Is it necessary to submit the Affidavit while filing I-751

Hi.

I am preparing to send my I-751 and was wondering if it is neccessary to submit the Affadiavit... and if yes.. can we have the affadvit from a family member.. like father in law, mom in law etc... we do other evidence like mortgage, we also bought a new car in both of our names... bills, etc..

any help will be appreciated.

1/24/08 - Transferred to VERMONT

1/26/2008 - NOA

2/23/2008 -Biometrics

12/16/2008 finally Approved

N-400

12/03/08 Eligible to file N400

10/03/09 Mailed N-400

10/07/09 NOA

10/13/09 Check cashed

10/30/09 FP appointment

11/07/09 Case sent to Local office for interview

11/23/2009 Received interview letter with an as of date of 11/18/2009

12/15/2009 Interview scheduled ---Approved

01/06/2010 Oath Ceremony

I've seen some VJers who did not submit any affidavits but got their I-751s approved. We did not submit any affidavits either but our case is still pending.

08/17/08: Mailed N400 to TSC

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

..............................................Notice date : 08/22/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

01/17/09: Applied for US Passport and passport card

01/28/09: Received US Passport

Since my local office too is Charlotte, NC. i am not gonna send a affidavit... anyways all the best ....

Just to confirm something.. My CR1 was approved on Feb 3 2006 .. so does that mean that i can send the application anytime till Feb 3 2008... i am planning on sending the application with the next week.

Timeline

The filing window opens 90 days before the expiration of your greencard. You can file any day within those 90 days. If you file too early your I751 package will be returned.

Mar 24, 2007: biometrics receipt dated Mar 09

Mar 28, 2007: NOA1 dated Mar 09

Mar 28, 2007: biometrics letter dated Mar 22

Apr 06, 2007: biometrics appointment

(Oct 09, 2007: called USCIS: service request sent to TSC)

Jan 31, 2008: case transferred to VSC (last touch date changed from 04/07/07 to 02/01/08)

Feb 01, 2008: touch

Feb 04, 2008: touch

(Feb 05, 2008: infopass appointment)

Feb 07, 2008: transfer notice dated Feb 01, 08

Feb 13, 2008: touch (Current Status: This case is now pending at the office to which it was transferred.)

Feb 25, 2008: touch

Apr 11, 2008: approval email! (only took 1 year, 34 days!)

Apr 13, 2008: 2 more approval emails

Apr 16, 2008: email notice: "Approval notice sent"

Apr 18, 2008: MISSION ACCOMPLISHED!!!! card received!

Karenros,

As Kez indicated, you can send in your I-751 anytime between now until Feb 3, 2008. If you are not in special need of the extension letter, then you don't have to rush as long as you get it sent out before the conditional green card expires.

it is 2 years after you get the green card not the Cr1 visa....

it is 2 years after you get the green card not the Cr1 visa....

The OP did not enter on a CR1 visa they entered on a K3 Visa and was approved for AOS on 02/03/2006... so their 90 days would end on 02/03/2008
