We are preparing our AOS forms. I am the non USC and I just noticed that my passport is about to expire September of this year. Do I need to have it renewed now b4 aos filing? Or in a later time? Does this matter when filing AOS?

Aug 16 06 - Mailed AOS by Fedex 2Day

Aug 25 06 - NOA for AOS & EAD

Aug 30 06 - Received mail for Biometrics Appointment

Sept 6 06 - AOS Transferred to CSC

Sept 9 06 - Biometrics Appointment

Nov 03 06 - EAD APPROVED!!!! WOOOOOOOOOOT!

Nov 20 06- AOS APPROVED!!!! OMG THANK YOU! THANK YOU THANK YOU! ..now just waitin for d card to arrive ^_^

If you have a valid passport right now, so you're okay to file.

It's always a good idea to have a valid passport on hand -- so you can file with your consulate for a new/extended passport.

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Hmmmm...can't remember for AOS..I would check into it. for the VISA(*which you're done with all that, I realize) you have to have a passport that's valid for at least 6 months into the future, but I'm not sure about AOS. I would check it out, or wait for more replies here. It only takes about 2 weeks to get another one, so why not do it just to be safe..ya know? :) M.

PS...I just reread..sorry. Didn't realize it was still valid 'til September...if you're just wanting to send your forms as quickly as possible, my advice(and you'll get more from others probably! :) ) would be to just file, and apply for a new passport as soon as possible afterward. By some far out chance you get an RFE for something like THAT, you will have it right on hand to send to them..and really what would be another 2/3 week delay for an RFE at that point? I applied for my AOS in September while my passport expired in April the next year. I sent my AOS package with copy of my old passport since I couldn't renew it until 6 months before its expiration date. Didn't get any problems at all :)

Me- Indonesia & hubby - US

married in Vancouver, Canada

USCIS-free for 10 years !

I applied AOS first, and then 1.5yrs later, (7mths b4 it expires), i renewed it again..

During my interview though (i didnt' get approved yet, bcz the doctor didn't check POS or NEG for both syphyllis and HIV), the officer asked me "IS this the passport you used to file?" NO

"Do you have the old one?" NO

dunno why he asked me that
