Does anyone know how my husband is supposed to claim tax for me and my daughter? We live in the USA, my daughter and I are currently awaiting our green card, I filed in may 07. I just want to know what steps he has to take etc.

Since his status changed during the tax year of 2007 and on December 31, 2007 he will be married = He will either file jointly, married filing separately or Head of household, you will have to run the numbers all three ways and calculate which one is most advantageous to you for having the lowest tax liability. :dance:

The above info is not correct.... he can not file as Head of household if he is married as of Dec 31st 2007 and his wife is living with him, he can file as Married Jointly or married separate... if he does not have a SSN for wife and Child then a W-7 should be filed along with the tax return to get ITIN for them both....

It's a form you fill out that gives an ITIN if you or your daughter do not have SSNs yet.

You are not correct, think about it, all depends on living arrangement at end of Dec 31, 2007 which we have not reached yet and like I stated there are three options to pick from and you should check all three out at that time, or better yet with a CPA to decide which one will work the best for your household.

Jointly is better...married filing separately is the WORST way to file.

Depends a bit on the situation, but generally this is probably true. Most of the online tax programs (Turbo Tax, etc) will let you figure it both ways and see which will be better for you.

True, if they are still married, but you have not reached the time to file yet, keep your options open until then, stranger things have happened. Thus that is why I say you have three options and to review each at that time. :whistle:

I see that I'm at least aware that head of household is for UNMARRIED people. Unless the OP and her spouse get divorced in the next two weeks, her husband CANNOT file as head of household. And considering she's asking about taxes and didn't post this in the Effects of Major Events on Immigration benefits (divorce/death forum), I'd pander a guess that they aren't planning on getting a divorce in the next two weeks. :wacko:

OMG you are such a dickhead.... please dont give people advice on a subject you know very little about.... the OP was asking about filing taxes for this coming tax season in case you have not looked at a calender lately that starts in 2 weeks.... and yes as a IRS Registered Tax professional I can give advice about how to file taxes.... do you suggest that I tell all my clients who are now making appointments to come and discuss their filing options that they will have to wait until after the 31st of dec before I can see them just in case they might get divorced in the next 2 weeks?????
