Hello All,

I am new to this forum, and I was referred her by immigration portal. I am in the process of bringing my fiance over here on a K1 visa. I got a free evaluation from a lawyer and he said that I need an affidavit of financial support. But what my question is is that when I called the USCIS to get the earnings of how much I am to make to support him the kind lady on the phone said that for a 2 person household, my income would have to succeed $17,112 a year. Well I make around $12 an hour and that would be $23,000 a year. Now why would the lawyer say that I would need an affidavit of support or a cosigner? Anyones help would be greatly appreciated.

$12 a hour comes out to a little less than $25K a year. Are you working full time? Is this a new job, as in just starting out? You should be fine, but what he/she may be looking at is perhaps you are not working full time or that you have only been in this job for a little while. In any event, you make above the minimum for 2 people, so you should not need a co-sponsor.

Could he be referring to an I-134?

Hello All,

How long have you been out of the States? If you can't show regular employment, this may require a co-sponsor even though you make above the minimum now.

** If you didn't work last year for example.

I just lost my job of 3 years, when I returned because I had to stay there an extra 4 days due to him getting ill. I was over there for 2 weeks, and I just found out this last Monday I had lost my position for the company, I just found a new job and start tomorrow. I have been employed for the past 10 years continuously.

This is what they want at the interview, per a note from OUR embassy, emphasis on our because the embassies differ slightly in what they look for. At our document review (this has to be scheduled prior to the interview, but hey, I was there so why not?) we provided last years income tax return/W2, letter from my employer, benefits summary from my work (not applicable to your case, we are already married) showing health insurance enrollment, and a year's worth of bank statements. They said it was too much but arranged it all in place anyway lol).

8. Evidence of Support. The applicant must provide evidence that he/she will not become a public charge. Evidence of support could include fax copies of applicant's petitioner most recent Federal Income Tax Return (1040) and Tax Statement (W-2), or an employment letter stating salary or wage.

The OP's petition results in a visa application for a beneficiary processing through the London consulate.

Three questions for the OP:

When do you anticipate the interview?

Is there a probationary period for this new job?

Do you or your fiance have any children?

I can provide bank statements and my past 3 years tax forms and such, so does me just starting this job mean that I will have to file an affidavit of financial support, because I am fixing to file and send off the I-129F form to the TSC with the check... I am new to this all and I want to send as much supporting documents to make this go smooth. Anything you guys could tell me would be great :) Yes there is a probationary period for this new job, 90 days. Would that require me to file the affidavit?

You have not yet filed the K1 petition, correct? If so, this means the interview is several months down the road.

By that time, will the probationary period have passed?

As far as the affidavit is concerned, you do not file it with your petition. It is presented at the consulate interview by your fiance.

You don't "file" an affidavit of financial support with the petition. For a K1 visa, the most common procedure is to fill out an I-134 form. Its name is "Affidavit of Support". If your income is sufficient, as it appears to be, you will be able to sponsor your fiance as the sole sponsor.

The affidavit relates to your promise and ability to support your fiance and later wife. After the marriage, you'll "file" an I-864 "Affidavit of Support" with her application to adjust status. The I-864 is mandatory and binding.

hehe okay guys Im getting all this information because Im about to apply for the I-129f at the end of this month.. so Chris and I are just starting this little journey... Sorry for the confusion but all of this is helpful.. oh btw after I apply for this I-129F does he file over there for a K1 visa??? Argh Ive been reading and reading and this is all very frustrating .. Back to reading I go I will just send the Required I-129F and the G-325a mine and his along with our photos to the TSC at the end of this month.. argh IM so confused again :S

No time like the present to learn the process and get the lingo right. The I-129F is a petition, not an application. When approved, it gives the foreign fiance the right to apply for a visa.

Don't send it to TSC. They only process fiance visa petitions in California and Vermont now. In what State do you live?
