Timeline

Anyone who came in on K1 get their Florida license before AOS approval?

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Yes,

my husband got his... for the life of his visa.. it expired when his visa did..

The visa or the I-94?

I was told to bring all of my husband's immigration papers w/ him to take the test.

A friend of ours got her license w/ her NOA for AOS...

I want to know if my husband can do the same thing?

Timeline

I went about a month before my I-94 was going to expire and was told my licence would expire with my I-94. She told me instead of having to pay twice, to come back once I got my NOA1 for my AOS application and I'd be able to get my licence. I haven't gone yet, but I plan on doing so within the next couple of weeks.

Yea - thanks. This is good to hear about the NOA. Since you're the second person to tell me that it makes me feel more confident. This is what the Florida DMV website says:

Non-Immigrants

Each non-immigrant who applies for an original driver license or identification card must submit:

  1. Employment authorization card issued by the United States Department of Justice (Form I688B or I-766); or
  2. Proof of nonimmigrant classification provided by United States Department of Justice (Form I-94, not expired, with required supporting attachment(s). If in doubt regarding required documents, please bring all of your INS documentation with you.). I-94s must be accompanied by a Passport. Certain classifications require additional documentation. Some examples are:
    • F-1 and M-1 classification must also be accompanied by an I-20.
    • I J-1 or J-2 designation must be accompanied by an IAP-66.
    • Refugee, asylee and parolee classifications must be accompanied by additional documentation.

Timeline

My husband took his Cuban passaport.. and I dont know if they looked at his visa or parole.. really..

he was given the DL with experation date, of three months of his entry date.. hope this explains better..

oh and if he has a DL from his country, he doesnt need to take the drug and alchohol class..

He didn't have a license in Brazil (as it is very expensive and not everyone has a car)....so he did take the on-line course.

He has the test scheduled for Tuesday and he is allowed to have a translator - as long as it's not me. Our neighbor agreed to do it (no problem) but I want to be sure so we don't waste anyone's time.

The DMV didn't give me much information about immigration on the phone - so I want to hear other people's experiences.

My husband got his on a B2 with an expired I-94 with his AOS NOAs. They said he came here legally, so okayyy... (He'd gotten one before with a letter from his father's attorneys explaining his status before he met me, and I guess DMV took it, but I think that's because they're idiots.)

I'm pretty sure it doesn't work like that most of the time. But that's our experience.

green card received: may 5, 2007

Let us know how you make out. We showed the same documents as you, except for the Bio letter. My wifes licence will expire the same as the I-94.

April 2009 Filed for removal of conditions.
May 09 2007 Biometrics
Aug 31st Congratulations letter, no interview needed
Sept 21st 2009. New green card with conditions removed arrived.

N400 Status
07/26/10 N400 mailed via UPS. Three year rule
08/03/10. Check cashed.
08/06/10 NOA letter received, but "Request for evidence" showing on the status website.
08/08/10 NOA #2. Biometrics appointment letter. Scheduled for 08/31/10
08/09/10 Biometrics completed. Walk in.
11/01/10 Touched. Transferred to local (Tampa) office
12/06/10 Interview . Passed
01/11/11 Oath ceremony

OH yeah, his license was valid for 1 year...hoping he can go back with the green card and get the expiration date changed to April of 2009. :D

Timeline

It was suggested I can bring our marriage license since my husband came on the K1 visa - we can show more proof he's in the AOS process. (If the DMV understood that).

I just don't want to waste the time of the friend (translator) who is coming with us. However, over the phone they're not able to answer everything.

I'll post our 'story' afterwards. Thanks you guys for your help.

I think we'll be ok with the AOS NOA.
