Hello All,

We are based in Viriginia. Well I got my SSN today :dance: so we thought we'd get my driving license application done, but they won't let me do it! It seems, that along with masses of other evidence/papers, I need a green card to apply. Has anyone else applied for a driving license in Virginia yet? Did the same thing happen....Grrr....it is so frustrating after driving for 20 years in many countries all over the world!

Silvia Applied with an expired i-94 and no EAD, one place turned her down so we went to another city and BINGO she got her licence.

If you can go find another office, it worked for her!

12/31/07: Sent I-751 packet to Texas, the LONG wait begins once again!

01/03/08: Packed received.

Kiki, I can understand your frustration. My wife and I made 3 trips to the Virginia DMV and each time we were told something different. However; to make a long story short, the only paper work that was required was the following:

1. A utility bill with my wife' name

2. SS card

3. I-485 return notice - the DMV enter the receipt number or your 'A' number to verify that you are in the Department of Homeland Security system. This only allow you to have a valid license for one year

4. Marraige certificate

Hi Guys,

I also live in Virginia, in Norfolk to be exact. I need more of your info which office works on you to get the DMV. I mean the location / address. I need to get one too near in the future, since I just took care the joint account of utility bills. Also, I do have SSN card with married name, even if, I don't have EAD yet with me, just NOA 1.

I-129 F / K-1 Visa in 2005:

Jan 10 : Received NOA 1 from VSC

Jan 27 : Received approval e-mail

Feb 5 : Received NVC letter

Feb 9 : Received NOA letter

Mar 7 : Received packet for visa interview

Apr 25 : Medical exam

Apr 26 : Screened documents and interview approved

May 13 : Picked up visa

Sep 11 : Went to the US

Oct .... : Got SSN in maiden name

Nov 13 : Wedding Day!

AOS in 2005 till 2006 :

Dec 12 : Sent AOS + EAD

Dec 22 : Received NOA1 letter

Dec 28 : Got touched

Feb .... : Received SSN in married name

Feb 18 : Received Bio letter of AOS + EAD

Feb 23 : Appointment of biometrics of AOS + EAD

The rest is a waiting game :)

Feb 25 : Got touched AOS + EAD

Mar 1 : Received an e-mail stating EAD card will be sent

Mar 2 : Received an e-mail stating an approval letter is already sent

Mar 4 : Received EAD card in the mail

May 24 : AOS Interview

July 14 : Touched (said that the decision took 120 days)

July 19 : InfoPass Appointment & Passport got stamped for GC. What a surprise!

July 20 : Got a welcome letter from USCIS and that GC card would be mailed soon. What a surprise!

July 25 : Got a GC in the mailbox. Wow...what a real relief! My status is now clear:)

Deal with USCIS again in April 2008

We applied at the DMV in Hampton. I would like to add to the information noted above that the SS card has to have your married name on the card.

One of the documentations required as stated on the DMV list is an unexpired or expired I-94. My wife had 3 weeks remaining on her I-94 and the DMV told us that they could only give her a valid license for 3 weeks. I pointed out that per there requirements that an expired I-94 could be used but she told us that it was a mistake. Then I proceeded to ask why is it on the list of items that could be used to obtain a Va. license and she could not give me a good answer. If you went to 3 different offices in Va. you will probably get 3 different answeres on the required documents to get a license.

We went to two different offices 4 times and was told something different each time. Now that the K-1 has expired and we have filed AOS/EAD papers I guess we are back out of the ball game to drive in VA.

I got a license in Richmond by showing my k-1 visa. The license then expired when my k-1 visa did (three months after my entry in the US). I then brought my NOA for my I-485, and they issued me a license that expires one year after the NOA mailling date. The person at the DMV was pretty clueless, they really don't now what to look for. However, she did have papers explaining what to do with a I-485, and I had to butt in and point it out to her, she was looking for I-797 on the list...which I believe is just the number for a NOA. Ask for a supervisor, they might be a little more helpful...or not. Good luck!
