Approved April/May/June Filers waiting for NVC

my husband called NVC last friday and told him our papers are not with them yet so i guess i will ask my husband to call the misinformation line at CSC on monday or maybe i'll just have to wait for the mail to come from NVC. what worries me is why we havent receive NOA2 for my daughter's I-130. we haven't reached the 6-month mark yet so we are hesitant to call CSC.

05/29/07 sent I-130s for me & my daughter at CSC

06/16/07 checks for I-130 cashed

06/19/07 sent I-129F not waiting for noa1 but with printed online copies of checks cashed

06/25/07 check for I-129f cashed

06/29/07 transferred I-129f to CSC

07/03/07 received noa1 in the mail for I-129f

10/31/07 approved K3 and my I-130 except for my daughter

11/05/07 received NOA2 in the mail

12/01/07 received mail from NVC/yey we got our case number

Ours was sent to the Embassy on 16 NOV 2007. So three days at the NVC, not bad.

As in Nov. 16? Hmm. That is quite awhile. You may be in the same boat as edp333. Their I129F was not forwarded yet (and they were approved on Oct. 23). Ed called CSC and after explaining the situation convinced the person he spoke with to request a transfer, hopefully that will get it (re)sent.

04/18/2008 - both of us are home at last, POE JFK!

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

your daughter is covered on your I-129. She will not need the I-130 until she adjusts status here. She will travel on a K-4 and is not required to file a seperate 129f. (assuming she is listed on your 129f and is a minor)

so, i sent email to mumbai consulate using ApprovalPlease's template (i only requested packet3). I got an auto reply back saying

USCIS's stated policy is to hold approved I130s for AOS and to send the approved I129Fs to NVC to be forwarded to the embassy. They had some trouble initially implementing this policy, but are now actually following it pretty well. If you look at the hard copies of your NOA2s, the I130 NOA2 will say something to the effect that your spouse is already in the US and will adjust status, while the I129F NOA2 will say that it was sent to NVC.

If its the I130 that you were inquire about that wasn't sent to NVC, it won't be sent to NVC unless you send the I824 to USCIS to tell them to forward it. Several problems there, the fee for this form is over $300 i believe, and it takes like another 6 months to process. Then you have to go through a minimum of 3-4 months at NVC. Also, you have to hope that your child's I!30 is approved within this time frame.

Essentially by sending in the I129F now, you are locked into that path. There is almost no chance of having both horses in the race like people had a year ago. The length of time to get a CR1/IR1 is not much longer than that for a K3, but only if you pursue the CR1/IR1 directly. Once you file the I129F, to get the CR1/IR1 the timeline as you can see is way longer, and probably not worth pursuing.
