Question about RFE

Hi All,

In my RFE email update it says "This case will be held in suspense until we either receive the evidence or the opportunity to submit it expires." Does anyone know generally how much time do they give to submit the evidence? Also, since my I-129F is suspended at the moment, does that mean my I-130 processing will also be suspended?? Any insights will be appreciated.

If the RFE concerns both petitions, then both petitions will be held. In my case it was the size of my wife's photos for both petitions, so both were held. The good part for me was , once I gave them the proper photos, my petitions were approved within a week or two. But its very frustrating to call and have USCIS and have them tell you that you must wait for the RFE in the mail. USCIS usually gives you somewhere around 6 weeks to return RFE.

Our RFE was generated Oct 5, 2007 and I had to December 28, 2007 to respond. Until you respond back the applications remain in suspense. Good luck and make sure you send exactly what they are asking for.
