hehe okay guys Im getting all this information because Im about to apply for the I-129f at the end of this month.. so Chris and I are just starting this little journey... Sorry for the confusion but all of this is helpful.. oh btw after I apply for this I-129F does he file over there for a K1 visa??? Argh Ive been reading and reading and this is all very frustrating .. Back to reading I go I will just send the Required I-129F and the G-325a mine and his along with our photos to the TSC at the end of this month.. argh IM so confused again :S

No time like the present to learn the process and get the lingo right. The I-129F is a petition, not an application. When approved, it gives the foreign fiance the right to apply for a visa.

Don't send it to TSC. They only process fiance visa petitions in California and Vermont now. In what State do you live?

Okay so when the I-129F gets approved hes to file for a K1 visa over there? I live in Texas and was told by the operator from USCIS to send my petition to the Beaumont office.. Should I send it to the Cali office instead? Im assuming that he can find out the processes he has to go through for the K1 visa on the UKVisa's website? hehe You guys have been so helpful and amazing :) Thank you soo much!!! :)

OH ya, ure in for a little wait. We did take some shortcuts, 4 months after we filed, to shave time from the consular processing phase.

We filed in June/July. Until the NOA2, approval of the petitions arrives, we basically have to cool our heels. BUT, in order to save time, we contacted the embassy and sweet talked them into providing us with Packet 3 information, and filled out all of the documents in October. We arranged everything, then made an appointment in October for a "document check", this is basically required before an interview can be scheduled. Once all of our documents were found to be in order, they supplied the medical forms and a list of doctors for the medical check, which is the next thing we have to do. We also picked up our police cerfiticate that week. I understand that in GB that the police cert takes up to 30-40 days, so that might be something that can be done ahead of time (police cert) but its only good for 6 months I think, so it could expire before your approval. They told us at the embassy that the medical results were good for a year, but we were waiting on an A-number from the Dept of State (the NVC) before we set that up because the results go straight to the embassy and there is possibility that in the next 2-3 months they could be lost.

SO:

After the petition is filed, it will gather dust for 5-7 months, probably. Around month 4-5, it would probably be good to start getting the forms filled out for the embassy application, arrange for the police certificate, and look into medical screening. For the K1 visa one of the forms that will have to be filled out, over there, is the DS-156 which is the actual visa application. http://evisaforms.state.gov/ has this form if you want to take a look at it.

Once all of that is done, then an appointment for interview can be made. The evidence of financial support that I supplied (the list) is only one of the things that will be required in the document package for the interview, and some consulates want that or similar information stapled to an I-134 Affidavit of Support. The income table is for household, so income requirements go up if there are other dependents (children, mother-in-laws <kidding>, etc) involved.

Hello All,

I am new to this forum, and I was referred her by immigration portal. I am in the process of bringing my fiance over here on a K1 visa. I got a free evaluation from a lawyer and he said that I need an affidavit of financial support. But what my question is is that when I called the USCIS to get the earnings of how much I am to make to support him the kind lady on the phone said that for a 2 person household, my income would have to succeed $17,112 a year. Well I make around $12 an hour and that would be $23,000 a year. Now why would the lawyer say that I would need an affidavit of support or a cosigner? Anyones help would be greatly appreciated.

Hi. I just wanted to make sure you weren't confused about 2 points from your original post.

The first comment of yours that I have bolded above, says that you need an "affidavit of financial support'. As many have stated here, that affadavit is the form I-134. It is required by ALL petitioners, regardless of their income, who are going through the K1 Visa process. The form and its supporting documentation is presented at the embassy during the final interview (that will be many months down the line for you guys). So, the attorney did not make some kind of "evaluation" of your sutiation and conclude that you need to submit an "affidavit of financial support'. He simply quoted you this standard requirement which is needed by all petitioners going through the K1 Visa process.

The second comment of yours that I have bolded above, says "Now why would the lawyer say that I would need an affidavit of support or a cosigner?" Again, why you need an affidavit of support is because ALL Petitioners are required to provide this. The "...or cosigner" is referring to the POTENTIAL need for a "Co-Sponsor". A Co-Sponsor (not "co-signer") is a second person who, in addition to the petitioner's affidavit of support, also submits an affidavit of support. This Co-Sponsor is only needed when the petitioner does not meet the financial support qualifications for their sponsored K1 Visa Beneficiary. In effect, each of 2 different people (the Petiitoner (you!) and the Co-Sponsor are both, individually demonstrating their intention and ability to financially support the K1 Visa Beneficiary. One of the main financial support qualifications is the demonstration of sufficient income. This is the $17,112 annual figure that you were advised of.

If you haven't yet had a chance to read through the K1 process guides pinned here at VJ, those will give you an excellent initial overview of the steps of the journey on which you are about to embark.

Thanks for all the information guys!!! :) Since the TSC doesn't process I-129 F Petitions anymore where should I send mine to? Where can I find the addresses and such...
