Filing I-129F delayed processing of I-130 in my case!

Timeline

On April 4th, I spoke with an immigration officer from California service center. She initially told me that my I-130 filing date was showing as January 2008 and so I'll have to wait for a few more months before my filing gets to an immigration officer. When I explained that my I-797C notice of action actually shows a receipt date of September 25, 2007 she took my phone number and said she would call me this week as she needed time to research my case,.

This officer was kind enough to call me this morning and told me that since I filed I-129F in January, my I-130 was also showing as filed in January 2008! She told me she would corrected this mistake and my case should get processed soon.

So August / September 2007 I-130 filers if you are still waiting on NOA2 for I-130 and also filed I-129F, it is possible that your I-130 got paired with I-129F. This could explain why October / November I-130 filers are getting NOA2 ahead of us.

Keep in mind the I-130 ultimately will be held pending the K-3 case, USCIS will hold back the I-130, and send the I-129F on to NVC and consulate for K-3 visa. The I-130 will be held for eventual adjustment of status from the K-3.

hey thanks for the info! maybe thats why not many of us who filed for k3 are not getting approved since most of us sent the i129f in january..i filed my i130 in oct and have not heard anything.. im at VSC!

The act of filing an I-129F for spouse pretty much renders the issue of processing the I-130 moot.

If you want an immigrant visa, don't file an I-129F for spouse.

I think part of the point being made, is that the processing of the I-129F is held up due to the receipting delay.

People don't file I-129Fs because they want an immigrant visa. They don't want the K3 held up because of the receipting delay.

AOS

May 23, 2008 - AOS filed

June 3, 2008 - NOA

June 27th - scheduled biometrics, reschedule requested

July 14th - biometrics

July 16 - cases available online

Aug 6th - card production ordered (EAD)

People don't file I-129Fs because they want an immigrant visa. They don't want the K3 held up because of the receipting delay.

As for my final statement, you'd be surprised how many people still think their I-130 processing impacts their K3 timeline 16 months after that stopped being the case.

I know there was a time when I-130 receipting delays resulted in delays filing an I-129F but that's opposite the point being made by the OP in this thread.

I think some glitch in USCIS case management system made I-130 filing date to match that of I-129F. I know there are quite of a few of us in this situation. I trust my conversation with the immigration officer corrected my I-130 filing.

Corrected or not, both petitions are likely to be approved the same day. Then your I-130 will be held anyway, making all dates associated with it moot anyway.

That may be but it is not addressed in this thread. Correcting the date on the I-130 will have no bearing on this case at all. Now, if they corrected the I-129F to use the correct I-130 receipt date as the starting point for processing priority, the OP would be getting somewhere or actually impacting the timeline of their K3 case.

It's hard to be sure whether it will or won't affect the case. If the I-130 had been left uncorrected, then the both petitions might have been shuffled later in the queue. It really depends on how USCIS organizes things. While it appears that the I-130 received date correlates with the processing order of K-3s, this does not necessarily mean that USCIS would reshuffle a particular case due to a correction. Still, I don't think we can discount the possibility that it might. I don't want to get the OP's hopes up, but this is an interesting case to keep an eye on.

Thanks, only time will tell. It is troubling to note that I-129F (K3) instead of speeding the unification process works just the other way for those of us affected by the processing delays.

It's hard to be sure whether it will or won't affect the case. If the I-130 had been left uncorrected, then the both petitions might have been shuffled later in the queue. It really depends on how USCIS organizes things. While it appears that the I-130 received date correlates with the processing order of K-3s, this does not necessarily mean that USCIS would reshuffle a particular case due to a correction. There's a possibility the correction will impact the K3 process and yes, this would be interesting to watch.

Here's a hypothetical to examine.

File the I-129F 4 months after the I-130 when I-130s are taking about 4 or 5 months to process. Will you get an approved I-129F in 30 to 45 days? It's possible. I've seen I-129F for spouse petitions approved in 30 to 45 days when done at NBC separate from the I-130 at CSC. Will the early I-130 filing date speed up the I-129F in such a case? I'd like to know but wouln't hold my breath.

That's why I'm back to recommending filing the petitions together again. We've see it work at least once already. Why not more?

I hope others have better success with filing together. We did it, and while it did not negatively affect our case, it certainly didn't appear to speed things up at all.

We sent both petitions in late July 07 and got NOA1 for both petitions in about a month and within a few days of each other. However, we ended up getting processed at the same time as other who sent their I-130 at the same time, but sent their I-129F up to several months later. We were able to get an NOA1 for both more quickly, but in the end, it made no difference. Still, I don't regret it as I was able to get my petitions submitted and receipted quickly. I think this made for a less stressful experience overall as we weren't biting our nails waiting on an I-130 NOA1 in order to send our I-129F.

I don't know if prioritizing K-3s using the I-130 receive date will continue to be USCIS policy(official or otherwise) as it may be a temporary way to ensure fairness due to the receipting debacle in the second half of last year.
