Question on lawyer fees for RFEs

I casually help friends with immigration-related questions and my friend (green card holder) and her husband (applying for AoS on the basis of the spouse of an LPR). The application just got an RFE from USCIS saying that his wife doesn t make 125% of the poverty level and they need a co-sponsor. She is pulling out the documents they filed with and unless I misunderstood something she makes more than double that amount.

I have asked her to clarify what income/taxes she submitted with his application when they submitted it in late 2021 (so presumably her 2020 taxes), but regardless the lawyers they used are asking for a lot of money to draft a response and I can t find logic in needing to pay for this. Either she made enough money when they originally submitted and USCIS committed an error, at which point it should be so easy for the lawyer to resend the evidence they already have on file with a boilerplate letter, OR the lawyers themselves messed up if she didn t make enough money and they didn t tell them to get a co-sponsor before filing.

They want nearly a thousand dollars to begin drafting a response and I want just a bit of context so I can encourage this sweet couple to advocate for themselves in the most accurate and appropriate way possible since I think this RFE would or should fall under the umbrella of his AoS application and not incur a large cost.

My husband attended his interview in El Salvador last year but later we got an email stating that his I-601A was canceled but it was approved while he was in the states prior to going to the interview. He had a very small weed charge over 10 years ago that was vacated and sealed, but he did stay over 300 days in the USA illegally. The email stated that those two were one of the reasons they canceled his wavier. We ve now applied for I-601 wavier to see if they approve it. We have two kids together and my lawyer prepared the wavier for us. I showed all my hardship and how depressed I ve been since he s been gone. It s been almost 7 months since I ve sent the I-601 wavier out. Should I send additional information about how I m suffering here alone? It s been so hard without my husbands financial support now we have to support him. Has anyone came across a case similar to this? My husband did want me to mention that durning his physical they were so rough and mean to him that he told them the truth like he always does and maybe saying that he did try a certain drug along time ago when he was younger could ve affected his case?

N-400 now or in three weeks after moving?

I'm helping someone fill in her N-400. She will be moving in less than a month within the same city, so no change of USCIS area. Does a move like that impact processing times at all? If it is simpler I could suggest waiting.

Also, it's been a while since I've dealt with USCIS-related things. I know that the N-400 can now be filed fully online. Does that extend to the AR-11 change of address form too? Thanks!

  • Sister in law has been approved and recieved and email to schedule her interview for F2b immigrant visa. The attorney has been trying for the last 2 months but website says there are no interviews available. She emails the Embassy and they say the sooner she schedules an interview the quicker the process will be. In multiple emails they encourage her to schedule an interview appointment but there are no appointments available. Is this George Orwell double speak?

A little back story, I live in California and have been married since 2016, but I've only been a resident for 3 years. I have my N-400 interview tomorrow and I can't seem to find my husband's birth certificate for my interview. I have a copy but it isn't an official copy of his birth certificate. Would this be an issue during my interview?
