemic starting in 2020.

My question is if I have to start From step1 again (USC IS Filing) since it's been almost 2 years when I have received the Letter to go get a medical examination.

OR if I still have the chance/possibility to schedule an appointment for a medical exam and continue with an interview after receiving the exam Letter.

I have not found any information if there is some sort of expiration date for the k1 process if it takes me too long to get all my documents together which are required for the interview,

all i found was that the medical exam expires 6 months AFTER taking it but not BEFORE.

OR is there maybe a way to "extend" the K1 visa so i dont have to start from step1 again ?

PLEASE free to ask me any further questions if something is not clear i am really hoping that somebody has an ansquer to my questions.

Dear all,

my husband and I would like to move back to the US with my children from a previous marriage. I wrote to the US consulate about which forms we would need to show. They mentioned a notarised agreement by the biological father or alternatively sole custody. I do not necessarily want to ask for sole custody as I think that would be unfair. However, what kind of form would I need to provide their biological dad to sign? Does anyone have a sample version for me?

I am kind of lost on this one.

Hey guys!

My fianc and I are in the middle of the K1 visa. It got approved and has been sitting in the NVC since March 2020 or so. I've been waiting for so long already and my life has basically been on hold. I wanna do an au pair year again and I was wondering if I can just cancel my K1 and then apply for J1? Do my au pair year and then get married and an AOS at the end of my au pair year?

The J1 I'm getting is not subject to the "2year waiting" rule.


What do you guys think? Would that be possible?

Divorce after moving to US without physical green card

Hi everyone,

Unfortunately I am in a very delicate and sad situation and would need your advice.

To my immigration status: I moved to US two months ago with a CR1 visa but entered after two years marriage (since I still had to work for 5 months in my country until I could end my work contract). I got a stamp saying LPR. My lawyer told me I should get a 10 yrs green card and I am still waiting on it in the mail.

To my marriage status: A month ago (after I quit my job and already moved here) I have found out about my husbands (US citizen) affairs. Two girls fell pregnant (whereas one was forced to abortion, the other one kept the baby but cut contact to him). I was and still am shocked and heartbroken.

Although the green card visa process was long and with covid even harder for a long distance marriage, I had hope for a reconnection and believed all his love promises and was looking forward to a future with him. I had lived with him before for 8 months. I had no clue about his lies and betrayal during the time apart. As soon as I have found out about his adultery, I distanced myself emotionally to sort my thoughts and feelings. My spouse became extremely frustrated, then controlling and threatening. I felt depressed and had to move out to a friend of mine a week ago for my own safety.

1) I want a divorce or legal separation asap. However, I am not sure if a divorce or separation would be an issue if I have not received my green card by mail? Would I need a waiver in any case? Am I already a LPR with the stamp in my passport and should not worry?

My gc should arrive in the next 20 days... I already changed my address online.

2) I talked to immigrant lawyers but they all said I should wait until I have the gc in hands and even to not divorce so soon because it would raise red flags... but honestly. I need closure on this part of my life and my husband would not wait that long anyway or use it as a tool to use against me all the time. Im not thinking of US citizenship whatsoever right now, so. I am not sure why the lawyers were all so careful and making me so scared?

Does a legal separation make a difference for immigration btw (instead of divorce)?

3) Also, I would want to include a statement why the marriage ended. Not sure if he would do it but I do not want to risk any immigration fraud questions since he already threatened me if I would ask for alimony in court, he would lie and say I paid him for the marriage (which is not at all true and luckily I recorded him). I do have messages, witnesses and recordings to prove one of his affairs. Im not asking for alimony, I just want my peace atm. Does such a statement helps for future matters?

If I will stay in the United States or move back home is something I will figure out in future. With Covid and having quit my job, chances are the same wherever. I have a lot of friends here in the US and since I previously overstayed my Esta by some days (yes stupid) I could not reenter so easily. At the moment, this is not one of my main concerns, but to get the divorce going without jeopardizing my status.
