3 years married... or 3 years GC?

I've been reading the guidelines of when to apply for citizenship and I'm not quite clear....

We married in November 2006 in Denmark, and came to the US in March 2007 and applied for GC.

Got my GC in August 2007.

Can I apply on the 3rd year of marriage... or on 3rd anniversary of GC?

4/14/10 Email approval for 13 yr Old CR 4/23/10

Oldest son now 21 I-130 filed by LPR dad ( as per NVC CSPA is applying here )
I-130 approved 2/24
Priority date 12/6/2007
4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

If you entered the US with a tourist visa, then 3rd anniversary of GC. If you entered with an immigrant visa, then 3rd anniversary of entry to the US.

If you entered the US with a tourist visa, then 3rd anniversary of GC. If you entered with an immigrant visa, then 3rd anniversary of entry to the US.

Haven't heard of that either, just that you have to meet both requirements, married for three years and a lawful permanent resident for three years and thought to be a LPR, you have to have a green card or they wouldn't ask for proof of that. But can apply 90 days before that 3rd anniversay. If you come here with an immigration visa, don't you have to get married within 90 days, then start all that AOS stuff that can take more than a couple of weeks?

1) third anniversary of marriage to the USC

2) third anniversary of being a LPR

3) third anniversary of your USC spouse being a USC....

application window begins 90 days prior to the latest of the three above dates

I was already married to my USC husband when I entered the USA on a B2 and did an AOS....

So I'll file 90 days before the 3rd anniversary of my GC, which is next May.

Two minor corrections. The first criteria should read "third anniversary of marriage to and living with USC", and you can only get a 90 day shortcut on the 3 years of LPR, not on the 3 years married to USC or 3rd anniversary of spouse's citizenship.

This correction isn't important to the OP's situation, though, but it is important to some of those who entered on CR-1 visas. If you only started living together on the day you became a LPR, then you have to wait until three full years after that day. See the box at the bottom of page 22 of the M-476

If you are applying based on 5 years as a Permanent Resident or 3 years as a Permanent Resident married to a U.S. citizen, you may file for naturalization up to 90 days before you meet the continuous residence requirement. For example, if you are applying based on 3 years of continuous residence as a Permanent Resident married to a U.S. citizen, you can apply any time after you have been a Permanent Resident in continuous residence for 3 years minus 90 days. You may send your application before you have met the requirement for continuous residence only. Therefore, you must still have been married to and living with your U.S. citizen spouse for 3 years before you may file your application. You must also meet all the other eligibility requirements when you file your application with USCIS.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.
