EAD and AOS in filed in July and nothing...

Okay, I posted this a little bit in a reply on another board but thought I would start my own thread and try to get some help...

We filed in July for AOS and EAD. In August we got a Biometrics appt. and went to that. Two weeks later we got an NOA for both. (Yes, it came AFTER the bio appt.) Since then? Nothing. It has been four months. I called USCIS on October 29th and they told me to have my husband call back because they couldn't talk to me. That day we got "touched." Two days later he called back. On that day USCIS told him that they were just now getting around to those filed on July 29th and since his was on the 31st if he called back at the end of the week they should have something new to tell him. At the end of the week we called back and they told us that they were just now getting to July 25th and to call back in a couple of weeks.

(Yes, they seemed to have regressed.)

A few days ago we called again and the dude told us that there was a "problem" with his EAD (that's what we're waiting for mostly at this point) and that a "hold" was put on it the 30th of October. The day after my first call. He couldn't tell us what it was. He said that he would put an inquiry into it and to call back in 60 days. 60 days! and it should have been adjudicated on October 16th! Now he won't be able to work until after Christmas at least.

We have sent emails to our Congressman. We were thinking of doing an infopass but have heard that they just do an inquiry there and if the guy on the phone already did it should we even bother?

I have personally found that an infopass appointment can shed a lot more light onto the situation so try it out.

But don't worry about it. Sounds like it could just be an RFE. Good luck.

Cool. I'll go ahead and make an infopass appointment for him then. What kind of RFE would they need for an EAD?

Timeline

An RFE could really be for anything, even a missing signature on a document. In our case, we had to send in a 1099.

The RFE would technically be for the AOS but an EAD cannot be processed without everything in the AOS application checking out.

So if there is an RFE out for the AOS, the EAD process is also put on hold.

Thank you. That's probably the problem. Who knows, we might have messed something up on the application and all that goes with it. Had pretty good luck up til this point.

As a note an RFE held up my EAD. I only received it this month after nothing. I was received in the end of June, so your time line sounds similar to mine day wise. I would infopass without a doubt just to talk to them and find out exactly what is going on. The [mis]Info line is very useless.

We've made an appointment with infopass for Thursday. Wish us luck! We still haven't heard ANYTHING with AOS. (Not even a touch since August.) But one bridge at a time for now...

We haven't had a touch for my hubby's AOS since May...

The only way for us to get the EAD in less than 90 days was to make infopass appointments.

Well, we went in for the Infopass today. It was a 2 hour drive and we were in and out in 5 minutes. Basically, they have no idea what is going on, just that the EAD is being "on hold" and "has nothing to do with the AOS." We asked if they needed more information or if we had done something wrong and they said they had no idea. They would send an inquiry in and we should hear something in 10 days. So let's hoping we hear something in 10 days...

I'm sorry you didn't have the issue resolved there, but it may happen now because you made the appointment. It's not fair, IMHO, to make people wait so long for the EAD.

I've seen a couple cases (ours included) where the infopass made the difference - you just didn't see it for days.

Well, we got the email yesterday saying that the EAD had been approved and that we will have it in 30 days. Whoo hoo! Something must have worked...
