Hi everyone,

I have been stalking this site for a while, I have been deciding if I should just get a lawyer, but tons of you guys say no.

Well here is my problem, My fiance is originally from Tunisia and he is illegally living in Rome, where we met, now, he does not have a criminal record in Tunisia but one in Rome....fighting when drunk kinds of things. I'm actually not a hundred percent positive about his record. It's not like he can go into a police station and ask for his criminal report without being arrested for not having documents. Well, My question is do we need a criminal report for Italy, or is Tunisia fine. Confused about the whole thing. I have a long way before the interview but that is one of the reasons why I want to hire a lawyer.

If he has lived there ,officially yes, as on some forms you have to list his addresses lived at since age 16, last 10 years , work history and employment addresses ,etc. was he was arrested and convincted ? Also look at what crimes USCIS and DOS really care about, these are spelled out on I-129f and DS-230, if he can answer yes to any of these, he better answer yes, and you will most likely be RFE'd or get a AR. Also most likely he is going to have to return to Tunisia for the interview, can he do that ?

On the side , just out of concern- fighting when drunk ? think about that please

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Interview to visa - 10 days

Filing to visa- 341 days

Wait wait wait......... I made him seem like a killer or something, We've been together for 3 years, a couple of year before we met he had a break down when his father died. He had a fight with someone in a bar. Don't judge so quickly. Thanks for the reply, Is there a number I can call?

Here are the things I would be thinking about if I were in your situation. How long has he been in Italy? Is this the first time he has ever been to Italy..any other country besides Tunisia? Has he departed and reentered Italy again since the first time he came to Italy? When was his last time back to Tunisia? How long has he been gone from Tunisia? Does he still receive mail, etc at some address in Tunisia? maybe for example at his parents/brothers house, etc?

"Living" in a place and "vacationing" in a place are not necessarily defined exclusively by the amount of time in question.

Of course, one of the factors that also has to be considered is how (by what means) he got into the country.

I'm not judging him, your op was vague on his record, its something you need to know. His illegal status in Italy matters little to USCIS, just may present some difficulties in getting a police record, and if ever arrested/ convicted a clean one. As for not disclosing to USCIS that he has been living outside of Tunisia, all I will say is that if they catch you not being 100% truthfull you could be in for a world of hurt.

Sounds like he's been in Italy quite some time. Certainly if he resided there more than a year, he's going to need a police report from Italy. It will be the Consular Officer that needs this, not USCIS. Always tell the truth in the visa process. Yes, I think you need a very competent attorney. From what you mention in another thread, I take it the attorney was either not aware of the police report problem, has a way around it in mind, is incompetent or simply didn't get enough information from you.

Facts are cheap...knowing how to use them is precious...

I told the lawyer everything, maybe he might be incompetent, I do not see any way around it. I found out some great information with some here in the forum that had a similar problem. My fiance has not commited a crime that would be concidered a non waiver crime. No Drugs, NO murder, Only stupid little things, we plan to get his criminal report by mail from Italy, and work from there. Like I said before in another thread, I'm starting the process this week. I've done a lot of networking and have a networking party with our alderman and other few important people in Chicago. Next friday will be the night to ask questions. There is a woman that has already done the K1 process and I'm going to see if she'll over our petition and see if its all in order.

Khaled had his documents but because the italian government is #######, they have not renewed it, for reasons unknown. Its a while before we have an interview, I just wanted to work out everything a head a time in my head before we do this on our own without counsel. I figured out how to get the criminal report to see what are options are and if there is going to even a problem.
