I think Texas is one of the more lenient ones in terms of shooting to defend property. There's no duty to retreat on your own property, and at night the person whose home is invaded isn't responsible for trying to determine the thief's intent before shooting.

But it's not his home, surely relevant because a) he wasn't in danger himself and b ) he is not in as good of a position to know whether someone is breaking in or not. A friend of mine in high school once had to climb in through a window because he locked himself out at home; a neighbor called the cops, who showed up and were amused to find that there was nothing wrong beyond a seventeen-year-old being dumb. Sort of glad the neighbors didn't decide to kill him, you know?

LOL. If it would be legal to shoot people for sheer stupidity in Texas, we'd sure have a different guy in the White House today. I don't think W would have had a chance down there. ;)

What I find funny is that the European press and many here in the USA look at GWB as some sort of Texas cowboy with a "shoot first, ask questions later" mentality. His family background is far from that stereotype.

As many would say...he's all hat and no cattle. ;)
