Hi all, I am trying to help my wife's brother in law. He would like to have the opportunity to come to the united states and work here. He only wants to come the right way legally. He is 35 years old, has an established restaurant in Colombia right now but has lots of construction skills as he has built many farm houses and planting as a farmer. His cousin's husband is the owner a swimming pool business and they build new pools in Florida. He would like to petition for him to come and work for him through a work visa and have him work for his company. Is there any way and for which visa he can apply for? My wife's brother in law does not have a college degree or a 'specialized' skill set with accompanying portfolio. He is a hard worker that would like the opportunity to come to the united states with a work visa THEN potentially (through proper procedure) apply to bring his wife and daughters if possible by tourist visa and changing status. He is adamant that he does not want to come with a tourist visa with his family and stay illegally. He has an established restaurant in Colombia and property that he does not plan to abandon or sell. Is there any possible route or visa type for applying for a work visa though his cousin's husbands pool business? I am thinking since he does not have a 'specialized or extraordinary' skill, maybe the lack or labor market is the angle for approval? I believe H-2A - not a preferred option as he does not plan to come and work in agiculture worker. He wants to come and be close with family which is why the pool business they can petition him because they would love to have him work with him. H1B - Specialty Occupation - would this be considered specialty with no degree or specialized portfolio? H2B - Temporary Non-agricultural worker - this is the only option i can think would be the visa to apply for. Looking for advice. O1 Visa - extraordinary abilities? Any suggestions or tips would be greatly appreciated.

On August 24, 2022 we received and RFE for my Adjustment of Status process for us to re send through the USCIS portal Completed and signed Form I-864, (Affidavit of Support) Provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864. Submit the petitioning sponsor s Federal income tax return, including all supporting tax documents On August 25, 2022 we replied the RFE with the form I-864 form and all its supporting documents but mistakenly submitted the form I-864 with an incorrect calculated household. What can I do???? PLEASE HELP!!

Hi everyone, we are filing an I-130 petition for my wife and her son. We are using an attorney in Colombia. The attorney filed the petition electronically and sent me the case number which says it is being reviewed. I never received a copy of the receipt notice in the mail and at the time I could not get ahold of our attorney. By the time he replied, apparently he had a medical emergency, I had already sent an inquiry to uscis about not receiving a notice in the mail. It is their reply that has me a bit concerned. On 03/01/2022, you or the designated representative shown below, contacted us about your case. Some of the key information given to us at that time was the following: Caller indicated they are: -- Applicant or Petitioner Attorney Name: -- Information not available Case type: -- I130 Filing date: -- 11/01/2021 Type of service requested: -- Non-Delivery of Approval Notice The status of this service request is: We have received your service request. Our systems indicate that you are not the applicant, petitioner, or attorney of record for the receipt number provided. Therefore, we cannot release any information to you regarding this case. The Privacy Act, 5 USC Sec. 552a, prohibits release of information to someone other than the affected party. The affected party is typically the petitioner, applicant or attorney of record. Disclosures of processing times and general procedures relating to certain form types do not fall under the Privacy Act. However, information given to someone other than the affected party, such as the beneficiary, which relates to the specific processing or adjudication of a particular petition or application is prohibited by the Privacy Act and Service policy. In addition, only the petitioner or applicant may request a change of address or other changes be made to the record. We cannot process changes requested by the beneficiary or a third party. We hope this information is helpful to you. There is a few other things in the email that I omitted case number etc but basically it seems like they are saying my name was not on the petition?? Is something off here ? I double checked the case number was correct and it was what my attorney sent me. Also as of now I have seen a photo of the paper notice but for whatever reason my attorney has not mailed it to me as I asked him to do.

Hello, everyone! I had an interview scheduled for next week at the Orlando USCIS office. I suspect it was a combo interview, since my husband and I have a pending I-751 (but I only ever received an invitation letter for the citizenship interview). However, it was cancelled last week when I checked online and just got the official cancellation letter in the mail today. I know of at least one other Visa Journey member whose naturalization interview at the Orlando office was scheduled a few weeks prior to mine, and theirs was also cancelled. I found out mine had been cancelled precisely because I had messaged them to ask about their ceremony, they told me they never even got to the interview, and then I checked the status of mine. I also notice in the VJ timelines that a few other people also with interviews set at the Orlando office recently haven t updated their timelines. It just makes me wonder if there s something else going on. Is there anyone else here with the same issue at this office? Is there maybe a mass cancellation going on? Please, chime in with your experiences or opinions. Thank you!
