I recently married a Japanese woman who was in the US on a F-1 Student Visa.

I understand that I need to fill out the I-864 Affidavit of Support even though my income does not meet the requirements of 125% above poverty line. I have been in school for the past five years and I have never worked "on the books" all my work has been "under the table" so I must file as unemployed with an annul income of $0.00.

My father is the joint sponsor, he will fill out his own I-864 and attach all the necessary tax forms that show sufficient income.

I have never filed income tax, so I cannot attach the tax forms to the application,

is this a problem, should I attach a note explaining that I have been a student and therefore unemployed?

Also, the I-864 form does not ask the relationship of my father to me or my wife, should I include a note indicating the relationship?

Your advice will be greatly appreciated.

If you made over the filing requirement, which is somewhere around 4000 I THINK (but I always have a hard time finding this info), you were supposed to pay taxes, regardless of whether your employer put it on the books or not.

If you didn't make over 4000, you can attach an explanation citing the tax code that says you do not have to file.

Attach a note explaining and then make sure you get IRS official tax transcripts for your Dad last three years of tax returns and try to submit his W-2 forms along with his copies of Individual Tax Returns for past three most current years. :thumbs:

Declare your earnings and pay the tax that is owed (if any) and then make sure you file a tax return for each year that you were working....

Explaining you were working under the table is not a very good idea.... unless you want IRS investigating you while you are trying to file for AOS....
