Fiance' is Nigerian but lives in UK

Hello, I am new to visajourney and would like to thank you in advance for help on this question. I am an American citizen, who met my fiance' online almost a year ago. He is a Nigerian man who has lived in the UK (London) for 16 years. He left Nigeria to attend university in UK.

I have gone to visit him this year and will go again in January. We will become officially engaged when I go then. Our question is "Do we file the K1 Fiance visa from the standpoint of him being Nigerian, and thus apply via the Nigerian embassy. Or do we apply from the standpoint of him being a British Nigerian, and apply via the London embassy. This is so confusing to me. He is still in London on student/employee visa (excuse me if I am not using the vocab correctly).

Please help me. I have researched many places on the www and cannot find an answer to this question.

You can apply through british embassy because he lives in London. Someone please correct me if im wrong. Im an austrian citizen but i applied through German embassy because i live in Germany. If you do apply through nigerian embassy how is he going to attend the interview? You have to put his resent add on the petition.

As long as he is a legal resident of the UK he can apply via the London embassy.

Right.

You are actually going to petition for him here as a Nigerian citizen living in UK. Then they will schedule his interviewing wherever he has been living for 6 months or more once it leaves NVC. Unless his student visa is expiring which means he's returning home soon, they'll just send it to the closest embassy to his address in the UK.

MY fiance had a student visa when he went through South Africa; everything was fine. Feel blessed that you don't have to go through Nigeria.

February 17, 2005--mailed in I 129F to CSC!

February 24, 2005--1st NOA

March 15, 2005--2nd NOA

April 11, 2005--Fiance receives Packet 3

May 19, 2005 Fax Checklist(Nigeria police report finally arrives)

June 6, 2005-- Interview Date!!!!Visa approved!!

June 18, 2005--Fiancee arrives in Hawaii!

August 14, 2005--wedding in Oregon

September 12, 2005--sent in AOS

September 20, 2005--1st NOA AOS

September 23, 2005--Walk-in biometrics completed

October 1, 2005--fingerprints received/processing resumed

November 26, 2005--EAD card received in mail

June 7, 2006--contact senators about AOS

June 28, 2006--senator says interview date is for August 14!!

August 14, 2006--AOS interview and 1 year wedding anniversary
